1.0 Project Location and Description
Greene Environmental Services, LLC (GES) of Snow Hill, NC proposes the establishment of a
nutrient offset mitigation bank in the Tar -Pamlico River Basin, Lower Tar River Sub -basin
(HUC 03020103) (see Figure 11). The proposed Pactolus Nutrient Offset Mitigation Bank
(Bank) is located in central Pitt County, NC immediately northeast of the city of Greenville, NC
and on the north side of the Tar River. The proposed Bank will be established pursuant to the
GES Tar -Pamlico Umbrella Mitigation Banking Instrument (UMBI) that was made and entered
into by GES, acting as Bank Sponsor and the North Carolina Department of Environmental
Quality -Division of Water Resources on May 1, 2013.
The proposed Bank is located on two adjoining properties that are located on three tracts; all can
be accessed via Joe's Lane, an unpaved, private road off the south side of Old Pactolus Road
(SR 1534) approximately one mile east of the intersection of Old Pactolus Road and Sunnyside
Road (SR 1535) (Figure 1). A portion of the Bank is adjacent to Greenville's Bradford Creek
Public Golf Course. The latitude and longitude of the approximate midpoint of the Bank is:
35.615895 x -77.281218.
The regulatory purpose of the proposed Bank is to provide nutrient offset credits for new and
existing development in the 8 -digit Hydrologic Unit Code (HUC) 03020103 of the Tar -Pamlico
River Basin requiring nutrient offset mitigation in accordance with 15A NCAC 02B.0240. The
Bank will also improve water quality within the Tar -Pamlico River Basin by reducing nutrient
and sediment inputs into the watershed. Land -use within the vicinity of the proposed Bank is
primarily agricultural, golf course, secondary forest and low density rural development. Land use
within the Bank is currently row crop agriculture. There are two unnamed streams and a few field
ditches on the properties containing the proposed Bank. GES is proposing to restore
approximately 15.8 acres of riparian areas adjacent to one intermittent stream and one field ditch
onsite. Thus, generating approximately 35,913.78 lbs of Nitrogen nutrient credits and 2,400.96
lbs of Phosphorous nutrient credits. The exact acreage will likely differ slightly pending a certified
topographic survey. The final, adjusted acreages and nutrient offset yields will be submitted with the post -
construction "As -Built Report". Establishing a riparian forest community adjacent to these
waterways by planting native trees species and allowing natural vegetative succession to proceed
in perpetuity and establishing a permanent conservation easement, will ensure the reduction of

nutrient and sediment loading into those waterways.
1.1 Streams, Classifications and Water Quality Assessments Pertinent to the Proposed Bank
Stormwater runoff from this Bank site flows into two unnamed tributaries (S-2 and S-5) onsite.
Downstream and offsite, S-2 converges with S-5 which then flows eastward into Moyes Run,
approximately one mile downstream of the Bank (Figure 2). Moyes Run flows into Broad Run
which then discharges into the Tar River approximately two miles downstream from the Bank.
Upstream on Moyes Run from the confluence of the unnamed tributary with Moyes Run are two
tributaries, Baldwin Swamp and Cannon Swamp. All of these waterways are designated as Class
C, NSW as defined by the North Carolina Department of Environmental Quality (DEQ), Division
of Water Resources (DWR (http://deq.nc.gov/about/divisions/water-resources/planning/classification-
standards/classifications#Whataresurfacewaterclassification). There are no known records that
indicate routine ambient sampling of water quality monitoring by NC DEQ or other state or
federal agencies in Broad Run, Moyes Run, Baldwin Swamp, Cannon Swamp or the unnamed
waterways. However, statewide mercury contamination advisories apply to all of these waters
(Table 1).

1.2 On-site Stream Determinations
Three separate on-site stream determinations were undertaken at the proposed Bank by NC-
DWR staff. The first stream determination was conducted in May 2014 on features located on
the land parcel (Pitt County Tax Parcel Number 82874) east of Joe's Lane (Figure 3 and
Attachment 1). For purposes of this Bank, only the downstream portion of S-2 was determined
to be a stream and subject to the Tar -Pamlico River Riparian Buffer Rules (15A NCAC 02B
.0259). Other features that were assessed, including S-3, were determined to be field ditches and
are not subject to Rule .0259.
The second on-site stream determination was performed at the southern end of Parcel 82874, on
the large canal (designated S-5 on the 2014 stream determination maps in Attachment 1 and
depicted in Figure 3 and Figure 4) bisecting the property from west to east. It was determined to
be subject to Rule .0259. This canal is under a drainage district easement and thus was
determined not viable for riparian restoration to generate credits, as indicated in correspondence
from DWR on April 15, 2014 (Attachment 7). Feature E and S-3 were determined by DWR to be
the same field ditch and therefore is included in this mitigation bank for riparian restoration.
The third stream determination was conducted in April 2016 on the upstream portion of S-2
located on the land parcel west of Joe's Lane (Pitt County Tax Parcel Number 06448) (Figure 3
and Attachment 2). S-2 was determined to bean intermittent stream and subject to Rule .0259
and is included within the Bank. This upstream segment of S-2 was noted in correspondence
from DWR to have impeded water flow due to a damaged culvert located downstream along the
property boundary on Joe's Lane. DWR requires maintenance to be performed on the culvert to
bring the stream into compliance with the stream standards noted in 15A NCAC 02B .0211(2).
Greene Environmental Services, LLC, will repair the damaged culvert in S-2 as part of their
restoration plan.

1.3 Bank Description
The proposed Bank will consist of three tracts, Tract 1, Tract 2 and Tract 3. Tract 1 is located on
Pitt County Tax Parcel Number 06448 (Figure 4). Tract 2 and Tract 3 are located on Pitt County
Tax Parcel Number 82874. Riparian restoration wil be performed along one intermittent stream
(S-2) and one ditch (S-3) and will generate nutrient offset credit only (Figure 3).
1. Tract 1 will generate approximately 4.6 acres of riparian restoration along the upstream
portion of S-2 and will extend from the top of the banks of S-2, outward a maximum of
200 feet on both sides perpendicular to the stream.
2. Tract 2 will generate approximately 4.5 acres or riparian restoration along the
downstream portion of S-2 and will extend from the top of the banks of S-2, outward a
maximum of 200 feet on both sides perpendicular to the stream. Tracts 1 and 2 are
separated by Joe's Lane and a road/utility access easement (approximately 30 feet wide)
along Joe's Lane. The culvert connecting the ditch under the farm road will be replaced
to ensure that water flow in S-2 is unimpeded. Section 3.0 describes the remediation
efforts GES will perform on the culvert to restore water flow and connectivity to the
downstream reach of S-2.
3. Tract 3 will generate approximately 6.7 acres of riparian restoration along the ditch S-3
and will extend from the top of the banks outward a maximum of 200 feet on both sides
perpendicular to the ditch. S-3 is hydrologically connected to the canal labeled as S-5.
However, there is a culvert connecting features S-3 to S-5 that may require maintenance
in order to maintain the hydrologic connectively between S-3 and S-5. Pitt County
Drainage District Number 8, holds a 20 -foot drainage district easement on the north side
and 40 -foot easement on the south side of canal S-5 (Figure 4). The purpose of the
easement is to allow Drainage District maintenance equipment and personnel access to
the canal if the canal needs to be cleared or obstructions need to be removed to improve
regional drainage. Because of this existing easement, the riparian areas adjacent to S-5
are not permissible for use for mitigation on the Bank. The culvert is also within the
drainage district easement. GES has claimed responsibility on behalf of the landowner to
fix and maintain this culvert such that it does not hinder the hydrological connectivity of
S-3 to S-5 (Attachments 3 and 4). Culvert maintenance, if determined by DWR to be

necessary, will be performed prior to issuance of the second credit release.
2.0 Project Area — Existing Conditions
The proposed Bank tracts were in row -crop agricultural production for decades as suggested by
aerial imagery in the 1974 Pitt County Soil Survey (Figure 5). Most recently, soybeans were
grown in the proposed tracts during the 2015 growing season and sweet potatoes were planted
in 2016 and harvested during October. (Attachment 5). Tract 1, however, was left fallow for the
2016 growing season.
Drainage ditches and streamswithin the properties have been in place since at least the 1974 soil
survey. Tracts 1 and 2 are bisected by a farm access road (Joe's Lane) and utility right of way
(Figure 3). A culvert under Joe's Lane conducts water flowing eastward in stream S-2 from
Tract 1 through to Tract 2. The existing culvert will be replaced by a new culvert pending
approval of this BPDP to ensure continuous hydrologic connectivity. Another culvert is located
in S-3 at its confluence with S-5. This existing culvert will be evaluated for potential
replacement as well, pending approval of the BPDP.
Since the 1974 soil survey photographic images were taken, the properties to the west of the
proposed Bank were converted from largely agricultural usage to a golf course (Bradford Creek
Public Golf Course) and a townhouse development; the properties to the east of the proposed
Bank have been converted from agricultural usage to open pit sand mines. Properties north and
south of the proposed Bank are still largely in agricultural production. Soil and site conditions
are favorable for the successful establishment of planted vegetation that will mitigate some of
the adverse environmental effects associated with the current and future land use on the adjacent
parcels.
2.1 Geologic and Soil Characteristics
The property is located within the Inner Coastal Plain Physiographic Province, within the
Rolling Coastal Plain Ecoregion (online at:
http://pages.pomona.edu/—wsteinmetz/lDl/nc_eco_pg.pdf). Based upon review of the United

States Geological Survey (USGS), Greenville SE, North Carolina Quadrangle, the proposed
Bank is located in the Moyes Creek watershed with elevations ranging from ±10 feet to ±18
feet above mean sea level (online at:
http://www.mytopo.com/products/quad.cfin?code=o35077e3). Topographic relief and surface
drainage is generally eastward toward Moyes Creek which then discharges to the Tar River
(Figures 2 and 6).
There are three soil series mapped at the Bank tracts (Figure 5 and Table 2) (MRCS 1974).
Tract 1 is dominated by Portsmouth loam (Po). This soil series is very poorly drained soil of
moth and broad flats and slight depressions; infiltration is moderate and runoff is very slow or
ponded. The dominant soil in Tract 2 is Osier loamy sand, loamy substratum (Os). This soil
series is a poorly drained soil of broad flats, slight depressions and stream terraces; infiltration
is rapid and runoff is slow. Though not mapped, site inspections indicated well -drained sandy
inclusions in portions of Tracts 1 and 2 in areas the most distant from the ditch.
Tract 3 is dominated by Olustee loamy sand, sandy subsoil variant (Oe). This soil series is a
very poorly drained sandy soil of smooth flats and slight depressions on uplands and stream
terraces; infiltration is rapid and runoff is slow.
The soils upland and exterior from the Bank tracts are suitable for silviculture or agriculture if
adequately drained and will likely be kept in row -crop agricultural usage for the foreseeable
future. The soils immediately upland from the Bank Tracts 1 and 2 are better drained, the soils
adjacent to Bank Tract 3 are poorly drained.

2.2 Forested Communities Adjacent to Bank
The closest forested communities are located along the southwestern, southeastern and western
boundaries of the proposed Bank (photographs provided in Attachment 5). The forested area
along the southwestern boundary is dominated by mature trees consisting of sweetgum
(Liquidambar styraciflua), water oak (Quercus nigra) and loblolly pine (Pinus taeda). The
forested area along the southeastern boundary is dominated by young trees less than 20 feet in
height consisting of sweetgum (Liquidambar styraciflua) and black cherry (Prunus serotina).
The forested area along the western boundary is a pine plantation consisting of loblolly pine
(Pinus taeda) approximately 50 feet in height.

2.3 Threatened and Endangered Species
The North Carolina Natural Heritage Program (NCNHP) maintains a database that includes state
and federally listed species by USGS, 1:24,000 Topographic Quadrangle (NC-NHP:
http://www.ncnhp.org/web/nhp). The proposed Bank is located in the northeastern portion of the
Greenville SE, USGS Quadrangle and the Bank is situated greater than two miles from the next
nearest quadrangle (Figure 6). For this document, only federally listed, Threatened and
Endangered Species are required to be listed; for informative purposes only, otherwise federally
listed species are included as well in Table 3.
The West Indian Manatee, Trichechus manatus, is the only federally listed Threatened or
Endangered Species included for the Greenville SE Quadrangle in the NCNHP database (Table
3). It is highly unlikely that the aquatic habitat adjacent to the proposed Bank would support
manatees. The canals adjacent to the Bank are highly modified due to channelization, do not
support aquatic suitable vegetation that is part of the manatee diet, and are over two stream miles
from the deep water habitats that manatees require. Manatees have been sighted in the Tar River
during summer months, but their occurrence is very rare and at the extreme inland extent of their
range (http://ncforestry.info/ncnhp/rare_animal species/rare_animals_2008.pdf).
Bald eagles, not listed as Threatened or Endangered, but given special status under the Bald and
Golden Eagle Protection Act, have been seen in the vicinity during site visit to the proposed
Bank. That agricultural usage of the Bank site and the lack of mature nesting and perching trees
generally precludes usage by bald eagles. Similarly, the Bank site does not possess suitable
aquatic habitat for the federally listed, species of special concern included in Table 3.

2.4 Environmental Issues
A database review of mapped on-site and near -site sources of contamination was obtained in a
report from Environmental Data Resources, Inc. (EDR: http://edmet.com/). EDR maintains an
updated database of current and historical sources of contamination. The Executive Summary
of the EDR report is provided in Appendix 6. In the report, all known and mapped storage
tanks, whether above -ground or underground were identified, as well as superfund sites,
landfills, hazardous waste sites, and other potential hazards. No mapped environmental hazard
sites were noted in the report within a one -mile radius of the proposed Bank site.
2.5 FEMA Floodplain/Floodway Mapping
Most of the acreage within the proposed Bank tracts is within areas mapped as FEMA (Federal
Emergency Management Agency) Zone AE (Figure 8 and 9); Zone AE is also commonly
referred to as within the 100 -year floodplain (Table 4). FEMA Zone X, areas between the 100 -
year and 500 -year floodplain are present in Tracts 1 and 2. Also in Tracts 1 and 2 are areas not
mapped, thus above the 500 -year floodplain. The proposed Bank will not result in the
construction of structures or buildings within Zones AE and X and the restoration of the riparian
area adjacent to the streams and ditches will reduce erosion and sedimentation and is therefore in
compliance with current FEMA regulations (44 CFR 60.3 and 44 60.5).

3.0 Proposed Nutrient Offset Restoration Plan
In an effort to improve water quality in the Tar River and subsequently downstream in the
Pamlico River and Pamlico Sound estuaries, the NC Department of Environmental Quality
classifies the entire Tar -Pamlico River Basin as Nutrient Sensitive Waters (NSW) in the NC
DEQ 2010 Tar- Pamlico River Basinwide Plan (online at:

plans/tar-pamlico-2010 ). As such, various nutrient management strategies have been
implemented to reduce nitrogen and phosphorus loading in waters within the basin. One key
strategy is to promote the establishment of vegetated riparian areas along natural and man-
made water conveyances (ditches, canal, streams) that are within or adjacent to lands in
agricultural production. Vegetated riparian areas reduce nutrient in several ways. Permanent
vegetated riparian areas remove lands from agricultural production thus those lands do not
receive direct application of fertilizer (chiefly nitrogen, phosphorus and potassium) and
reduce soil erosion thereby reducing the nutrients (principally phosphorous) that are affixed
to sediments. In addition, forested riparian areas separate agricultural lands from waterways,
and with deep-rooted trees and stable soils, intercept, uptake and sequester nutrients found in
groundwater and surfaces waters emanating from those agricultural lands (Spruill 2004,
Klapproth and Johnson 2009, NC Conservation Network 2016).
The purpose of the proposed Bank is to convert the existing agriculture land use adjacent to
the streams and ditches into a riparian Restoration Site, which entails establishing and
preserving a 200 feet wide vegetated riparian area on both sides adjacent to the streams and
ditches on the Parcel. The vegetation will consist of planted native tree species and
eventually with naturally colonizing herbaceous, shrub and tree species that will buffer
adjacent land uses. The Bank will be planted with a mix of "character tree" species during the
winter of 2017. "Character trees" are defined as planted or volunteer species identified from a
survey of local vegetation on less degraded sections of the specified stream and from reference
literature that details native species. Seedlings of character tree species will be purchased from
the North Carolina Forest Service, Claridge Nursery in Goldsboro, NC, and/or ArborGen Inc.,
a seedling nursery headquartered in Ridgeville, SC. The character tree species chosen will be
based on their suitability to site and soil conditions as well as their availability. Probable species

and quantities that may be planted are listed in Table 5. For the proposed planting season
(winter 2017) the tree species available was severely limited as a consequence of flooding at
the Claridge Nursery during Hurricane Matthew. The majority of their seedling stock was lost
during the October 2016 flood event.
Soil conditions range from mesic moderately to well -drained sands to poorly -drained hydric
loams. Tree species will be planted according to their adaptations to on-site soil and
topographic conditions. Bald cypress (Taxodium distichum) will be planted along poorly -
drained, stream margins and in areas of standing water. Black gum (Nyssa sylvatica) will be
planted in hydric and mesic soils. Sycamore (Platanus occidentalis), green ash (Fraxinus
pennsylvanica) and willow oak (Quercus phellos) will be planted in mesic and hydric soils and
along the banks of S-2 where soil conditions are favorable. Alternative trees for supplemental
planting may include: white oak (Quercus alba) and red oak (Quercus rubra) on mesic sites,
and cherrybark oak (Quercus pagoda) on mesic and hydric sites, or other appropriately adapted
and native hardwood species as are available.
Tree seedlings will be planted in rows generally paralleling the stream and ditche. The rows
will be approximately twelve feet apart and the seedlings will be planted at intervals of
approximately twelve feet resulting in a yield of 320 seedlings per acre. An estimated 6000
seedlings will be planted on the 15.8 -acre proposed Bank, yielding an adjusted density of
approximately 380 seedlings per acre. These totals are based on an estimated acreage of 15.8
acres within the Bank. Bareroot seedlings will be planted while dormant during winter
(January to early March) of 2017. Planting will be accomplished by either mechanical means
(tractor equipped with specialized seedling planter), manually, or a combination of the two.
Prior to planting, the Bank tracts will be disked as a part of normal post-harvest farming
operations and to facilitate planting and help create a microtopography that reduces surface
water runoff and erosion and promotes surface water retention. Tract 1 may require a pre -
planting prescribed burn to reduce annual weeds that may have accumulated during the 2016
growing season. An appropriate seed mix will be applied to provide temporary ground cover
for soil stabilization and reduction of sediment loss during rain events in areas disturbed by the
disking.

Pending the approval of this BPDP, the culvert in Stream S-2 that is underneath the farm
access road (Joe's Lane) will be replaced with a new culvert to ensure continued hydrologic
connected between Tract T-1 and downstream portions of S-2. Similarly, the culvert in S-3
adjacent to its confluence with S-5 will be replaced if it is deemed inadequate for maintaining
the hydrological connection between ditch S-3 and ditch S-5.
The "As -Built Report" will include a finalized topographic survey indicating exact acreages
within each tract and the total Bank. Also, any deviations in planting design, species
composition and maintenance of culverts from those elucidated in this document will be
explained and justified in the "As -Built Report".

4.0 Monitoring and Maintenance Plan
The Bank will be monitored annually for a minimum of five years, or until the DWR success
criteria have been met. Supplemental planting or other site modification deemed necessary to
achieve success criteria will be documented in the annual monitoring report for that particular
year.
Vegetative success will be monitored within the restored nutrient offset riparian areas and a
monitoring report will be provided to DWR no later than December 31 St of each year for five
years or until success criteria have been met. The report will include vegetative plot data
monitored in accordance with the CVS-EEP Protocol for Recording Vegetation (CVS-EEP, v.
4.2). Plots measuring 100 m2 (10m x 10m) (0.0247 acres) will be permanently established at
the approximate locations identified on Figure 10. The exact locations of the plots will be
indicated on the topographic survey that will be included in the "As -Built Report" prepared

after all planting and site work is completed. A sufficient number of plots will be randomly
established in each of the three tracts based on the final acreage in accordance with the UMBI
and will be placed at random. A minimum of two percent of the Bank acreage is required to be
in monitoring plots, thus 0.316 acres of the 15.8 acre Bank. Thirteen 10m x 10m plots contains
0.321 acres, thus slightly more than the required monitoring plot acreage. Adjustments to the
number and location of the monitoring plots will be made pending a final topographic survey to
determine the exact acreage of the Tracts and Bank. Expectedly, based on current acreage
estimates, Tract 1 will contain four monitoring plots designated PAC -1A through PAC -1D;
Tract 2 will contain four monitoring plots designated PAC -2A through PAC -2D; and Tract 3
will contain five monitoring plots designated PAC -3A through PAC -3E, for a total of thirteen
monitoring plots. Plant species composition, survival rates, character species density and tree
height will be recorded within each plot, as well as general notes on problems encountered or
unique situational developments.
Photographs of each plot from the same plot corner will be included in the annual monitoring
reports to provide DWR with a snapshot of the site success each year. At the end of the five
year monitoring period, target acreage density of 320 planted trees is required according the
LIMBI. Monitoring will take place between late August and October. The first annual
monitoring report will be submitted by December 31, 2017 and the projected final annual
monitoring report, pending approval by DWR, will be submitted by December 2021. The
easement boundary will be checked annually as part of monitoring activities and the conditions
as well as any maintenance performed will be reported in the annual monitoring reports to NC
DWR.
5.0 Financial Assurance
Greene Environmental Services, LLC will provide a performance bond to ensure completion of
all mitigation work. The amount of the performance bond shall be efficient to cover all costs
associated with establishing the site for its proposed mitigation, but shall not be less than
$150,000. Upon approval of the "As -Built Report", Greene Environmental Services, LLC will
provide financial assurance in the form of a monitoring bond to ensure that adequate funds are
available for completion of the maintenance and monitoring outlined in the BPDP under

Section 4 and in the LIMBI. Performance bonds for monitoring shall be renewed annually to
cover the next years monitoring period, with confirmation of renewal provided to DWR with
each annual monitoring report when applicable. DWR reserves the right to alter the credit
release schedule if monitoring reports are submitted without proof of bond renewals when
applicable.
5.1 Long -Term Management
GES will establish a permanent conservation easement approved by DWR on the proposed
mitigation bank. The proposed easement boundary is shown in Figure 3. Signage will be
installed at prominent locations along farm roads and paths to identify the Bank tracts as
protected, conservation areas. The signs will be maintained by Greene Environmental Services,
LLC for the duration of the five-year monitoring period. The signs will list prohibited activities
within the Bank (e.g., mowing or cutting vegetation, excavation or deposition of spoil material,
vehicular traffic), as well as contact information for Greene Environmental Services, LLC.
Easement boundaries will be identified in the field to ensure clear distinction between the
Parcel and adjacent properties. Boundaries may be identified by marker, bollard, post, tree -
blazing, or other means as allowed by site conditions and/or conservation easement. Boundary
markers disturbed, damaged, or destroyed will be repaired and/or replaced on an as needed
basis.
6.0 Nutrient Offset Mitigation Potential
The proposed Pactolus Nutrient Offset Mitigation Bank is located in and will be available for
mitigation banking in the Tar River Subbbasin HUC 03020103 (Figure 11). Nutrient offset
credits generated from this mitigation bank will be provided to offset nutrient loads within the
8 -digit HUC 03020103. The proposed Bank will generate approximately 15.8 acres of nutrient
offset (nitrogen and phosphorus) credits. Table 6 below and Figure 3 details the credit
generation for this site. . The Sponsor will maintain 2 credit ledgers. One to account for
Phosphorous nutrient offset credits and one to account for Nitrogen nutrient offset credits. The
Sponsor will maintain 2 credit ledgers. One to account for Phosphorous nutrient offset credits

Dear Mr. Knowles:
On May 2, 2014, at your request, Mr. Roberto Scheller of this Office conducted an on-site determination of drainage
features located on the subject property. The drainages were reviewed for applicability to the Tar -Pamlico Buffer Rules
in accordance with (15A NCAC 2B .0259). The features are labeled as "S 1, S 2, S 3, S 4" on the attached maps and
initialed on May 5, 2014.
The Division of Water Resources (DWR) has determined that the features labeled as "S 1, S 3, and S 4" on the attached
maps and highlighted in red are not subject to the Tar -Pamlico Buffer Rules. The feature labeled as "S 2" on the
attached maps and highlighted in blue is subject to the Tar -Pamlico Buffer Rules. The stream determinations are as
illustrated on the attached maps and marked on the ground with yellow DWQ flagging.
The owner (or future owners) should notify the DWR (and other relevant agencies) of this decision in any future
correspondences concerning this property. This on-site determination shall expire five (5) years from the date of this
letter. Landowners or affected parties that dispute a determination made by the DWR or Delegated Local Authority that
a surface water exists and that it is subject to the buffer rule may request a determination by the Director. A request for
a determination by the Director shall be referred to the Director in writing c/o Karen Higgins, 1650 Mail Service Center
Raleigh, NC 27699-1650. Individuals that dispute a determination by the DWR or Delegated Local Authority that
"exempts" a surface water from the buffer rule may ask for an adjudicatory hearing. You must act within 60 days of the
date that you receive this letter. Applicants are hereby notified that the 60 -day statutory appeal time does not start

Topographic map at a 1:24,000 scale are "Subject" to the Tar -Pamlico River Riparian
Buffer Protection Rule. There may be other streams located on your property that do not
show up on the maps referenced above but still may be considered jurisdictional
according to the US Army Corps of Engineers and/or to the DWR.
Please note that the stream had impeded water flow due to a damaged culvert located
downstream along the property boundary on Joes Lane. This issue needs to be addressed
as soon as possible, to provide for suitable aquatic life propagation, maintenance of
biological integrity and all other relevant items as required under 15A NCAC 02B .0211

This on-site determination shall expire five (5) years from the date of this letter. Landowners or
affected parties that dispute a determination made by the DWR may request a determination by
the Director. An appeal request must be made within sixty (60) calendar days of date of this letter
or from the date the affected party (including downstream and/or adjacent owners) is notified of
this letter. A request for a determination by the Director shall be referred to the Director in
writing c/o Karen Higgins, DWR 401 & Buffer Permitting Branch, 1617 Mail Service Center,
Raleigh, NC 27699-1617.
This determination is final and binding unless, as detailed above, you ask for an appeal within
sixty (60) calendar days.
The owner/future owners should notify the Division of Water Resources (including any
other Local, State, and Federal Agencies) of this decision concerning any future
correspondences regarding the subject property (stated above). This project may require a
Section 404/401 Permit for the proposed activity. Any inquiries should be directed to the

Pitt County Drainage District Number 8 oversees the maintenance of the drainage district project along
with overseeing the easements within the project area. A culvert that hydrologically connects Tract 3 of
the proposed Pactolus Nutrient Offset Mitigation Bank to a drainage district canal that discharges into
Moye's Creek a tributary of the Tar River in Pitt County, NC is located within the drainage district
easement of Drainage District Number 8. This culvert is located within parcel number 82874 (Pitt County
OPIS). The coordinates for the culvert are latitude: 35.615023, longitude: -77.279919 (Attachment 1).
The Drainage District has determined that it is the landowner's responsibility to maintain the culvert in
question and replace it if needed to maintain hydrologic connectivity between the tributary and the
canal. The Drainage District requests that they be contacted prior to any major work on or replacement
of the culvert.

This letter pertains to the responsibility for the maintenance and, if necessary, replacement, of a
culvert that hydrologically connects Tract 3 of the Pactolus Nutrient Offset Mitigation Bank to a
drainage canal that discharges into Moye's Creek a tributary of the Tar River in Pitt County, NC.
The culvert lies within the drainage district easement of the Pitt County Soil and Water
Conservation District, Drainage District Number 8 (Drainage District Number 8) and is within
parcel number 82874 (Pitt County OPIS). The coordinates for the culvert are latitude:
35.615023, longitude: -77.279919 (Attachment 1 to the Etheridge letter dated June 15, 2016).
As stated in the letter from Mr. Tim Etheridge, Drainage District Number 8, maintenance of the
culvert is the responsibility of the landowner. The Drainage District requests notification prior to
work being performed on the culvert and is available to provide technical assistance if necessary.
I am conveying the responsibility for maintenance of this culvert to Greene Environmental
Services, LLC of Snow Hill, NC to ensure that hydrologic connectivity is maintained.
Responsibility for the maintenance of this culvert will be addressed in the Pactolus Nutrient
Offset Mitigation Bank, Bank Parcel Development Package, submitted to the NC Department of
Environmental Quality, Division of Water Resources.

Brownfields are real property, the expansion, redevelopment, or reuse of which may be complicated by the presence

When Congress passed the Clean Air Act Amendments of 1990, it required EPA to publish regulations and guidance
for chemical accident prevention at facilities using extremely hazardous substances. The Risk Management Program
Rule (RMP Rule) was written to implement Section 112(r) of these amendments. The rule, which built upon existing
industry codes and standards, requires companies of all sizes that use certain flammable and toxic substances
to develop a Risk Management Program, which includes a(n): Hazard assessment that details the potential effects
of an accidental release, an accident history of the last five years, and an evaluation of worst-case and alternative
accidental releases; Prevention program that includes safety precautions and maintenance, monitoring, and employee
training measures; and Emergency response program that spells out emergency health care, employee training measures
and procedures for informing the public and response agencies (e.g the fire department) should an accident occur.

The EDR Proprietary Manufactured Gas Plant Database includes records of coal gas plants (manufactured gas plants)
compiled by EDR's researchers. Manufactured gas sites were used in the United States from the 1800's to 1950's
to produce a gas that could be distributed and used as fuel. These plants used whale oil, rosin, coal, or a mixture
of coal, oil, and water that also produced a significant amount of waste. Many of the byproducts of the gas production,
such as coal tar (oily waste containing volatile and non-volatile chemicals), sludges, oils and other compounds
are potentially hazardous to human health and the environment. The byproduct from this process was frequently
disposed of directly at the plant site and can remain or spread slowly, serving as a continuous source of soil
and groundwater contamination.

Hey David,
I just got a copy of the stream call letter done at Pactolus and the Stream Call request form sent
by you to the Washington Regional Office. Why didn't GES have the Regional Office staff
conduct a stream call of Canal B? If wanting nutrient offset credit on the ditches flowing into
Canal B, you would need to have a stream call done on Canal B. You can't buffer Canal B since
it's under a drainage district easement, but you still need a call done on that feature to determine
whether those ditches are flowing into an intermittent stream or a ditch.
