Salisbury Street Raleigh, NC 27604 Re: Westlake at Country Trail �— Request for Buffer Impact Approval v Sage Project #2016.47 On behalf of Mr. Bennett Keasler, Jr. of Aspect Partners, LLC, please find attached a complete application and supplemental information requesting written approval from the North Carolina Division of Water Resources (NCDWR) to proceed with activities associated with the proposed residential development of Westlake at Country Trail. Project History The 6.3 -acre site (Site) is located southwest of the intersection of Kingsland Drive and Leesville Road in Raleigh, NC. The Site is the southern subdivided portion of a larger 13.51 -acre parcel. The northern portion of the original parcel is being developed as a church and does not have any proposed wetland, stream, or riparian buffer impacts associated with its development. The stormwater plan for the Site will be reviewed by the City of Raleigh. DWQ EXP# 09-0361 corresponds to the riparian buffer determination made on the site in 2009. Based on previous conversations with NCDWR staff, the buffer determinations made in the letter associated with the 09-0361 determination (copy attached) is still valid because the five-year "clock" did not start until January 1, 2012. No permits have been previously requested or issued for the site from the NCDWR or the US Army Corps of Engineers (USACE). Sage reevaluated the Site in October of 2016 and was able to locate the flagging used to demarcate the beginning of the buffered stream. Photos of the Site are attached. Project Summary and Purpose The purpose of the proposed project is to provide additional housing for the area. The project will involve the development of 14 home lots and the utilities (e.g. roadway, sewer, stormwater, etc.) associated with a residential development. Westlake at Country Trail Subdivision Page 1 of 2 Avoidance and Minimization The heavy equipment required to complete the repairs will remain outside of Zone 1 of the buffers to minimize impacts. The aerial sewer crossing was proposed to avoid stream impacts. The construction corridor for the aerial stream crossing was limited to a 30 -foot wide corridor to reduce buffer impacts while still complying with the City of Raleigh's requirements. The riprap used for the stormwater bypass will not be placed in the intermittent streambed. Proiect Impacts No stream or wetland impacts are proposed. The riparian buffer impacts resulting from the aerial sewer crossing and the stormwater bypass will impact a total of 2,700 ft2 in Zone 1 and 1,800 ft2 of Zone 2. Mitigation No mitigation has been proposed because all of the proposed impacts are considered "allowable". If you have any questions, please call me at (919) 559-1537. Proposed impacts are requested to discharge stormwater from a stormwater BMP and for an aerial sewer line crossing. The sewer crossing was proposed as an aerial crossing to avoid stream impacts. The aerial sewer crossing was limited to a 30 -foot wide corridor to reduce buffer impacts but meet the City of Raleigh's requirements. The riprap used for the stormwater bypass discharge will not be placed in the stream bed and will remain above the ordinary high water line. 1 b.
