I note that approximately 150 feet of riparian buffer is indicated on the northwestern portion of the property along the road frontage. There is an existing stormwater drainage ditch area that only flows water during, and immediately after, a rain event. This area appears to meet the definition of an "Ephemeral (stormwater) Stream". Under 15A NCAC 02B .0259 (3)(a), an Ephemeral (stormwater) Stream is exempt from the rules. 6. Has anyone from DWQ visited the site? No Staff Name: Date of Visit: 7. I own a 10 -acre tract of land 1.5 miles northwest of Falkland in Pitt County. I plan to build a house on the property starting in February. There is a drainage Swale/ditch on the southwestern portion of the property that includes approximately 150 feet of area designated as Riparian Buffer on the Pitt County GIS site (I have attached a copy for your reference). The USGS Topographic map does not show a blue -line stream in this area. However, the Pitt County Soil Survey indicates an intermittent stream symbol extending onto this area of my property. I have included copies of the topo map and the soil survey map with pencil marks of the area of interest on my property. I will send a copy of this information via US Mail. I have owned the property since August of 2015. 1 have walked through the low drainage area numerous times over the past year, and I have noted that there is no flow in the drainage except during and immediately after a rain event. Based upon a hand auger hole I bored on the property last year, the water table on the property is deep (>13 feet), and there does not appear to be any baseflow groundwater discharge (i.e., seep or spring) to the drainage area of my property. I believe that this area should be exempt from the riparian buffer rules because the area most likely meets the definition of an "Ephemeral (stormwater) Stream". However, I would like to have a determination by the NCDEQ as to whether this area is jurisdictional riparian buffer. If it is jurisdictional, I would appreciate some guidance about management of the area in compliance with the riparian buffer rules. Also, I know that I have jurisdictional riparian buffer on the northeastern property boundary along Otter Creek. I would appreciate some guidance about how best to manage that portion of my property as well. Feel free to call my cell phone (252-814-6361) to schedule a meeting on the property.
