Pleasant Oaks Plantation Rice Field Restoration and Protection Project
Dear Mr. Talty:
On November 28, 2016, the Division of Water Resources (Division) received your application
dated November 18, 2016, requesting a 401 Water Quality Certification from the Division for the
subject project. On January 12, 2017, the Division received an email message chain in which
Brennan Dooley of the US Army Corps of Engineers notified the applicant's environmental
consultant on December 6, 2016 that the proposed project would be processed under the
Standard Permit procedures. The Division has determined that your application is incomplete
and cannot be processed. The application is on -hold until all of the following information is
received:
1. Please provide the Division a copy of your response to the January 12, 2017 email from
the U.S. Army Corps of Engineers requesting additional information. [15A NCAC 02H
.0502(c)]
2. A Public Notice issued by the U.S. Army Corps of Engineers (USACE) will be necessary to
begin the proper consideration of an application (pursuant to 15A NCAC 02H .0503). The
Division will be notified by the USACE when a Public Notice is issued for your project. No
action is necessary by you for this item at this time. This letter is to serve as notification
to you that your application cannot be processed until a Public Notice has been issued.
Pursuant to Title 15A NCAC 02H .0502(e), the applicant shall furnish all of the above requested
information for the proper consideration of the application. If all of the requested information is
not received in writing within 30 calendar days of receipt of this letter, the Division will be unable
to approve the application and it will be returned. The return of this project will necessitate

reapplication to the Division for approval, including a complete application package and the
appropriate fee.
Please respond in writing within 30 calendar days of receipt of this letter by sending three copies
of all of the above requested information to the 401 & Buffer Permitting Branch, 1617 Mail
Service Center, Raleigh, NC 27699-1617.
Please be aware that you have no authorization under the Section 401 of the Clean Water Act
for this activity and any work done within waters of the state may be a violation of North
Carolina General Statutes and Administrative Code.
