application: The property is currently vacant forested land. It is bordered on the east by the railroad tracks, on the west by
NC 147, south by Ellis Rd., and on the north by industrial properties. Other industrial properties and a charter school exist on
the south side of Ellis Road. Phase 1 including the Ellis Road Apartments project and offsite sanitary sewer (previously
permitted) is under construction.

The entire 302 acres were delineated and field verified by the USA CE and City of Durham (COD). The site plan was
developed to avoid as many impacts as possible. To minimize stream loss, the applicant proposes to use a bottomless arch
culvert at crossing "S2" to avoid permanent stream loss in this location. Temporary stream impacts are requested during the
construciton of the arch culvert and riprap is proposed up to the OHWM of the stream.

As per the project engineer; Standard Erosion Control measures will be incorporated such as silt fencing, inlet protection all
upstream structures and appropriately sized sediment riser basins will be utilized during construction. Post -construction
stormwater management and riparian buffer protection is incorporated into the design to protect avoided streams,
wetlands and other waters.

The overall project being the Ellis Road Assemblage is a Phased development that is anticipated to require additional impacts
to streams, wetlands and riparian buffers. However, the details of these impacts have not yet been identified. The applicant
understands that future impacts will be cumulative to these impacts. All development will be subject to Durham stormwater
and water quality protection ordinances to include the protection of riparian buffers and requirement for approved SMPs and
associated BMP devices. As such, nearby downstream water quality will be protected.

I administrative penalty, and/or appropriate legal action.
This verification will remain valid until the expiration date identified below unless the nationwide authorization is modified,
suspended or revoked. If, prior to the expiration date identified below, the nationwide permit authorization is reissued and/or
modified, this verification will remain valid until the expiration date identified below, provided it complies with all requirements of
the modified nationwide permit. If the nationwide permit authorization expires or is suspended, revoked, or is modified, such that the
activity would no longer comply with the terms and conditions of the nationwide permit, activities which have commenced (i.e., are

Determination of Jurisdiction:
A. ❑ Based on preliminary information, there appear to be waters of the US including wetlands within the above described project
area. This preliminary determination is not an appealable action under the Regulatory Program Administrative Appeal Process
( Reference 33 CFR Part 331).
B. ❑ There are Navigable Waters of the United States within the above described project area subject to the permit requirements of
Section 10 of the Rivers and Harbors Act and Section 404 of the Clean Water Act. Unless there is a change in the law or our
published regulations, this determination may be relied upon for a period not to exceed five years from the date of this
notification.
C. ® There are waters of the US and/or wetlands within the above described project area subject to the permit requirements of
Section 404 of the Clean Water Act (CWA)(33 USC § 1344). Unless there is a change in the law or our published regulations,
this determination may be relied upon for a period not to exceed five years from the date of this notification.
Basis For Determination: The property contains relatively permanent waters, with indicators of ordinary high water
marks, stream channels of unnamed tributaries of Northeast Creek, and abutting wetlands. Northeast Creek is a tributary of Jordan
Lake, a Traditional Navigable Water.
Remarks: This JD was confirmed by field inspection on 9/4/2014. The drawing on the attached Sheets 1 -28 of 28,
"Wetland Delineation for Ellis Road Assemblage", revised on 01/19/2015, accurately depict the boundaries and locations of
jurisdictional waters of the US within the subject study area. The pond in high ground, as shown on Sheet 23 of 28, and the "isolated"
stream segments, are not subject to Section 404 of the Clean Water Act.
E. Attention USDA Program Participants
This delineation/determination has been conducted to identify the limits of Corps' Clean Water Act jurisdiction for the particular site
identified in this request. The delineation/determination may not be valid for the wetland conservation provisions of the Food Security
Act of 1985. If you or your tenant are USDA Program participants, or anticipate participation in USDA programs, you should request
a certified wetland determination from the local office of the Natural Resources Conservation Service, prior to starting work.
F. Appeals Information (This information applies only to approved jurisdictional determinations as indicated in B and C above).

Explanation: The feature(s) listed on the attached Table 1 have been located on the Soil Survey
of Durham County, North Carolina and/or the most recent copy of the USGS Topographic map at
a 1:24,000 scale, or was determined to be subject per section 8.5(B)(4) of the Durham Unified
Development Ordinance. Each feature that is checked "Not Subject" has been determined not to
be a stream or is not present on the property. Features that are checked "Subject" have been
located on the property and possess characteristics that qualify it to be a stream. There may be
other streams located on your property that do not show up on the maps referenced above but,
still may be considered jurisdictional according to the US Army Corps of Engineers and/or to the
Division of Water Resources (DWR).
This on-site determination shall expire five (5) years from the date of determination in this
letter. Landowners or affected parties that dispute a determination made by the City of
Durham may request a determination by the N.C. Division of Water Resources. An appeal
request must be made within sixty (60) calendar days of date of this letter or from the date
the affected party (including downstream and/or adjacent owners) is notified of this
letter. A request for a determination by the DWR shall be referred to DWR in writing c/o
Karen Higgins, Surface Water Protection Section, 1650 Mail Service Center, Raleigh, NC
27699-1650.
DWR's determination can be contested as provided in Articles 3 and 4 of General Statute 150B by
filing a written petition for an administrative hearing to the Office of Administrative Hearings

(hereby known as OAH). A petition form may be obtained from the OAH at
http://www.ncoah.com/ or by calling the OAH Clerk's Office at [phone] for information.
Within sixty (60) calendar days of receipt of this notice, a petition must be filed with the OAH. A
petition is considered filed when the original and one (1) copy along with any applicable OAH
filing fee is received in the OAH during normal office hours (Monday through Friday between
8:OOam and S:OOpm, excluding official state holidays).
The petition may be faxed to the OAH at [phone], provided the original and one copy of
the petition along with any applicable OAH filing fee is received by the OAH within five (5)
business days following the faxed transmission.

the proposed activity or other City of Durham permit(s).
