Environmental Consultants December 12, 2016 TO: Mr. Chad Coburn NC DEQ Division of Water Resour PAIL; 127 Cardinal Drive Extension Wilmington, NC 28405 RE: 401 WQC Application; Sullivan Project Surf City, NC (Pender County) Dear Chad: 2 0 6 1 2 4 4 Enclosed is a 401 Water Quality Certification application for your review. This application is submitted on behalf of Henry Allen Sullivan for the construction of a mixed-use development located off of Hwy 210 in Surf City, NC. The applicant plans to construct five commercial outparcels with road frontage and 12 single-family lots behind it. The project will permanently impact 0.319 acre of wetlands in order to access the project area. Additionally, 0.153 acre of RPW impacts are needed to utilize uplands throughout the site. To mitigate for wetland impacts, the applicant proposes buying 0.3 acre of non -riparian wetland credits from the Northeast Cape Fear Mitigation Bank. The Pre -Construction Notification form, associated maps, and site plan are enclosed for your review. Additionally, the NC DWR application fee has been submitted to your Raleigh office. Please contact me if you have any questions. Thank you for your assistance with this project. Sincerely, V,, L - Kim Williams Environmental Scientist Encl. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project. Impacts were minimized as much as possible through careful site design. The Town of Surf City allows only one access point into this property. The applicant originally planned to place this access in uplands (see attached site plan from 2010). However, NC DOT recently placed a traffic light at the intersection of Hwy 210 and Fun Center Drive. The Town of Surf City is strongly encouraging the applicant to place the access road at this light for safety purposes. The RPW on site runs across the site. In order to make the much of the site buildable, impacts were necessary. 1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques. (BUDDY) FOWLER, COUNCILMAN Date: 11/29/2016 Re: Driveway access on Highway 210/ Wetland Fill Sullivan Property LLC — Parcel #4235-28-0035-0000 From a planning perspective the filling of the wetlands on the Sullivan property makes sense for the following reasons: • The Town of Surf City Zoning Ordinance only will permit a shared access point to get to these lots as they are in the C3 Commercial Zone. • Alignment with the existing driveway, creating a full access intersection, allows for a better flow of traffic onto the State maintained roads, access to future and existing businesses and a much safer and controlled access point. It is not the Town's policy to encourage the filling of wetlands but in this specific sit n the benefit to the community as a whole in regard to safety necessitates our support.
