Re: Responses to your "Notice of Violation" letter 2/22/99
Arbor Greene Subdivision, Wake County
Dear Mr. Dorney,
In response to your "Notice of Violation/Arbor Greene Subdivision letter dated 2/22/99, Fortis
Homes has implemented the following measures:
1) Bass, Nixon, and Kennedy recently sent a survey crew to this community
to delineate locations of all existing temporary sediment control devices and
detention basins. This information was plotted on to a site vicinity map showing
the detailed wetland delineation which was evaluated by Danny Smith, Pete Colewell,
and yourself on several occasions during 1998.
2) Robbie Bell of Bass, Nixon and Kennedy, and Jake Taylor, Wake County
Environmental Services, met on-site March 2, to evaluate the existing
structures and review alternatives to generate another Sediment and Erosion Control
Plan for this community.
3) Robbie Bell will supply Wake County Environmental Services a new Sediment and
Erosion Control Plan for their review and approval within 4 working days of this
meeting.

I feel strongly that implementing this plan prior to our March 12th meeting would not be prudent
unless the Division of Water Quality also agrees fully with the new plan before commencement.
There are a few areas in this community that may need additional on-site review from all parties
to come to a foregone conclusion. These issues are site specific.
As I discussed with you during our phone -conversation on the morning of 2/23/99, Fortis Homes
wants to cooperate fully in this matter. Fortis Homes is very concerned with regards to
interpretation of the Neuse River Buffers Rules within different governmental agencies and its
impact in this community.
