Dear Mr. Thedford: This letter is to request a remission of the civil penalty assessed against the Town of Mooresville regarding failure to begin submitting Discharge Monitoring Reports electronically (eDMR). The Town did not begin electronic submission of DMRs sooner because we were of the understanding that DWR staff members would first visit our plant. During this expected visit, we intended to discuss and be advised on how we were to calculate our influent flow and submit data for that parameter. During the period of December 2014 to March 9th 2016, our plant operated with two influent flows due to, prior expansion and the construction of two package plants. The question of how to make our calculations based on these two influent flows and how to enter that data into the eDMR database was discussed several times. However, DWR staff did not make a visit during this period, and, assuch, we remained uncertain of how to enter this data. Additionally, the Town believed that the State had yet to complete a "template" specific to our plant— i.e. based on the parameters and limits found in our permit - in the eDMR database, and that this would need to A 1 e reach completion before we could begin entering our compliance data and submitting it electronically. We were unaware that the template was considered ready and that we should have already begun our electronic submissions. On March 9th, 2016, Sr. Environmental Specialist Wes Bell approved the Town for utilizing the data from one influent flow based on findings during his inspection of our plant. However, we were still unaware after his visit that we should begin submitting eDMRs right away due to our understanding that constructing the template for the Town was still in process. We would like to apologize for any confusion or misunderstanding on our part. The Town of Mooresville strives in every way to maintain compliance with our NPDES permit, and offers our assurance that this violation was due to miscommunication rather than deliberate disregard for our duty. With that in mind, we humbly request the Division of Water Resources for remission of the civil penalty assessed against the Town of Mooresville. The Town of Mooresville will make an extensive effort to submit all future DMR electronically as required starting with July, 2016. Thank you for your time and consideration.
