A couple years ago there was a violation of the Neuse Buffer rules -- a
private land owner on Richland Drive cut the trees down between his
house and Richland Lake (along the Loblolly Trail) to "get a better
view
of the Lake." The person was sent a letter of violation, possibly
fined, and required to replant trees.
NOW, the new owner of the house has recently CUT THE TREES DOWN that
were planted!! These newly planted trees may be smaller than xx"
diameter required to be kept (if there is such a rule?).
It could be a matter of the neighbors and realators do not know the
'rules' and made an innocent mistake, BUT, we do NOT want other folks
along Richland Lake and the Loblolly Trail to think that it is "OK" to
cut any trees.
I have received several calls and e-mails recently from this apparent
violation. Here is what a user of the Loblolly Trail observed:
"It appears that at the same spot that the previous owner had chopped
down the trees and been fined, a new owner has chopped the newly
planted
trees. There seem to have been quite a few changes going on at the
house. Still in the back are piles of brush and in the middle of one
of
the piles is a mile marker for the Loblolly Trail. "
1. Is there a requirement of only keeping trees of a certain diameter
and above 'non-cut' in the Neuse Buffer?
lb. if so, if trees were replanted due to a previous violation, are
these new tress protected?
2. Is there another layer of protection (e.g., Raleigh easement) that
would prevent any cutting along the Loblollly trail? And what about
violation of destruction of City property (e.g., trees, signage, etc).
2. What action can DWQ and/or City of Raleigh do now? I am hoping the
new owners are required to replant, etc. per this violation. And, that
perhaps ALL the neighbors should be sent a letter clarifying the Neuse
Buffer Rules from DWQ as well as a letter from the City of Raleigh
clarifying the Loblolly Trail easement protections.
Can you forward this to the other appropriate DWQ and Raleigh staff
that
should respond to this apparent violation(s). Thanks for your help and
guidance on this issue.
