Walter,
With regards to the current application for this project, it does not include the information we discussed while on site in March
2016 and noted in your summary below. Please provide the information that we discussed regarding the need for this road since
all proposed building site can be accessed from the existing road network. If the proposed purpose includes future throughway in
accordance with a Town of Kernersville roadway plan then the agencies may require that all crossings along the proposed
throughway be permitted at this time even though they may be constructed in phases. This would be consistent with how the
agencies permit DOT projects and other public access projects. Final design does not need to be completed for future phases,
however estimated impacts may be necessary to determine impacts from the "single and complete" project.
Please also note that since the buffers are imposed by the Town, the 401 will not include any approval for buffer impacts. If
revisions are made to the PCN, please remove the buffer impacts from the Buffer Impact Table on the PCN form.

Chris,
Steve and I met with Sue and John on Monday and reviewed the proposed road crossing. The following determinations were
made concerning the project:
The proposed road crossing that we are currently seeking a permit for, crosses and intermittent stream channel and if the impact
exceeds 150 linear feet then mitigation will be required for the entire stream impact length at a 1:1 ratio ($396 per foot).
The purpose and need for the proposed road crossing needs to be substantiated by the Town of Kernersville since all of the
proposed development can be accessed by existing roads without the proposed crossing. Steve indicated that the Town is
requiring this road crossing for interconnectivity, planning purposes, emergency management, etc. so we will need a letter from
the town that will accompany our application that provides adequate justification.
The road as planned will cross the intermittent stream that we are applying for now, and potentially a second stream to connect
the single family parcel to the existing single family subdivision. We evaluated this stream and it was determined to be perennial,
which would require mitigation at a 2:1 ratio ($792 per foot). Even if this parcel is sold, if the road is proposed as planned, it will
trigger cumulative mitigation regardless of owner. So, even if the intermittent stream impact that we are applying for now is kept
under 150 linear feet to avoid mitigation when the second crossing is applied for, it will trigger mitigation for both the intermittent
and perennial stream crossings. There is an existing culvert on the perennial stream that is at least 60 feet in length, and the
length of culvert would be subtracted from the new impact amount which would reduce the impact and subsequent mitigation.

This letter is written regarding the stream channel crossing in Smith Crossing. The Town of
Kernersville Board of Aldermen placed a Special Use District zoning condition that requires this
road crossing to provide interconnectivity to enhance emergency access; provide safe vehicle,
bicycle and pedestrian traffic flow; and address traffic congestion. Also, the alternative street
connection, Kenosha Drive is a residential 20' ribbon pavement street which is inadequate design to
serve the Smith Crossing mixed used development.
