Mr. Underwood has finally agreed to put deed notifications on the remaining lots (per current application from Gary Mitchell). This includes a map signed by Jennifer Frye of the Corps of Engineers. (Mr. Underwood has made the point that he did not want to rule out future development of those lots.) Item VIII (1) of the current PCN indicates that the signed wetland map and deed notice has been recorded with the Register of Deeds in Bladen County, specifying that Lots 73,74,75, and 76 are subject to 404 regulation, require permits for modification, etc With this now in place, it is the recommendation of this office that the requested 401 Certification be approved, AFTER the appropriate fees have been collected. The 401 should reiterate the notice requirement concerning lots 73 thru 76. Finally, it looks like something that we can live with. The PCN says that they have recorded the map and notification language concerning the wetlands on Mr. Underwood's remaining wet lots.
