A Categorical Exclusion (October 2007) was completed for this project and distributed shortly thereafter. Additional copies are available upon request. The North Carolina Department of Transportation (NCDOT) proposes to replace the 83-foot, two span Bridge No. 2 with a single span steel plate girder replacement bridge of 110 feet in length. The new structure will be built approximately 30 feet downstream, yet parallel to the existing bridge. An off-site detour will be used during construction, with the exception of emergency traffic. There will be a total of 36 feet of permanent impact to an unnamed tributary (UT) to the North Pacolet River due to the extension of a pipe. There will be <0.01 acre of temporary impact to the UT due to dewatering during the replacement and extension of the pipe. An additional <0.01 acre of temporary impact will occur to the North Pacolet River due to the removal of a footing from the northwest side of the existing bridge. The abutment on the southeast side of the bridge will be left in place to help stabilize the slope on that side of the river. This water resource is located in the Broad River Basin (subbasin 03-08-06, Hydrological Cataloguing Unit 03050105). The North Carolina Division of Water Quality (NCDWQ) index number for the North Pacolet River is 9-55- 1-(1). North Pacolet River is classified by the Division of Water Quality as a C-Tr water body. The NCWRC has designated North Pacolet River trout waters. No High Quality Water (HQW), Water Supplies (WS-1 or WS-II), Outstanding Resource Waters (ORW), or water that appear on the Final 2006 303(d) list occur within 1.0 mile of the project. The average baseflow width of the North Pacolet River is approximately 20 feet. Depth varies from 0.5 to 4 feet. The average baseflow width of the UT to North Pacolet River is 7 feet. The average depth of the UT is 0.5 feet. Permanent Impacts: There will be 36 feet of permanent impact to the UT to North Pacolet River due to the extension of a pipe. The existing pipe will be replaced and extended toward the bank of the North Pacolet River. Riprap will be placed at the end of the pipe, outside of the rivers bank, as an energy dissipater. Currently the existing pipe carrying the UT to North Pacolet River is perched, causing water from this stream to fall on the underlying substrate. NCDOT proposes to lengthen the pipe to correct this problem, and move the outfall away from the roadside, to reduce the chances of slope failure in this area. Temporary Impacts: There will be <0.01 acre of temporary impact to the UT to North Pacolet River due to dewatering during the replacement and extension of the pipe. An additional <0.01 acre of temporary impact will occur to the North Pacolet River as a result of the removal of the footing on the northwest side of the bridge. Due to the continuing slope failure of the adjacent mountain, the abutment on the southeast side of the bridge will be left in place to help stabilize this area and help avert obstruction of the North Pacolet River. Bridge Demolition: The existing structure consists of a timber deck on 1-beams supported on reinforced concrete abutments. The interior bent consists of a timber cap beam on timber posts with a concrete sill. The bridge will be removed without dropping components into "Waters of the United States". Utility Impacts: There are no utilities attached to the existing structure, and there will be no impacts to jurisdictional waters due to utilities. Schedule: The project schedule calls for a February 17, 2009 Let date with a date of availability on March 30, 2009. The review date for the project is December 30, 2008. Page 2 of 4 FEDERALLY PROTECTED SPECIES Plants and animals with federal classifications of Endangered, Threatened, Proposed Endangered and Proposed Threatened are protected under provisions of Section 7 and Section 9 of the Endangered Species Act of 1973, as amended. As of January 31, 2008 the United States Fish and Wildlife Service (USFWS) list 3 species under federal protection for Polk County (Table 1). Surveys have determined that no individuals of the protected species are present at the project site. The NC Natural Heritage database of rare species and unique habitats was reviewed in April 2008. There is no documentation of rare species or unique habitats occurring within 1 mile of the project area. A survey for dwarf-flowered heartleaf was performed on April 10, 2008. No individuals were found during the 2 man-hour survey. Table 1. The NCDOT is committed to incorporating all reasonable and practicable design features to avoid and minimize jurisdictional impacts, and to provide full compensatory mitigation of all remaining, unavoidable jurisdictional stages; minimization measures were incorporated as part of the project design. • Best Management Practices will be followed for this project as outlined in "NCDOT's Best Management Practices for Construction and Maintenance Activities". • Best Management Practices will be used during demolition of the existing bridge. • NCDOT will implement erosion and sedimentation control measures, as specified by NCDOT's "Design Standards in Sensitive Watersheds". • Use of a single span structure. • There will be no deck drains allowed to discharge directing into the North Pacolet River. • Traffic will be maintained on an offsite detour during construction, except emergency vehicles. • There will be an in-stream and 25 foot buffer work moratorium from October 15 to April 15 for protection of trout. Mitigation: Permanent impacts for this project are 36 feet due to the lengthening of a pipe carrying a UT to North Pacolet River. Because of the minimal impacts associated with this project, NCDOT proposes no mitigation. Page 3 of 4 REGULATORY APPROVALS Section 404 Permit: It is anticipated that the removal of the existing bridge footing will be authorized under Section 404 Nationwide Permit No. 33 (Temporary Construction Access and Dewatering). It is anticipated that the lengthening of a pipe carrying a UT to the North Pacolet River will be authorized under Section 404 Nationwide Permit No. 23 (Approved Categorical Exclusion). We are therefore requesting the issuance of Nationwide Permits 23 and 33 for this project. Section 401 Permit: We anticipate 401 General Certification Nos. 3688 and 3701 will apply to this project. All general WQC conditions will be adhered to during project construction. Therefore, in accordance with 15A NCAC 2H, .0500(a) and 15A NCAC 213.0200 we are providing two copies of this application to the North Carolina Department of Environmental and Natural Resources, Division of Water Quality, for their records. This project is located in a trout county, therefore comments from the North Carolina Wildlife Resources Commission (NCWRC) will be required prior to authorization by the Corps of Engineers. By copy of this letter and attachment, NCDOT hereby requests NCWRC review. The specific footprints of all buildings, impervious surfaces, or other facilities must be included. The bridge is considered structurally deficient due to the fact that the structural evaluation is ranked 2 out of 9. IV. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts Page 5 of 9 were minimized once the desired site plan was developed. VIII. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on January 15, 2002, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCEEP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at http://h2o.enr.state.nc.us/ncwetlands/strmgide.html. 1. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction. Please attach a separate sheet if more space is needed. There is 36 feet of permanent stream impact to a UT to the North Pacolet River due to a pipe extension. Due to the minimal impacts of this project no mitigation is proposed Page 6 of 9 2. Mitigation may also be made by payment into the North Carolina Ecosystem Enhancement Program (NCEEP). Please note it is the applicant's responsibility to contact the NCEEP at (919) 715-0476 to determine availability, and written approval from the NCEEP indicating that they are will to accept payment for the mitigation must be attached to this form.
