PROJECT SUMMARY: The applicant is applying for a Major Modification to increase the size of subdivision roads, convert an elevated boat ramp to a standard ramp and to change the dredging footprint at Sunset Cove subdivision. Field Investigation Report: Robin Comer Page 02 9. NARRATIVE DESCRIPTION: The Sunset Cove project is located on Wetherington Landing Road (SR1101) near Stella in Carteret County. N.C. Hwy. 58 lies a few miles to the east of the site. The site is identifiable by an abandoned house on a high bluff just before White Oak Bluffs subdivision. The White Oak River borders the site to the west. Sunset Cove is 16.72 acres in its entirety and varies from 0' to 34' in elevation above NHW. The high ground portion of the site is vegetated with various upland grasses, mature Live Oaks and a tree fringe along the waterfront. A strip of Section 404 Wetlands that is approximately 100' wide runs parallel to the shoreline and into the property near the east side. The shoreline has a 15' wide fringe of coastal marsh that is both irregularly and regularly flooded. High marsh species include Cattail (Typha spp.), Black Needle Rush (Juncus roemarianus), Salt Meadow Grass (Spartina patens) and Bullrush (Scirpus spp.). The regularly flooded low marsh has patches of Smooth Cordgrass (Spartina alterniflora). The shoreline on the north west side of the proposed project is similar in nature and undeveloped. White Oak Bluffs subdivision is south east of the proposed project and has a series of private docks. This section of the White Oak River is not a Primary Nursery Area as designated by the Division of Marine Fisheries and the Division of Water Quality classifies it as SA waters. The area in which the proposed project would take place is closed to the taking of shellfish. Carteret County's Land Use Plan dated 1996 classifies this area as Rural with Services and Conservation within the AFC's. There are no shellfish leases in the area. The substrate in the area is mainly sand and mud. It did not appear that shellfish resources or SAV's were present. 10. PROJECT DESCRIPTION: Due to concerns by the Fire Marshall, the applicant is proposing to increase the radius of 2 cul-de-sacs from 40' to 55'. This is the minimum amount to provide ingress and egress of emergency vehicles. The main road would remain to be a 50' right of way. During the time since original issuance of Major Permit #72-07, an existing area of non - coastal wetlands has increased in size (Action ID SAW -2004-00280). Due to this change, the applicant is proposing to fill 2,230ft2 of non -coastal wetlands for the construction of the access road to the boat ramp. The dimensions of this permitted access road would remain the same and previously permitted retaining walls would prevent transport of sediment into adjacent wetland areas. The applicant is also applying to convert the previously permitted elevated boat ramp into a standard concrete boat ramp. This would involve the filling of 250ft2 of Coastal Wetlands. The proposed ramp would be 76.5' X 15' and would be constructed on high ground. The Coastal Wetland area affected would be 16' X15'. Plant species in this area are Smooth Cordgrass (Spartina alterniflora) and Salt Meadow Grass (Spartina patens). The previously permitted access channel would also need to be modified to accommodate the proposed concrete ramp. The proposed modified access channel would be 104' long and 15'to 35' wide. Water depths in this area would increase from -2' NLW to -3' NLW. Connecting water depths would be -4'. There would be 230yd3 of material removed during excavation. ANTICIPATED IMPACTS: The proposed concrete ramp would cause the filling of 250ft2 of Coastal Wetlands. The access road to the ramp would cause the filling of 2,230ft2 of non - coastal wetlands. There could be increased surface runoff from the additional impervious are of the cul-de-sacs. The road modification would increase land disturbance from 2.9ac to 3.Oac. The property is located at 1272 Wetherington Landing Road (SR 1101) adjacent the White Oak River. Plans are underway by the owners to develop an 18 -lot subdivision on the tract to be called Sunset Cove. Major CAMA permit 72-07 was issued on May 8, 2007 to Mr. Comer for development of the subdivision and associated water access amenities. The original permit expiration date of December 31, 2010 was extended to December 31, 2014 in accordance with Session Law 2009-406, as amended by Session Law 2010-177. The permit received a two-year renewal on January 15, 2015, effective through December 31, 2016. In September 2016 the permit was again renewed effective through December 31, 2018. The permit authorizes development of a 10 -slip boat dock and elevated boat ramp with access road, turn -around, and retaining wall. An access channel, subdivision streets and stormwater drainage pipes are also permitted. The Sunset Cove subdivision has not been built. The project has been `on hold" due to economic conditions in recent years that have negatively affected real estate development and sales. However, due to an improving economy Mr. Comer has resumed plans to build the project. Preliminary plat approval for the Sunset Cove subdivision was granted by the Carteret County Planning Commission on May 9, 2016. This submittal proposes to modify previously permitted project plans for the site. The proposed changes are a result of current Carteret County subdivision requirements necessitating widening of subdivision cul-de-sacs. The changes will require a slight reconfiguration of some of the individual lots. The owner is also requesting that the permit be modified to allow concrete to be used for construction of the elevated sections of the currently permitted boat ramp. Construction of the ramp entirely with concrete will necessitate changes to the currently permitted access channel. Project plans submitted with this application provide currently permitted plans and existing and proposed conditions. Site Description The undeveloped project site consists of 16.72 acres. Residential uses are located to the west and southeast of the site. Agricultural uses are found to the north and northeast. The original permit required that an archaeological assessment be conducted prior to construction. Man- made features currently located on the property are limited to an abandoned septic system. The area is not zoned by Carteret County. The subdivision lots will be served by individual septic systems and drinking water will be provided by West Carteret Water Corporation. Minimum lot size for the subdivision is 20,000 square feet. Vegetation on the site consists of trees, grasses, shrubs, and wetland plants. A new wetland map for the site was approved by the USACE on October 27, 2016 (USACE Action ID SAW -2004-00280). Current project plans depict the new jurisdictional determination and the coastal wetland delineation recently approved by DCM. The size of the wetland fringe existing along the waterfront at the time of the original permit action has now decreased; thus minimizing impacts from the proposed boat ramp. In order to minimize impacts to wetlands, Mr. Comer agreed at the time of issuance of the original permit to establish a minimum building line. The line is located landward of 404 wetlands and 150' landward of Normal High Water. The restrictive covenants for the subdivision will limit construction in the setback area to walkways, piers, and other water access structures permitted by the NC Division of Coastal Management and the US Army Corps of Engineers. The minimum building line is portrayed on the plan submitted with this application and will be incorporated into the final subdivision plat. Project Description As part of the 2016 subdivision review process Carteret County fire officials requested modifications to the cul-de-sacs of Evening Drive and Morning Court. Mr. Comer was asked to increase the asphalt radii from 35 feet to 40 feet and the right-of-way radii from 50 feet to 55 feet to better accommodate fire trucks. These changes are located outside CAMA areas of environmental concern and wetland areas and are depicted on the proposed plans and section drawings. The change to the roads will result in a slight increase in the size of the area to be graded, filled, or disturbed for the project, increasing from 2.9 acres to 3.0 acres. Wetlands were avoided as much as possible in the design of the river access road. Impacts are limited to non -coastal wetlands located in a portion of the turn -around area and a narrow section of adjoining roadway. Based on the currently approved jurisdictional determination (JD) the ramp access roadway will result in the placement of fill in 2230 square feet of non -coastal wetlands. (Based on the original JD, 1698 square feet of non -coastal wetlands would have been affected by the ramp access roadway and turn -around.) It is anticipated that cutting and filling associated with the access roadway construction will balance the need for additional fill material. However, a small amount of fill material may be required and is indicated on Form DCM MP -2 Excavation and Fill. A retaining wall is included (permitted) to avoid filling of wetlands on the down-slope side of the roadway. The proposed concrete boat ramp will measure 15 feet by 76.5 feet. Concrete sections will be formed and poured on high ground and pushed into position below NHW. The access channel must be modified Robin Comer . The proposed channel will measure 104 feet in length with width ranging from 15 feet to 35 feet. The final project water depth will be -3.0 feet. A backhoe will be used to excavate 230 cubic yards of material below Normal High Water for construction of the ramp and access channel. No more than 250 square feet of coastal wetlands will be affected by the ramp construction. A "bucket to barge" system will be used for excavation. Spoils will be placed on the high -ground area just north of the area designated for boat and trailer parking. The parking area is located to the east of the proposed water access roadway and south of the proposed subdivision street (Evening Drive). Silt fencing, silt traps, rolled erosion control fabric (blanket), vegetation and mulch will be used to keep the excavated material onsite and erosion controlled. In summary, the owners have taken care in the design of the project to avoid and minimize impacts to wetlands. As previously requested by the US Army Corps of Engineers they have established a minimum building line along the waterfront affecting lots 3 through 7. The minimum building line is located landward of coastal and non -coastal wetlands and limits construction in the setback area to water access structures. The boat ramp is located in the narrowest fringe of coastal wetlands, which has now diminished since the original permit was issued. Constructing the ramp entirely of concrete (as opposed to elevated sections) will significantly contain building costs and improve safety for users of the ramp. The ramp access roadway was designed and located to impact the smallest possible area of wetlands. A retaining wall is included adjacent the roadway to avoid filling of wetlands during construction.
