Mr. Allen -
Jennifer Burdette passed along the attached information for me to review regarding your project and
stormwater regulations. As I understand the emails between you, Mr. Randy Miller and Jennifer, this is a
phased subdivision. The next phase involves a road crossing, which the U.S. Army Corps of Engineers has
determined requires a NW29. The corresponding 401 certification from the state is GC3890.
As Jennifer indicated to you in previous correspondence, GC3890 has a requirement for stormwater
management. This requirement comes from our regulations, which states that DWR cannot approve a project
unless it "provides for the protection of downstream water quality standards through the use of on-site
stormwater control measures;" When a local government requires a stormwater management plan (e.g.
through NPDES Phase 11), that can satisfy the state requirement and allow DWR to issue a 401 certification
without having to review the same stormwater management plan. While I understand that the Town of Holly
Springs has grandfathered your project from their local requirements, this does not grandfather your project
from the state requirements that have been in effect since 1996. If your project requires a NW29, the project
will need to comply with Condition #12 of GC3890, which requires stormwater management for low or high-
density projects.
I was able to find some information related to this ro ect in our database from 2006-2007, where we sent
correspondence to Holly Pointe, LLC asking about stormwater requirements and this road crossing. While that
project was only for the sewer crossings at the time and was withdrawn by the applicant in 2007, we did discuss
the possibility of stormwater management being required for this entire project with the previous owner.
I understand this is not the email you were hoping for and that this site has both topographic and planning
