It is bordered on the east by the railroad tracks, on the west by NC 147, south by Ellis Rd., and on the north by industrial properties. Other industrial properties and a charter school exist on the south side of Ellis Road. Phase 1 including the Ellis Road Apartments project and offsite sanitary sewer (previously permitted) is under construction. 3b. Impact Justification and Mitigation 1. Avoidance and Minimization 1 a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project. The entire 302 acres were delineated and field verified by the USA CE and City of Durham (COD). The site plan was developed to avoid as many impacts as possible. To minimize stream loss, the applicant proposes to use a bottomless arch culvert at crossing "S2" to avoid permanent stream loss in this location. Temporary stream impacts are requested during the construciton of the arch culvert and riprap is proposed up to the OHWM of the stream. 1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques. As per the project engineer; Standard Erosion Control measures will be incorporated such as silt fencing, inlet protection all upstream structures and appropriately sized sediment riser basins will be utilized during construction. Post -construction stormwater management and riparian buffer protection is incorporated into the design to protect avoided streams, wetlands and other waters. 2. In the pre -development condition the site cover is mostly a mixture of wooded and open space with some impervious from roofs, driveways, and streets. The proposed development will consist of 215 single family lots as well as 125 townhome units. The overall project being the Ellis Road Assemblage is a Phased development that is anticipated to require additional impacts to streams, wetlands and riparian buffers. However, the details of these impacts have not yet been identified. The applicant understands that future impacts will be cumulative to these impacts. All development will be subject to Durham stormwater and water quality protection ordinances to include the protection of riparian buffers and requirement for approved SMPs and associated BMP devices. As such, nearby downstream water quality will be protected. 4. Sewage Disposal (DWQ Requirement) 4a. Clearly detail the ultimate treatment methods and disposition (non -discharge or discharge) of wastewater generated from the proposed project, or available capacity of the subject facility.
