On August 16, 2016, the Division of Water Resources (Division) received your application dated
August 2, 2016 requesting an Individual Water Quality Certification from the Division for the
subject project. A public notice was issued for the project on November 28, 2016, and the
comment period closed on January 3, 2017. The Division did not receive any comments for the
project. A request for additional information was issued by the Division on January 4, 2017
requesting payment of the costs of advertising the public notice. On January 9, 2017, the
Division received an update on the project via an email from Emily Hughes indicating that the
project would involve temporary impacts that were not included in the application for an
individual water quality certification. The Division has determined that your application is
incomplete and cannot be processed at this time. The application is on -hold until all of the
following information is received:
1. Please update the Pre -Construction Notification form by adding a description of the
temporary impacts to wetlands and open water areas required for the project and the
quantities of each of these impacts. These impacts must also be shown on the site plan
for the project. 15A NCAC 02H .0502(a)(4) & (b)
2. Please submit $166.08 to pay for the costs of advertising the public notice as required in
Title 15A NCAC 02H .0503(f) as requested on January 4, 2107.
3. Title 15A NCAC 01C .0107 (a) stipulates that no DEQ agency shall issue a permit approval
while work on an environmental document is in progress. Please provide a copy of the

Final Environmental Assessment and Finding of No Significant Impact once it is issued for
the project.
Pursuant to Title 15A NCAC 02H .0502(e), the applicant shall furnish all of the above requested
information for the proper consideration of the application. If all of the requested information is
not received in writing within 30 calendar days of receipt of this letter, the Division will be unable
to approve the application and it will be returned. The return of this project will necessitate
reapplication to the Division for approval, including a complete application package and the
appropriate fee.
Please respond in writing within 30 calendar days of receipt of this letter by sending three copies
of all of the above requested information to the 401 & Buffer Permitting Branch, 1617 Mail
Service Center, Raleigh, NC 27699-1617.
Please be aware that you have no authorization under the Section 401 of the Clean Water Act/
Isolated Wetlands and Isolated Waters Rules for this activity and any work done within waters of
the state may be a violation of North Carolina General Statutes and Administrative Code.
