PROJECT SUMMARY: The proposed project is located at the former Captain Bills Restaurant, which is currently the Southern Salt Seafood Company (701 Evans St). There is an existing building with a 2,586 sf fixed timber platform along the south side, a 1,049 sf fixed timber platform along the east side and a 144 sf fixed timber platform along Field Investigative Report Southern Salt Seafood company Page 2 of 3 the west side of the existing building. The site does not currently have any slips. The current proposal is for fixed platform additions (2 roofed), floating platforms, 10 new slip areas and maintenance excavation within the slip areas. There is no high ground work proposed through this proposal. 9. Narrative Description The Southern Salt Seafood Company project is located along the Morehead City waterfront (designated as urban waterfront area) within the Morehead City Harbor area of Bogue Sound at 701 Evans Street. The tract is bordered by the Town of Morehead City "Jibb Landing" to the West and privately owned boat docks to the east (Geer Family). The Southern Salt property is 18,557 square feet (.42 acres) in its entirety, has a shoreline length of 117.75' and is an average of 4' above NHW. Presently there is an existing bulkhead, restaurant and fixed timber decks on and along this tract. There are no coastal wetlands or high ground vegetation on this tract. The Morehead City Land Use Plan classifies this property as Downtown Mixed Use, with all AEC's classified Conservation. This section of the Bogue Sound (Morehead City Harbor) is not designated as Primary Nursery Area, is closed to the taking of shellfish and carries a water classification of SC. The historic riparian corridors were determined through an original permit # 97-05 issued to the adjacent property for the Town of Morehead city (western riparian corridor) and shall pertain to the Southern Salt proposal and meet all required setbacks. Substrate in the Morehead City Harbor is mostly sand and silt. No SAV's or shellfish beds were observed within the proposal project area. There is a USACOE federal within the project vicinity (app. 385' from existing bulkhead). 10. Proiect Description: The applicant's current proposal is to add a roof (unenclosed) to the existing timber platforms to the south and east, maintenance excavate, add 10 new slips, add floating platforms and add two new fixed landing areas with one of the landings covered. The applicant is proposing to maintenance excavate within the proposed slip areas. The dredge footprint would be 52' x 110', has an average depth of -2' nlw and would have a final depth of -6' nlw. The connecting depths within this area are -8' nlw. A total of 465 cubic yards of sandy/silt material would be removed and trucked or barged to a pre - approved disposal area. The disposal area would be determined by the marine contractor. The second portion of the project is the addition of two fixed platform areas. The proposed fixed platform to the west would be 9.5' x 16.4' and is proposed to be roofed. This area is an extension of the existing platform and per the applicant would enhance safety within this area. This new non -water dependent structure would be more than 20' from nhw, therefore would be inconsistent with the Coastal Resource Commission rules; 15A NCAC 07H .0209 (g)(4)(B)(IV). The second proposed fixed platform is located to the south east of the existing fixed platform/restaurant and north of the proposed docking facility. The dimensions would be 16.8' x 21.8' and would be used for a public observation as well as possible seafood unloading area. Bills) Page 3 of 3 dependent use and would not be roofed (would meet 15A NCAC 07H.0208 (b)(5)(D)). The applicant is also proposing the placement of floating platforms for the addition of 10 slip areas (transient in nature). The property currently does not have any designated slip areas. A gangway would extend from the existing fixed timber platform to the west in a southerly direction and would intercept a 6' x 38.3' floating finger pier. This would intercept a second floating finger pier (extends to the east) and would be 6' x 45'. The third proposed floating finger pier would extend from of # 2 in a southern direction and would be 6' x 26.5'. The final proposed 6' x 73' floating platform would be shore parallel and would be located approximately l' landward of the USACOE channel setback. There would be six side -too parallel slips located inside of the floating platforms with the final four located on the most southern side of the 73' floating platform. The outer four slips would be oriented as parallel as well. All portions of the floating platforms (water dependent) would meet the 27 sf rule (15A NCAC 07H .0208 (b)(5)(D). All portions of the docking facility would meet the minimum 15' setback from the riparian access lines. The average existing water depths within the slip areas is an average of -2' at normal low water. The tidal amplitude within this area is 3'. The total length of the shoreline is 117.8'. The width of the Morehead City Harbor is approximately 535' in this area. The proposed pier would extend a maximum of 165' waterward of nhw within a 535' wide waterbody, however there are longer piers adjacent to this site (to the east and west), therefore the 1/3 distance can be used. The proposed pier would also remain within the establish pier head length. According to the applicant, the typical boat would be 12' — 23' with a mixed use open runabout design. The marina policy would prohibit overboard discharge, no fueling and no overnight or live aboard dockage. Note: Any of the proposed roof areas would not cause any impervious surface impacts due to the project is entirely over estuarine waters. 11. Anticipated Impacts: The proposed pier and platform would shade 1,604 ftz and incorporate 7,125ft2 of open waters. The setting of pilings would cause temporary turbidity. There would be no hindrance to navigation due to the fact that the docking facility would be located a distance of 1' landward of the USACOE channel setback. The total pier length, which includes the platform, would be a distance of 165'within a 535' wide waterbody, however there are longer adjacent piers, therefore the 1/3 distance may be utilized. The proposed docking facility would also remain within the existing pier head length within this area. All roofed areas would remain over existing and proposed platform addition, therefore no new shading impacts would exist. This project has the potential to improve public benefit by adding additional public access as well as 10 new transient slip areas. The proposed western covered area is not consistent with the CRC rules [15A NCAC 07H .0209 (g)(4)(B) ff )] because it extends more than 20' waterward of nhw (approximately 80'), therefore, staff recommends this portion of the project be removed to prevent the entire project from being denied. Name: Heather Styron Date: 12/19/16 Morehead City FIXED TIMBER PLATFORM & FLOATING DOCK SOUTHERN SALT SEAFOOD COMPANY MOREHEAD CITY, CARTERET COUNTY, NORTH CAROLINA PROJECT NARRATIVE November 17, 2016 INTRODUCTION The project site is an approximately 0.426 acre site located in of the Town of Morehead City's corporate limits and is adjacent to the Morehead Harbor Channel. The property currently has one restaurant located on it, Southern Salt Seafood Company and the property is owned by Captain Bills Inc. The property currently has three (3) fixed timber platforms on the west, south, and east sides of the structure. There are currently no dock slips on the property. The Southern Salt Seafood Company Fixed Timber Platform & Floating Dock project includes the installation of approximately 574 square feet of fixed timber platform and 1,100 square feet of floating dock. There are three (4) 6' wide floating docks in lengths of 38'4", 45', 26'6", and 73'. Ten (10) boat slips are being proposed as part of this project. EXISTING CONDITIONS Southern Salt Seafood Company currently has an approximately 2,586 square foot fixed timber platform on the southern side of the structure. This platform is attached to the structure and to the approximately 1,049 square foot fixed timber platform on the east side of the structure. An approximately 144 square foot fixed timber platform is on the west side of the structure adjacent to the Town of Morehead City fixed timber platform. PROJECT DESCRIPTION The existing timber platform that surrounds the structure on the east and south portions is at approximately 5.0' NAVD88. There are two (2) proposed timber platform additions to this structure. The first addition is approximately 16'10" x 21'10" and will be located on the south face of the existing timber platform extending waterward. The second addition will be along the western portion of the platform and will be approximately 9'5" x 164". Both of these timber platforms will be at the same elevation as the existing platform and constructed of similar materials. The roof will follow the existing-building-foof slope -and will not extend beyond the fixed platform area. The four (4) floating docks will provide ten (10) boat slips for transient boats. No overnight dockage will be allowed. All four (4) floating docks will be six (6) feet wide. Demolition and Removal — The only demolition and removal proposed in this project is the removal of the existing handrail once construction of the entire platform is constructed. Excavation — Excavation will be completed within the proposed floating docks location. Dredging will excavate the existing bottom elevation to approximately -6 feet NAVD88. An estimated 465 cubic yards will be removed. Upland Development — There is no Upland Development planned as part of this project. Stormwater Management — No upland improvements, pavements, walkways or other impervious surfaces will be constructed as part of the project. No stormwater management or additional stormwater measures are required for this project. NAVIGATION CONDITIONS The federal channel boundary and channel setback run along the entire southern margin of the project site. The federal channel is 200 feet wide. The channel and setback lines shown on the drawings were obtained from the Navigation Section, U.S. Army Corps of Engineers, Wilmington District. METHODS OF CONSTRUCTION Construction of the timber platform and floating docks will be by conventional marine construction equipment including barges and cranes. Excavation will likely be completed by a barge mounted excavator and disposed of at an upland site determined by the licensed marine contractor performing the work. The equipment will be onsite only a sufficient time to complete the excavation, pile driving, platform installation, and floating dock work. COMPLIANCE WITH THE N. C. ENVIRONMENTAL POLICY ACT The work proposed as part of this application is private development and does not involve expenditure of public funds. The Regulatory Reform Act of 2011 (SB 781) was passed by North Carolina Legislature in July 2011. This bill eliminates the requirement for an environmental assessment (EA) for any project requiring a Major CAMA permit. Therefore, the proposed project is not subject to N. C. Environmental Policy Act review. Project includes installing two (2) fixed timber platforms connected to the existing timber platforms. The first timber platform is approximately 422 square feet located along the south face of the existing platform and extending waterward. The second platform is approximately 152 square feet and is located on the western end of the existing fixed timber platform. Four (4) floating docks are proposed as part of this request, all of which are 6 foot in width. The first floating dock will be approximately 38'4" in length and connect to the existing timber platform. The second floating dock will be approximately 45 feet in length and run parallel to the existing timber platform. The third floating dock will be approximately 26' 6" and extend south towards the channel setback line. The final floating dock will be constructed parallel to the channel setback line and will be approximately 73 feet in length. No piles will be installed within the setback. e.
