As the permit states all material mined from the expanded area of the 6.16 acres of Jurisdictional Wetlands, otherwise known as the "Pony Pasture", will be hydraulically dredged. All spoils will be deposited in the 5.28 acre area designated and approved by the Division of Land Resources. A final quantity of material mined from the above mentioned area will be calculated by cross sectioning the area. We have hired the surveying firm of Joyner Keeny and Associates to perform this task. On November 26, 2007 Joyner Keeny came to the proposed mining area and performed a baseline elevation survey of the existing topography. When we complete the dredging process, Joyner Keeny will come back to the site to survey the new elevations, and with that data they will supply us with an accurate measurement of how much material has been mined from the Pony Pasture area. This will be the amount of sand that will be dedicated for the NCDOT to purchase at fair market value. In the meantime Barnhill Contracting will be hauling material out of the 5.28 acre stockpile area. To ensure that we do not haul out more material than what will be dedicated to the NCDOT, we have calculated the volume of material that will be mined, using existing plans by Bissell Professional Group with a 3:1 slope above the water line and a 2:1 slope below the waterline to the maximum depth of 25 feet, as the permit states for the 6.16 acre Pony Pasture. These calculations show a volume of 174,399 cubic yards of material (See Exhibit 1). We then calculated the volume of material available for mining from the southernmost part of Pond 1, which is located directly south of the 5.28 acre stockpile area, and the volume of material available in the area is 235,959 cubic yards; which is more than what will be dedicated for the NCDOT (See Exhibit 2). The southernmost part of Pond 1 mentioned above will be treated as a Material Bank for the NCDOT to ensure that the volume of material they are due, Lhey will get. As the NCDOT purchases material it will be documented and sent to the Division of Water Quality as the permit requires. As the NCDOT purchases material, the area of the Material Bank will be reduced respectively. As mentioned above the final volume of material that will be dedicated to the NCDOT will come from the calculations of Joyner Keeny and Associates using a cross section method. We have attached hereto a sample of the accounting records we will keep for the material sold to the NCDOT to be reported to the Division of Water Quality (See Exhibit 3).
