The placement of these pipes, end walls,and its dissipator will disturb 142 linear feet of a feature. An investigation by S and EC and the USACOE found this feature to be a stream. I have also included a copy of the report. A PCN will be filled with the USACOE for this crossing. The stream crossing will be completed under NPW 29. Through discussions and coordination with S and EC, Bob suggested that your office be contacted and kept informed on the proposed crossing. Based upon NWP 29, the filing of the PCN with the USACOE and the amount of disturbance, it appears that proposed crossing is allowable. Thank you, Randall L. Mr. Lastinger agreed with our determinations on the property. He also agreed that that the pond was a non jurisdictional pond in high ground. Please see the attached sketch map for any revised determinations. Impacts to "important streams" count toward the maximum 300' allowable under a Nationwide permit. If a project exceeds 300' of important stream impacts, the responsible party must apply for an Individual permit. The USACE has a 45 -day maximum review period to evaluate a Nationwide permit. However, an Individual permit has no maximum review period. Streams deemed to have "important aquatic function" may also require mitigation by the USACE for any impact and will require mitigation by DWQ if impacts exceed 150'. Unimportant streams require impact justification but do not require USACE mitigation. The next step in this process is to generate a wetland delineation map for submission to the USACE for approval and permitting. S&EC has not received a draft copy for a sign -off map to date.
