Dear Ms. Beckwith:
The North Carolina Department of Transport�tion (NCDOT) is proposing to replace bridge no. 53
in Macon Cow�ry which waslied-out in December 2015. The proposed replacement structure is a
45' L x 27' W cored sl�b bridge that will be built on the same location. An off-site detour is
being used currently and will continue to be used during construction.
Enclosed are a PCN application, preliminaryjurisdiction form, plan sheets showiug the proposed
work, � USGS quad map, photographs, and other pertinent project information to assist in your
consideration of this request.
The U.S. Fish and W ildlife Service and Noitli Carolina Nlhual Heritage Progr�m datab�ses �vere
checked for records of threatened and endangered species in Macon County. Carolina no�tliern
Elying squirrel (G/ca�com��s sabrn�us coloralrrs), spotfin chub (Erniioncrz monachas), Appalachian
elktoe (Alnsmido�Nn rnvenelinna), littlewing pearlynmssel (Pegins fnbidn), small wl�orled
pogonia (Isoh•in me�leoloides), Virginia spiraea (Spiraen virgininnn), rock gnome lichen
(Gyimrorlernin lrneare), and nortliern long-eared bat (A�Lyotis sepreiin•ionalis, NLEB) are listed as
either threatened or endaiigered and are kno�vn from current records. Gray bat (�Llyo�is
g��rsescens) and [ndian� bat (dl��orrs sorl�rlrs) are listed species that are likely To occur in Macon
County.
Appalachian elktoe, littlewing pelrlymussel, and spotfin chub aily occur in Macon County in the
Little Tennessee River �nd a few of its tributaries do�vustream Lake Emory in Franklin. Coweeta
Creek is too small and cold for mussels and this bridge is several miles upstream of Lake Emory.
Therefore, the project will not affect these species.
Virgnia spiraea occurs along the Little Tennessee River upstream of Lake Emory and has been
found along a small tributaq� to the river fer below the dam. However, there are no scoured

banks or gravel bars at tlie bridge that could suppo�t this plant. And, the plant �vas not seen
during visits to tlie bridge site.
Gray bats usually roost in caves or in/on structures year-round while Indiana bats and NLEB only
winter in caves or mines �vith stable, but not freezing, cold temperatures. During warm seasons
Indiana bats and NLEB usually roost on structures, under the shaggy bark of Iive trees such as
white oaks, sycamores, and hickories, or in cavities and under the loose peeling bark of dead
trees. This project will not require bridge demolition or blasting, so gray bats will not be affected.
The bridge is not situated in an a��ea where NLEB hibernacula or maternity roost trees are an
identified concem, so the project is consistent with exceptions for incidental take outlined in the
NLEB Final 4(d) rule. To protect Indiana bats, the hvo ti�ees that appear to conflict witli
construction will be removed from October 15 to April l5 (winter clearing). With this measure,
we recommend a"may affect, not likely to adversely affecY' detennination for Indiana bat.
Small whorled pagonia most often occurs in open, dry, deciduous woods witli acid soil, though
habitats can include slopes along streams and mesic forest with white pine and rhododendron.
Land use adjacent to the bridge consists of the maintained roadway and residential drives, road
shoulders and bridge approaclies, landscaped lawns, and wooded creek banks. Small whorled
pagonia, if present in the wooded areas, would not be affected since construction will only occur
in currenHy maintained and recenHy disturbed areas near the road.
The Carolina northern flying squin•el and rock gnome lichen are found in spruce-fir forests and
other isolated high elevation locations in westem North Carolina. However, rock gnome lichen
can occasionally be found at lower elevations in deep river gorges with high humidity or on some
vertical rock faces that are periodically wet The bridge site is much too low in elevation and
lacks rock faces and other habitat conditions required by these species.
The project is small in scale. Erosion and sedimentation control measures will be used to
minimize adverse effects of the work on aquatic habitats. Habitats for listed species appear
lacking at the project site and none of the species knowu from Macon County were observed
during field visits. For these reasons and those discussed above, �ve recommend that a
determination of "no effecY' on listed species, with exception to L�diana bats, apply to this
project.
This project was reviewed by NCDOT's Humau Environment Unit in 2016 and it was detennined
tliat surveys were not necessary for historic structures or archeological resources (see attached
foims).
NCDOT best management practices will be used to minimize and control sedimentation and
erosion on this project.
Impacts to Waters of the United States
Coweeta Creek (DWQ Class: B Tr) is shown on the USGS topographic map as a perennial
stream. It has a well-defined channel approximately 30 feet in widtli with a substrate of sand,
gravel, and rock. Coweeta Creek Flows to the Little Tennessee River, whicli meets the definition
of a Traditional Navigable Water (TN W). For these reasons, we believe Coweeta Creek is a
Relatively Pe�manent Water (RPW) and is under tlie jurisdiction of the U.S. Army Co�ps of
Engineers. In order to construct the project, it will be necessary to impact �vateis of the United
States in tlie Little Tennessee River Basin (CU 06010202). Specifically, NCDOT is ��equesting to

1. The Corps of Engineers believes that there may be jurisdictional waters of the
United States on the subject site, and the permit applicant or other affected party
who requested this preliminary JD is hereby advised of his or her option to
request and obtain an approved jurisdictional determination (JD) for that site.
Nevertheless, the permit applicant or other person who requested this
preliminary JD has declined to exercise the option to obtain an approved JD in
this instance and at this time.
2. In any circumstance where a permit applicant obtains an individual permit, or
a Nationwide General Permit (NWP) or other general permit verification requiring
"pre-construction notification" (PCN), or requests verification for a non-reporting
NWP or other general permit, and the permit applicant has not requested an
approved JD for the activity, the permit applicant is hereby made aware of the
following: (1) the permit applicant has elected to seek a permit authorization
based on a preliminary JD, which does not make an official determination of
jurisdictional waters; (2) that the applicant has the option to request an approved
JD before accepting the terms and conditions of the permit authorization, and
that basing a permit authorization on an approved JD could possibly result in less
compensatory mitigation being required or different special conditions; (3) that
the applicant has the right to request an individual permit rather than accepting
the terms and conditions of the NWP or other general permit authorization; (4)
that the applicant can accept a permit authorization and thereby agree to comply
with all the terms and conditions of that permit, including whatever mitigation
requirements the Corps has determined to be necessary; (5) that undertaking
any activity in reliance upon the subject permit authorization without requesting
an approved JD constitutes the applicanYs acceptance of the use of the
preliminary JD, but that either form of JD will be processed as soon as is
practicable; (6) accepting a permit authorization (e.g., signing a proffered
individual permit) or undertaking any activity in reliance on any form of Corps
permit authorization based on a preliminary JD constitutes agreement that all
wetlands and other water bodies on the site affected in any way by that activity
are jurisdictional waters of ihe United States, and precludes any challenge to
such jurisdiction in any administrative or judicial compliance or enforcement
action, or in any administrative appeal or in any Federal court; and (7) whether
the applicant elects to use either an approved JD or a preliminary JD, that JD
will be processed as soon as is practicable. Further, an approved JD, a proffered
individual permit (and all terms and conditions contained therein), or individual
permit denial can be administratively appealed pursuant to 33 C.F.R. Part 331,
and that in any administrative appeal, jurisdictional issues can be raised (see 33
C.F.R. 331.5(a)(2)). If, during that administrative appeal, it becomes necessary
to make an official determination whether CWAjurisdiction exists over a site, or
to provide an official delineation ofjurisdictional waters on the site, the Corps will
provide an approved JD to accomplish that result, as soon as is practicable.

Review of HPO quad maps, HPO GIS information, historic designations roster, and indexes was
undertaken on December 20, 2016. Based on this review, there are no existing NR, SL, LD, DE,
or SS properties in the Area of Potential Effects, which is 75' from each end of the btidge and
50' fi•om the centerline each way. A survey site, the McClure Mill (MA0250) falls outside of the
APE and will not be affected by this project. All other structures within the APE are one-story
homes built in the 1970s and 1980s based on Macon County GIS/tax information. Bridge No. 53
was not eligible for National Register listing based on the NCDOT Historic Bridge Inventory.
There are no National Register listed or eligible proper[ies and no survey is required. If design

Projec[Descrlpllar: Replacement of Bridge No. 53 over Cowetta Creek on SR 1119 (McClure Mill
Road) in Macon County, North Carolina. The archaeological Area of Potential Effects (APE) measures
600R in length (300ft from each bridge end-point) and 150R in width (75ft from each side of the SRI l 19
center-line).
SUMMARY OF CULTURAL RESOURCES REVIEW

Permltting and funding informatfon was reviewed for determining the level of archaeological input required by
sta[e and federal laws. Based on the submitted "request for cultural resources revfev/' form, the project is state-
funded with federal permit interaction. As such, Section 306 of the Na[lonal Hlstoric Preservation Act will apply.
Next, construction design and other data was examined (when applicable) [o define the character and ex[ent of
potential impacts to the ground surfaces embracing the proJect locale. The dimenslons of the APE were formulated
to capture any federal permit area. Once an APE was outlined, a map revlew and site file search was conducted at
the Office of State Archaeology (OSA) on Tuesday, December 20, 2016. No previously documented archaeological
sites are located within the APE.
Historic structure locations often harbor archaeological deposits and features related to the former occupation of
a property. An InspecHon of National Register of His[oric Places (NRHP), Siate Study Listed (SL), Lowlly Designated
(LD), Determined Eligible (DE), and Surveyed Site (SS) proper[ies employfng the NCSHPO website evidenced none
of these historic resources within the immedfate project area. In addition, historic maps of Macon Caunty were
appraised to Identity former structure locations, land use patterns, or other confirmallon of historic occupahon in
the projec[ vicinity. Archaeological/historical reference materials were Inspetted as well. In general, the cultural
background review established that no NRHP listed properties, previously recorded archaeological sites or
cemeteries are located within the APE. Based on cultural-historical factors, the APE fs considered to have a low
potentlal for the documentatlon of archaeological resources.
Further, topographic, geologic, (lood boundary, lidar, and NRCS sail survey maps (RSA, HaC2) were referenced to
evaluate pedeological, geomorphological, hydrological, and other environmental determfnants that may have
resulted in past occupatlon a[ this lowtion. Aerial and on-ground photographs (NCDOT Spatial Data ViewerJ and
the Google Street View map application (when amenable) were also examined/utillzed for additional assessment
of disturbances, both natural and human induced, which compromise the Integrity of archaeological sites.
Environmental/impaU facrors do not suggest a hefghtened potential for archaeological resource recovery.
