DWR Mitigation Total: O linear feet The project shall be construc[ed in accordance with your application dated reeeived August 18, 2016. After reviewing your application, we have decided that these impacts are covered by General Water Quality Certification IYumber 3885. "I'his certification corresponds to the Nationwide Permit 13 issued by the Corps of Engineers. In addition, you should acquire any other federal, state or local permits before you proceed with your project including (but not limited to) Sediment and Erosion Con[rol, Non-Dischar�e and Water Supply Watershed regulations. This approval will expire with the accompanying 404 perniit. This approval is valid solely for the purpose and design described in your application (unless modified below). Should your project change, you mi�st notify the NCDW R and submit a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter, and is thereby responsible for complying with all the conditions. For this approval to remain valid, you must adhere to the condiTions listed in the attacl�ed certification(s} and any additional conditions listed below. Condition(s) of Certification: Project Specifc Conditions 1: Riprap shall nct be placed in the acfive thahveg channel or placed in the streambed in a manner that p:e�ludes aquatic life passage. Bioengineering boulders or struc:ures should be propedy designed, sized and installed. [15A NCAC 02H.0506(b)(2)] 2. For the 51 linear f et of s[ream being ia�pacted due to site dewatering activities, the site shall be graded to i[s preconstrcction contours and revegetated with apprupriaie native species. []SA NCAC 02H.0506(b)(2); 3. At the end of each headwall, the stream bed shall be restored to allow the stream to access the culvert and allow aquatic passage. My deviation from this will need on site approval from NC D WR. [15A NCAC 02H.0506(b)(2)] 4. Native stream bed material excavated to install the headwalls shall be retained, stored separately from other stockpiled material, and used to restore the streambed to proper elevation that allows for aquatic passage. [15A NCAC 02H.0506(b)(2)] 5. The bypass pumping operation shall be maintained continuously during headwall construction. Adequate back up measures, such as a back-up pump or extra pump capacity during a rain event, shall be employed. All bypasses of the impervious dike are to be reported. The bypass pumps, if operated on a float system, shall have fuel level monitored at intervals adequate to maintain pump viabiliry. lf pumps aze not operated on a floxt system, pumps shall be checked more frequently, as to wrrespond to fuel usage, to ensure pumn viability during weekends and holidays. Unless otherw;se approved in this cer[ificatioi�, plscement of culverts and other structures in open waiers and sffeams shall be placed below the elevation of the streambed by one foot for all culverts with a diameter greater than 48 inches, and 20 percent of the culveR diameter for culverts having a diameter '� less than 48 inches, to allow Iew flow passage of water and aauatic life. Design and placement of culverts and other.structures including temporary erosien control measures shall not be wnducted in a manner that.may result in dis-equilibrium of wetlands or stre��nbeds or banks, adjacent to or upstream and downstream of the above strucmres. The applicant is required to provide evidence tha[ the equilibrium is being maintained ifrequested in wri[ing by NCDWR. Ifthis condition is unable [o be met due to bedrock or other limiting features encountered during construction, please contactNCDWR for � guidance on how to proceed and to determine whether or not a permit modification will be required. The Permittee shall ensure that the final design drawings adhere to the permit and to the permit drawings submitted for approvaL [15A NCAC-02H .0507(c) and 15A NCAC 02H .0506 (b)(2) and (�)(2)l 7. All work in or adjacent to stream waters shall be conducted in a dry work area. Approved BMP measu:es from the most current version of NCDOT Construc[ion and Maintenance Activities manual suchas sandbags, rockbe:ns, cofferdams and other diversion snuctures shsll be used to prevent excavation in 47owing water. Heav}• equipmentsha:l be operated from the banks rather than in the stream channel in order to mir.imize sedirnentation snd :educe the introdaction of other pollutants into tl�e stream. All mechanized equipment operated near surface �vaters must be regulazly inspected and r.iaintained to prevent contamination of stream waters from fuels, ]ubricants, hydraulic fluids, or other texic materials. Dischazging hydroseed mixtures and washing out hydroseeders and other equipmen[ in or adjacent to surface waters is prohibi[ed. [15A NCAC 02H.0506(b)(3)] 12. Thepermittae and�its autl�orized agents shall conduct its activities in a manner consistent with State water quality standards (including any requirements resultir.g from compliance with §303(d) of the Clean Water �� -� '' Act) and any other appropriate requirements of State and Federal law. Erosion and sediment control practices must be in full compliance with all specifications goveming the proper design, installation and operation and maintenance of such IIest Management Practices in order to protect surface waters standards [15A NCAC 02H.0506(b)(3) and (c)(3]): a. The erosion and sediment control measures for the project must be desi�ed, installed, operated, and ,maintained in accordance with the most recent version of the North Carolina Sediment and Erosion Con[rol Planning and Design Manun/. b..� The design, installation, operation, and mainienance of the sediment and erosion cor.trol measures must besuch.that they equal, or exceed, the requirements soecified in the most recent version of the North Cnrolina Sediment and Erosion Control Mam�ol. The devices shall be maintained on all construct:on sites, borrow sites, and waste pile (spoil) projects, inclading contractor-owned or leased borrow pits associated with the projec[. c. For borrow pit sites, [he erosion and sediment con[rol measures must be designed, installed, operated, and maintained in accordance with the most recent version of the North Carolrna Surface Mining Manual. d. The reclamation measures and implementation must comply with the reclamation in accordance with the requ'vements of the Sedimentation Pollution Control Act. 22.
