EBI CONSULTING (EBI) is preparing an environmental review on behalf of AGM Hi44 1
and the United States Department of Housing and Urban Development (HUD) for the prop
above as part of its permit process and regulatory review. We are in the process of completing the 8 -
step process for wetlands as outlined in the HUD MAP guidelines. We have enclosed information
regarding the proposed undertaking within this letter for your review.
The Subject Property includes one irregular-shaped parcel, totaling approximately 21.67 acres. At the
time of inspection, the Subject Property consisted of undeveloped, wooded land. with no existing
structures or other improvements. An intermittent streambed transects the Subject Property from
southwest to northeast on the western portion of the Subject Property. A stream bisects the Subject
Property from south to north on the central portion of the Subject Property. Another stream defines
the Subject Property's eastern border.
The borrower proposes to construct an eleven -building, 228 -unit multi -family apartment complex with a
clubhouse building and six garage structures.
The Subject Property is bounded by the following land use:
North — The Subject Property is bound to the north by single-family residential homes and undeveloped
woodlands.
South - The Subject Property is bound to the south by a roadway under construction, beyond which is a
cleared land with a building under construction.
East - The Subject Property is bound to the east by undeveloped woodlands.
West — The Subject Property is bound to the west by Old Holly Springs Apex Road beyond which is a
closed landfill and undeveloped woodlands.
EBI Consulting, Inc. has attached copies of a Location Map and a Topographical Map„ both of which have
the location of the Site designated, along with photographs of the Site and adjacent properties for your
review.

Review of the U.S. Department of the Interior, Fish & Wildlife Service's National Wetland Inventory
Mapper (NWI Mapper) accessed at http://wetlandsfws.er.usgs.gov/ indicated that the Subject Property is
not located on or adjacent to a wetlands area. However, during the site inspection of the property, EBI
observed several small creeks with vegetative indicators of potential wetland areas, located throughout
the Property. These creeks generally flowed to the north and discharged into Little Branch, located
approximately 2,100 feet north of the Subject Property. EBI was provided with a wetland delineation
map which was produced by John R. McAdams Company, Inc. ARMC) in 2008. JRMC identified North
Carolina Department of Natural Resources (NC DENR) intermittent/ US Army Corp of Engineers
(USACOE) Intermittent 1:1 Mitigation streams; NC DENER perennial / USACOE perennial 2:1
Mitigation streams; NC DENR Intermittent/ USACOE non -jurisdictional streams and 0:1 Mitigation
streams on the property. EBI reviewed the Stream Impact Analysis — Overall map produced by JRMC,
dated July 6, 2010. On the Stream Impact Analysis Map, 15 potential areas of impact to streams and
wetlands were identified. A total of 0.159 acres of bank to bank wetlands; 1.101 acres of riparian
wetlands and approximately 5,409 feet of streams will be impacted by the proposed development.
Additionally, the property is located within the Cape Fear River Basin and riparian buffers associated
with the river basin were identified throughout the property. Thirteen of the fifteen identified impact
areas are located on the Property and will be affected by development, the other two identified areas
are located to the northeast and across NC Highway 55 Bypass; therefore, they will not be impacted by
the Subject Property development.
The NC Ecosystem Enhancement Program (NCEEP) issued an acceptance letter for wetlands mitigation
payments for the property on April 19, 2011. The NCEEP letter indicates that the credits paid for will
cover up to 2.202 acres of riparian wetlands and up to 6,000 feet of streams. The letter states that while
the NCEEP is willing to accept payment for impacts associated with the proposed development of the
property; this this decision does not assure that the payment will be approved by the permit issuing
agencies as mitigation for project impacts. The acceptance is also contingent on the issuance of the final
401 Water Quality Certification/Section 404/CAMA Permit by the NC DENR within nine months of the
issuance of the above referenced letter. Additional letters acknowledging receipt of mitigation payments
to the NCEEP for the property were issued on February 8, 2012, December 4, 2012, July 23, 2014, and
July 8, 2016. These letters note that the final 401/404/CAMA permit was issued. EBI was not provided
with a copy of the final 401 /404/CAMA permit.
