Mebane.

The purpose of the proposed project is to provide vehicular and pedestrian access to Phase II of the subdivision.

The overall project consists of proposed development of the site with Phase II of the Village at Lake Michael Townhomes.
In order to provide access to Phase II of Lake Michael Townhomes, an access road and wetland crossing are necessary.
To faciltate development of the site and construction of the proposed wetland crossing, clearing and grading the site is
necessary. Graders, haulers, excavators and other heavy equipment will be used during site construction.

D. Impact Justification and Mitigation
1. Avoidance and Minimization
1 a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project.
Due to the development and use of the site as a residential development, a road must be constructed to provide access to the
site. The road width has been designed to be as narrow as possible given existing topographic gradients and safety concerns
associated with pedestrian and vehicular travel. Side slopes from the road have been designed to be 3:1.
The wetland crossing location was designed to cross at or near the narrowest portion of the wetland, attempting to minimize
the amount of wetland impact. Additionally, the crossing location was selected at a location that is impacting a lower quality
wetland that has formed as a result of stormwater improvements associated with Phase I of the townhomes. Portions of the
proposed area of impact include a matted/vegetative swale that affords minimal aquatic habitat/function.
Alternative crossing locations, including accessing the site from West Lebanon Road were evaluated. However, access from
West Lebanon Road would result in greater impact to a higher quality perennial stream that provides significantly greater
benefits for aquatic species. Therefore, the alternative crossing location was not considered a viable option compared to the
proposed crossing location.
The remainder of road/utility infrastructure and tomehomes have been designed to avoid impacts to jurisdictional streams,
wetlands and ponds. Wastewater will be discharged to an existing sewer line that crosses the site. Water will be provided to
the site from Phase I. The proposed water line has been designed within the road crossing impact area, thus, avoiding
additional impacts to WoUS.
There are approximately 0.1751 acres of wetlands, 677 linear feet of stream channel and 0.70 acres of open waters (ponds)
located on the site. The ponds, streams and remaining 0.1051 acres of wetlands have been avoided.
1b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques.
The clearing limits will be staked and silt fence will be used. A temporary coffer dam will be installed up -gradient of the
proposed culvert. During construction, water will be pumped around the construction footprint. Upon completion of the culvert
installation, the temporary sand bag coffer dams will be removed and flow will be diverted through the culvert. Impacts to the
wetland associated with the coffer dam are included within the permanent impact area of wetlands proposed within this
application.

PEI consulted the USFWS Endangered Species, Threatened Species, Federal Species of Concern, and Candidate
Species List for Orange County. Four federally listed protected species are identified on the list: the bald eagle, dwarf-
wedgemussel, Schweinitz's sunflower and smooth coneflower.
Based on our site observations, the site does not contain suitable habitat or large water bodies capable of supporting the
bald eagle. Therefore, we have made the determination that the proposed project is not likely to disturb the bald eagle.
The proposed project is not impacting streams that would be considered suitable habaitat for the dwarf-wedgemussel.
Therefore, we have made a determination of no effect for this species.
The project is not proposed to impact suitable habitat for Schweinitz's sunflower and smooth coneflower, that maybe
present on the site, along West Lebanon Road. Therefore, we have made a determination of no effect for this species.
Additionally, PEI reviewed the NC Natural Heritage Program database for federally protected species that inhabit the
Mebane, NC Quadrangle, the quadrangle that contains the site. The NHP database does not identify federally protected
species on the Mebane, NC Quadrangle.

Explanation: The feature(s) listed above have been located on the Soil Survey of

USGS Topographic map at a 1:2,000 scale. Each feature that is checked "Not Subject"
has been determined not to be a stream or is not present on the property. Features
that are checked "Subject" have been located on the property and possess
characteristics that qualify it to be a stream. Streams that are considered subject have a
50' riparian buffer from the top of bank on both sides of the stream. The City of
Mebane's jurisdiction is only over the stream buffer. The NC Division of Water
Resources and the US Army Corps of Engineers have jurisdiction over streams both on
previously mapped and unmapped streams as well as on wetlands. There may be other
streams located on your property that do not show up on the maps referenced above,
but still may be considered jurisdictional according to the US Army Corps of Engineers
and/or to the Division of Water Resources. Additionally, impacts to the drainage feature
may require permitting through either of these permitting agencies.
All streams were evaluated per NCDEQ Stream Identification Method 4.11.
• Feature SA is a perennial stream that runs from the property line to Feature PA.
• Feature PA is hydrologically connected to feature SA.
• Feature SAA is considered not subject.
• Feature PAB is considered not subject.
• Feature WA runs alongside PAB, and is not subject.
• Feature WAA is South of PAB and considered not subject.
• Feature SAB runs between WA and WAA and is not subject.
After the field visit, the City of Mebane concurs with Pilot Environmental's
determinations. The final map, Soil Survey of Orange County, and the USGS
Topographic map at a 1:2,000 scale are attached to this document.
This on-site determination shall expire five (5) years from the date of this letter. Landowners
or affected parties that dispute a determination made by the City of Mebane representative
shall be referred to the Director of the Division of Water Resources, c/o the 401 Oversight
Express Permitting Unit, or its successor. The Director's decision is subject to review as
provided in G.S. 150B Articles 3 and 4. An appeal request must be made within sixty (60) days
of date of this letter or from the date the affected party (including downstream and/or
adjacent owners) is notified of this letter. A request for a determination by the Director shall
be referred to the Director and the City of Mebane in writing.
This determination is final and binding unless, as detailed above, you ask for an appeal within
sixty (60) days.
The owner/future owners should notify the City of Mebane and/or the Division of Water
Resources (including any other Local, State, and Federal Agencies) of this decision concerning
any future correspondences regarding the subject property (stated above). This project may
require a Section 404/401 Permit for the proposed activity. Any inquiries about 401/404
permitting should be directed to the Division of Water Resources (Winston Salem Regional
Office) and the US Army Corp of Engineers (Raleigh Regulatory Field Office).
