Therefore, if you have projects that occur within the Raleigh Field Office's area of responsibility (see attached county list), you no longer need to contact the Raleigh Field Office for a list of federally -protected species. Our web page contains a complete and frequently updated list of all endangered and threatened species protected by the provisions of the Endangered Species Act of 1973, as amended (16 U.S.C. 1531 et seq.)(Act), and a list of federal species of concern) that are known to occur in each county in North Carolina. Section 7 of the Act requires that all federal agencies (or their designated non-federal representative), in consultation with the Service, insure that any action federally authorized, funded, or carried out by such agencies is not likely to jeopardize the continued existence of any federally -listed endangered or threatened species. A biological assessment or evaluation may be prepared to fulfill that requirement and in determining; whether additional consultation with the Service is necessary. In addition to the federally -protected species list, information on the species' life histories and habitats and information on completing a biological assessment or evaluation and can be found on our web page at http://w%vw.fivs.gov/raleigh. Please check the web site often for updated information or changes. I The term "federal species of concern" refers to those species which the Service believes might be in need of concentrated conservation actions. Federal species of concern receive no legal protection and their designation does not necessarily imply that the species will eventually be proposed for listing as a federally endangered or threatened species. However, we recommend that all practicable measures be taken to avoid or minimize adverse impacts to federal species of concern. If your project contains suitable habitat for any of the federally -listed species known to be present within the county where your project occurs, the proposed action has the potential to adversely affect those species. As such, we recommend that surveys be conducted to determine the species' presence or absence within the project area. The use of North Carolina Natural Heritage program data should not be substituted for actual field surveys. If you determine that the proposed action may affect (i.e., likely to adversely affect or not likely to adversely affect) a federally -protected species, you should notify this office with your determination, the results of your surveys, survey methodologies, and an analysis of the effects of the action on listed species, including consideration of direct, indirect, and cumulative effects, before conducting any activities that might affect the species. If you determine that the proposed action will have no effect (i.e., no beneficial or adverse, direct or indirect effect) on federally listed species, then you are not required to contact our office for concurrence (unless an Environmental Impact Statement is prepared). However, you should maintain a complete record of the assessment, including steps leading to your determination of effect, the qualified personnel conducting the assessment, habitat conditions, site photographs, and any other related articles. With regard to the above -referenced project, we offer the following remarks. Our comments are submitted pursuant to, and in accordance with, provisions of the Endangered Species Act. Based on the information provided and other information available, it appears that the proposed action is not likely to adversely affect any federally -listed endangered or threatened species, their formally designated critical habitat, or species currently proposed for listing under the Act at these sites. We believe that the requirements of section 7(a)(2) of the Act have been satisfied for your project. Please remember that obligations under section 7 consultation must be reconsidered if: (1) new information reveals impacts of this identified action that may affect listed species or critical habitat in a manner not previously considered; (2) this action is subsequently modified in a manner that was not considered in this review; or, (3) a new species is listed or critical habitat determined that may be affected by the identified action. However, the Service is concerned about the potential impacts the proposed action might have on aquatic species. Aquatic resources are highly susceptible to sedimentation. Therefore, we recommend that all practicable measures be taken to avoid adverse impacts to aquatic species, including implementing directional boring methods and stringent sediment and erosion control measures. An erosion and sedimentation control plan should be submitted to and approved by the North Carolina Division of Land Resources, Land Quality Section prior to construction. Erosion and sedimentation controls should be installed and maintained between the construction site and any nearby down -gradient surface waters. In addition, we recommend maintaining natural, vegetated buffers on all streams and creeks adjacent to the project site. The North Carolina Wildlife Resources Commission has developed a Guidance Memorandum (a copy can be found on our website at (http://wmv.fws.gov/mleigh) to address and mitigate secondary and cumulative impacts to aquatic and terrestrial wildlife resources and water quality. Of the twenty-three archaeological sites located within or in proximity to the project area, five are recommended for revisits to establish their boundaries and evaluate those portions of the sites within the project corridor for their eligibility for the National Register of Historic Places. These sites are: 31ED22, 31NP279, 31WL188, 31WL197, and 31WL293. In addition, it is recommended that 31WL195, a cemetery, be revisited to clearly mark it for avoidance in the field. Please describe the means for its avoidance—for example, by a perimeter fence and buffer. The following properties have been previously determined not eligible for listing in the National Register of Historic Places: 31HX175, 31HX178, 31HX180, 31HX263, 3INP 161, 31NP162, 3INP 163, 3INP 164, 3INP 165, 31NP166, 3INP 167, 31NP168, 31NP169, 31NP170, 31NP213, 31WL196, and 31WL212 because of a lack of integrity and inability to contribute to an understanding of the area's prehistory or history Based on their topographic and hydrologic setting, nine areas proposed within new pipeline location routes or re-routes are recommended for archaeological survey. The archaeologists listed, or any other experienced archaeologist, may be contacted to conduct the recommended survey. No additional information was available for the site, and the site has not been assessed for its National Register of Historic Places (NRHP) status. It is recommended that the site location be revisited in order to determine if the site is located within the proposed project study area, and if so, whether the site contains intact subsurface deposits or could be considered eligible for the NRHP. Ten of these archaeological sites (31NP161-170) were recorded in 1990 during an archaeological survey for a 7.6 mile -long section of the then -proposed natural gas pipeline (Lautzenheiser 1990). Two of the 10 sites (31NP169 and 31NP170) were recorded outside of the 50 -foot wide survey corridor and were not assessed for their NRHP eligibility. Both sites are located well outside of the 2/6 current project study area and will not be affected by the proposed construction. Of the remaining sites recorded during the original pipeline survey, all but one was considered not eligible for the NRNP. Site 31NPI63, recorded as the remains of an historic domestic structure, was not further evaluated at the time, as the proposed gas pipeline was to be re-routed to avoid adverse impacts to the site. The site was revisited in 2014 during a survey for a proposed solar farm (Deetz 2014). It was determined at that time that the pipeline had not been re-routed and had instead, bisected the approximately 100-x-100 foot archaeological site. The 2014 investigations fully delineated the archaeological site through close -interval shovel testing of the undisturbed portions of the site. Three positive shovel tests yielded late nineteenth to early twentieth century materials from the surface or plowzone; no intact, subsurface deposits were recorded. The site was recommended not eligible for the NRNP. No further work is recommended for any of these archaeological sites. A 1992 survey of a 400 -acre tract for a proposed landfill east of Wilson recorded 24 archaeological sites, four of which (31WL195-197; 31WL212) are located in close proximity to the project study area (Hargrove 1992). Site 31WL195 consists of a nineteenth and twentieth century cemetery containing several unmarked graves. The cemetery is located along the east side of Landfill Road and may be impacted by the proposed pipeline. It is recommended that this cemetery be revisited to determine if the proposed project corridor will impact marked or unmarked graves within the cemetery boundaries. Site 31WL196 consisted of a small scatter of prehistoric artifacts and was recommended not eligible for the NRNP. Sites 31 WL 197 and 31 WL212 are large prehistoric lithic and ceramic artifact scatters located in an agricultural field on the east side of landfill road. Based on the archaeological report, it does not appear that either site 31 WL 197 or 31 WL212 was shovel tested to fully delineate the site boundaries or determine the presence or absence of subsurface deposits. It is recommended that these two sites be revisited to determine if the site boundaries extend into the project study area, and if so, if the portions of the site(s) located within the project study area contain intact subsurface deposits. An archaeological survey conducted in 1992 for the Roanoke Valley 230kV transmission line in Northampton and Halifax counties recorded 10 archaeological sites, one of which (31NP213) appears to be located within the project study area (Browning 1992). This dense scatter of prehistoric Archaic lithic artifacts was determined not eligible for the NRHP. No further work is recommended at this location. Site 31WL188 was recorded by a local amateur archaeologist in 1992. The site, located in an agricultural field on the west side of Landfill Road, purportedly yielded hundreds of artifacts spanning the Paleoindian, Archaic, and Woodland periods. No subsurface testing of the site was conducted, and the site's boundaries have not clearly been defined. As the archaeological site boundaries may extend into the project study area, it is recommended that this site be revisited and its boundaries delineated in order to determine if the proposed pipeline will have an adverse effect on the site. A 1995 survey for the proposed Weldon sewer line improvements recorded a single archaeological site, 31 HX 175 (Lautzenheiser and Holm 1995). This site consisted of lithic materials recovered from the disturbed soil surrounding a graded and disturbed borrow pit. This site was recommended not eligible for the NRHP. No further work is recommended at this location. 3/6 A 1997 archaeological survey for the proposed Halifax Industrial Park recorded eight archaeological sites, two of which (31HX178 and 31HX180) are mapped as being within or immediately adjacent to the project study area (Brady and Lautzenheiser 1997). Site 31HX178, located in an agricultural field on the western side of the existing gas pipeline, consisted of numerous prehistoric surface artifacts. Five shovel tests excavated within the site boundaries recovered artifacts from intact, sub-plowzone deposits. Additional testing of this site was recommended to determine its eligibility for the NRHP (Brady and Lautzenheiser 1997: 17). Site 31HX180 consisted of a low-density prehistoric artifact scatter located on the east side of the existing pipeline. The site was recommended not eligible for the NRNP. It is recommended that site 31HX178 be revisited to determine if the site boundaries extend into the project study area and to assess the site's NRHP eligibility. No further work is recommended at site 31HX180. A 2008 archaeological survey for a proposed communications tower recorded a single archaeological site (31HX263; O'Neal 2008). This site appears to be located within or adjacent to the horizontal directional drilling platform located east of Ponderosa Road on the south side of the Roanoke River. Close -interval shovel testing recorded a prehistoric woodland and twentieth century historic artifact scatter. The site was recommended not eligible for the NRNP; no further work is recommended for this site location. In 2011, Costal Carolina Research conducted an archaeological survey and evaluation on behalf of the North Carolina Department of Transportation (NCDOT) for the widening of US 158 from east of Weldon to the Murfreesboro Bypass (Bamann et al. 2011). A total of 70 archeological sites were recorded. One of these, 31NP161, was previously recorded during the 1990 pipeline survey and was determined at that time to be not eligible for the NRNP. Site 31NP279, recorded during the 2011 survey, appears to be located within or in close proximity to the project study area. Site 31NP279 consists of the remains of an early twentieth century domestic structure. A standing brick well house and subsurface paved brick pathway were recorded during the investigation. Only the portion of the site located within the NCDOT project corridor was subjected to subsurface testing. While this portion of the archaeological site was determined not eligible for the NRNP, the remainder of the site remains unassessed. It is recommended that the site be revisited to determine if the site boundaries extend into the project study area. Site 31 WL293 was recorded in 2006. This site appears to be within or in close proximity to the existing pipeline; however, no site information was available for this prehistoric archaeological site. It is recommended that the site be revisited to determine if the site boundaries extend into the project study area. In addition to the previously recorded sites, an area purportedly containing a Civil War -era cemetery is located on the north side of West 2nd Street in Weldon near the Roanoke Canal. This information was provided by a landowner to crew attempting to conduct test boring for proposed horizontal directional drilling, citing concerns for potential disturbance to gravesites. While a preliminary map check did not reveal any previously recorded cemetery in this vicinity, it is recommended that the area be revisited and additional historical research be conducted to determine if any unmarked graves are located in this portion of the proposed project area. In summary, of the 23 previously recorded archaeological sites located within or in close proximity to the project study area, 15 have been determined not eligible for the NRNP. No further work is recommended for these archaeological site locations (see Table 1). Seven of the previously recorded archaeological sites (Sites 31ED22, 31HX178, 31NP279, 31WL188, 31WL197, 4/6 31 WL212, and 31 WL293) were either not sufficiently investigated or additional work was recommended in order to determine the NRHP status of the sites. ESI recommends that these sites be subjected to field investigations to determine 1) if the site boundaries extend into the proposed project area and if so, 2) if the sites contain significant, intact subsurface deposits or meet other criteria for NRHP eligibility. Previously recorded archaeological site 31WL195, though recommended not eligible for the NRHP, is an historic cemetery with both marked and unmarked graves. This cemetery should be revisited to determine if the proposed project corridor will impact any marked or unmarked graves within the cemetery boundaries. The landowner -reported Civil War -era cemetery purportedly located within or adjacent to the project area should be investigated on a level sufficient to document whether any unmarked graves are likely to be located in this portion of the proposed project area. While it appears unlikely that there is a cemetery in this location, it is recommended that this area be revisited and additional historical research be conducted in an attempt to locate any information about known or documented cemeteries in the vicinity. In addition to revisiting these known and purported site locations, it is possible that the SHPO will require additional archaeological survey of any new locations impacted by the proposed pipeline. The Survey is incorporated herein by reference. All Facilities shall be and remain the property of Piedmont and may be removed by it at any time and from time to time. Piedmont shall be responsible for all property taxes actually assessed against Piedmont by any government agency related to the Facilities including any utility station as described herein; however, for the avoidance of doubt, Piedmont shall not be responsible for any real or personal property taxes unrelated to the Facilities for which Grantor shall be responsible. In the event that Grantor is directly assessed real or personal property taxes on the Facilities by any government agency, Grantor shall give Piedmont written notice of the tax bill prior to payment and Piedmont shall have a reasonable opportunity to investigate and/or contest the tax bill and shall then make payment or reimburse Grantor for such real or personal property taxes on the Facilities. Piedmont shall have all rights necessary or convenient for the full use and enjoyment of the rights herein granted, including, without limitation: (1) reasonable access within the Permanent Easement Area, and (2) to keep the Permanent Easement Area cleared of trees (including limbs and overhanging foliage), buildings, structures, and any other obstructions (collectively, "Obstructions"), except for Obstructions approved by Piedmont in writing pursuant to Piedmonts policies, guidelines or procedures regarding land use within easements (the "Guidelines"); provided Piedmont shall have no right to construct or permit to be constructed or maintain any structures above ground within the Permanent Easement Area except for markers and the above ground utility station and related appurtenances as described herein. The temporary and exclusive right to use the temporary construction easement area shown in the attached "Exhibit A" (the "TCE Area") for construction activities including, without limitation, installing temporary fencing around the TCE Area and laying, storing, erecting, or parking equipment, vehicles, materials, fill, components, parts, and tools within the TCE Area during construction of the Facilities, which temporary right shall terminate upon the earlier of Piedmont placing such Facilities in service and release of Piedmont from its obligations under all permits issued for construction of such Facilities including, without limitation, all sedimentation and erosion control permits or March 31, 2019. Piedmont shall have all rights necessary or convenient for the full use and enjoyment of the TCE Area, including without limitation (1) reasonable access within the TCE Area and (2) to keep the TCE Area cleared of Obstructions. Upon completion of construction and the Facilities being placed in service, Piedmont shall restore the TCE Area to substantially the same condition as it existed prior to Piedmont's entry thereon. A perpetual easement for the purposes of erecting, constructing, maintaining, operating, altering, relocating, repairing, upgrading, replacing, removing, inspecting and protecting one or more utility stations or sites (including, without limitation, meter stations, valve sites, launcher and/or receiver sites or regulator stations) and all appurtenances used in connection therewith, for the transportation and/or control of natural gas, under, upon, over, through, and across that portion of the Property designated "USSE Area" on the Survey ("the USSE Area"). Piedmont shall have all rights necessary or convenient for the full use and enjoyment of the USSE Area, including, without limitation: (1) reasonable access to and from the USSE Area within the Permanent Easement Area and Access Easement Area;(2) to clear and keep cleared the USSE Area of any and all Obstructions; (3) to install fencing around the USSE Easement Area; (3) to exclude all persons, including Grantor, from any fenced portions of the USSE Area; and (5) to install landscaping within or around the USSE Area to screen the utility station site as may be desired by Piedmont or required by any governmental authority. Permanent Access Easement. A perpetual access easement for the purposes of ingress, egress, and regress, upon, over, and across that portion of the Property designated "Access Easement Area" on the Survey ("the Access Easement Area"). Piedmont shall have the right, but not the obligation, to keep the Access Easement Area cleared of Obstructions and have the right to construct, reconstruct, maintain, repair, improve, and use roads or driveways within the Access Easement Area (including, without limitation, grading, graveling, and installing culverts). Any roads or driveways constructed by Piedmont within the Access Easement Area shall be constructed at Piedmont's sole expense. Piedmont may install gates within the Access Easement Area, provided that Grantor has a reasonable means of using any gates locked by Piedmont Piedmont shall not install or permit to be installed any permanent structures in the Access Easement Area except for fences and gates. For purposes of this EASEMENT, the term "Easements" shall refer collectively to all easements described above and the term "Easement Areas" shall refer collectively to all the easement areas described above. Grantor's Reservation of Rights. Grantor reserves the right to use the Property and Easement Areas for all purposes that do not unreasonably interfere with the rights granted herein and that are not inconsistent with the rules and regulations of the North Carolina Utilities Commission, the Guidelines, or any applicable federal, state, or local law, rule, or regulation. Grantor shall obtain written approval from Piedmont prior to making any use of the Easement Areas. Anything to the contrary herein notwithstanding: (A) Grantor shall not: (1) unreasonably interfere with Piedmont's access to or maintenance of the Facilities or the Easement Areas, or (2) endanger the safety of Grantor, Piedmont, the general public, or the Facilities; and (B) Piedmont shall not (1) unreasonably interfere with Grantor's access to, development of or maintenance of the remainder of the Property, except as provided for herein; provided however, this subsection (13)(1) shall not impair or otherwise interfere with the rights granted to Piedmont herein to construct, install, maintain, operate, repair, alter, replace, remove, relocate, inspect, upgrade and protect one or more pipelines and appurtenant facilities within the Easement Areas in accordance with this Agreement, or (2) endanger the safety of Grantor or its successors, Piedmont, the general public. Damages. Piedmont shall be responsible for actual damage to: (1) the land within the Property and Easement Areas; and (2) improvements and annual crops located on the Property that are not in violation of the terms hereof, provided that such damage must be caused by Piedmont in exercising the rights granted herein, and provided further that a claim is made by Grantor within three (3) years after such damages are discovered by Grantor (which for this purpose shall exclude discovery by Grantor's agents, tenants, guests, invites, or other persons unless such persons notify Grantor of such damages). Piedmont shall restore and level the surface of the Easement Areas to, as nearly as can be reasonably done, the same condition as prior to Piedmont's use of the Easement Areas. Piedmont shall not be liable for any damage caused to Obstructions caused or created by Grantor or permitted to be caused or created by Grantor or improvements installed by Grantor or caused by or permitted to be caused by Grantor in violation of the terms hereof and may remove them at Grantor's expense. No Waiver or Additional Representations. The failure by either party to exercise and/or enforce any of the rights, privileges, and Easements herein described shall not be construed as a waiver or abandonment of any such rights, privileges and easements, and either party thereafter may exercise and/or enforce, at any time and from time to time, any or all of them. Existing Pipeline Easement. Piedmont has an existing easement across the Property recorded at Deed Book 665, Page 213, in the Northampton County Registry and shown on the Survey. ("Existing Pipeline Easement"). Nothing herein shall be deemed to affect, after, supersede or replace the Existing Pipeline Easement. The Existing Pipeline Easement shall remain in full force and effect notwithstanding the execution and recordation of this Easement. Ownership of the Property.
