Neuse River Buffer Rules, Wetland/401 Certification' letter dated 2/5/99,

Dear Mr. Smith:
The purpose of this letter is to respond to your `Notice of violation/Notice of Enforcement' letter dated
2/5/99. S&EC, Inc. is responding to your letter on behalf of the FORTIS Home Corporation.
FORTIS and other parties involved will be conducting a project meeting during the week of 2/15/99-
2/19/99. The results of this meeting will be used in generating plans for achieving compliance with the
issues Iraised in your letter (including potential impacts to the Neuse River Buffers, violations of Section
401 of the Clean Water Act, violations of the General Conditions of Nationwide Permit 12 and violation
of the General Stormwater Permit and Sediment & Erosion Control Permit).
FORTIS (or a representative) willbe contacting you shortly after the project meeting. At which time you
will be provided with their plans for achieving compliance with the potential violations. An office
meeting between FORTIS, their representatives and the regulatory agencies involved will most likely be
requested to review these plans for compliance and to discuss how best to proceed.
Since the time of the potential violation, the project site has been stabilized and all approved (and some
additional) Sediment and Erosion Control devices are in place. No additional impacts will occur to either
jurisdictional waters (including wetlands) or riparian areas subject to the Neuse River Buffers until this
matter is resolved.
