incomplete and cannot be processed. The application is on -hold until all of the

is for _185_ linear feet of stream impacts. Pursuant to 143-215.3D (e), a $570

(BNK), has prepared the attached Pre -Construction Notification (PCN) for the above referenced
project to apply for a Clean Water Act Section 404 Nationwide Permit 29, Section 401 Water
Quality Certification No. 3890, and a 15A NCAC 02B .0233 Neuse River Riparian Area buffer
authorization. The project is a residential development located north of I-540, east of Sycamore
Creek, and between Leesville Road and Erinsbrook Drive (Figure 1).
The attached PCN provides information for use in your review of the proposed impacts to
streams, wetlands, and buffers associated with this project. Supplemental information is provided
in this cover letter and in the attachments including a Vicinity map, USGS map, Jurisdictional
Features map, and Impact Map. BNK has provided the attached site plans for your review.
Proposed Impacts and Mitigation
The only impacts associated with this development are due to a road connection required to tie
an existing subdivision to City of Raleigh Fire Station Number 29 (Fire Station) to the north. It
would complete the connection between an existing road stub on Englehardt Drive to the south
with one constructed next to the Fire Station. The alignment will follow a recorded public
easement, and is not flexible in its alignment.
The original plan called for a sanitary sewer connection to an existing interceptor line along
Sycamore Creek. This alignment required crossing the UT of Sycamore Creek parallel to the
proposed road crossing, and then a westward corridor crossing two additional wetland areas.
Project designers located a lesser impact option by tying into an existing gravity line along ACC
Boulevard to the west. This alignment crosses one Wake County Soil survey stream. CEI visited
this feature on November 21, 2016 and found no stream feature exists. No wetlands occur within
this alignment. A request for NCDWR review of our findings has been submitted.
Impacts associated with the proposed road crossing have been minimized to the greatest practical
extent. The City of Raleigh dictates the maximum allowable crest and sag of streets. Project
designers attempted to lower the road crossing to minimize the fill slope footprint. The City
allowed some flexibility in their requirements and authorized some minimization of impact.
However, the variance required to bring this crossing below mitigation thresholds was not
feasible.

The road stub included in the site plan is a requirement of the City of Raleigh. Any future
extension of this road would require additional impacts, including a crossing of an existing
impoundment of the UT of Sycamore Creek. The owner of the tract this road stubs out to is not
connected to this project in any way, and has no plans to sell or develop the property.
Sediment and erosion control measures would be implemented according to NC requirements,
and approved by NCDEQ. Jurisdictional areas adjacent to construction areas would be clearly
marked with protection fencing or other similar method to avoid inadvertent encroachment.
Copies of permits and impact areas would be provided to the prime contractor and all
subcontractors working in or near jurisdictional areas. Construction and grading would be
completed with typical equipment including track excavators and graders.

Engineers worked with the City of Raleigh to reduce the amount of fill needed for the road crossing. However, the slope of adjacent land and
elevation needed across the stream mandated what is proposed. The original plan called for a sewer line crossing of th UT of Sycamore Creek,
including two additional wetland impacts en route to an existing interceptor along Sycamore Creek. The new project would connect at ACC Blvd.

Best management practices and sedimentation and erosion control methods will be used during all construction techniques. No equipment refueling
or maintenance activities will occur adjacent to jurisdictional areas. All temporary impacts to jurisdictional wetlands during construction activities will
be returned to their original configuration and seeded in a timely manner for stabilization. Stream crossings will be stabilized with riprap and fabric.

1. The Corps of Engineers believes that there may be jurisdictional waters of the
United States on the subject site, and the permit applicant or other affected party
who requested this preliminary JD is hereby advised of his or her option to
request and obtain an approved jurisdictional determination (JD) for that site.
Nevertheless, the permit applicant or other person who requested this
preliminary JD has declined to exercise the option to obtain an approved JD in
this instance and at this time.
2. In any circumstance where a permit applicant obtains an individual permit, or
a Nationwide General Permit (NWP) or other general permit verification requiring
upre-construction notification" (PCN), .or requests verification for a non -reporting
NWP or other general permit, and the permit applicant has not requested an
approved JD for the activity, the permit applicant is hereby made aware of the
following: (1) the permit applicant has elected to seek a permit authorization

This document confirms that CalAtlantic Group, Inc. (Applicant) for the Englehardt Subdivision
(Project) has expressed an interest to utilize 334 Stream Mitigation Credits from the EBX-Neuse
sponsored Neu -Con Wetland & Stream Umbrella Mitigation Bank, specifically the Selma Mill Site in
Neuse HUC 03020201. As the official Bank Sponsor, EBX, attests to the fact that mitigation is available
for reservation at this time.
These mitigation credits are not considered secured, and consequently are eligible to be used for alternate
purposes by the Bank Sponsor, until payment in full is received from the Applicant resulting in the
issuance of a Mitigation Credit Transfer Certificate by the bank acknowledging that the Applicant has
fully secured credits from the bank and the Banker has accepted full responsibility for the mitigation
obligation requiring the credits/units.
The Banker will issue the Mitigation Credit Transfer Certificate within three (3) days of receipt of the
purchase price. Banker shall provide to Applicant a copy of the Mitigation Credit Transfer Certificate and
a documented copy of the debit of credits from the Bank Official Credit Ledger(s), indicating the permit
number and the resource type secured by the applicant. A copy of the Mitigation Credit Transfer
Certificate, with an updated Official Credit Ledger will also be sent to regulatory agencies showing the
proper documentation.
