The Division received your request for written comments regarding the subject project back in
August. Unfortunately, I have not had a chance to respond until now. The proposed project is part of the
mixed use development referred to as New Hill Place that received a water quality certification for the first time
in 2010. Several modifications have been issued since then. The Section 404/401 permit/certification for the
overall project approved 82 linear feet of perennial stream impact (Impact Area #15) on the subject parcel. You
can find copies of 401 water quality certification information on the project here. Applications under versions 1
and 2 were withdrawn, so you can start with version 3. Any additional impacts proposed would require a
modification of the individual permit for New Hill Place. You should contact James Lastinger (919-554-4884)
with the US Army Corps of Engineers if the proposed project may involve additional impacts to waters of the
US.
