The project shall be constructed in aceordance with your application reeefved May I>, 2013 and ranewal request
received December 13, 2016. After reviewing your application, we have decided that these impacts are covered by
General Water Quality CeRification Number 3886. This csrtitication corresponds to the Nationwide Pennit 14
issued by the l:orps of Engineers. In addition, you should acquire any other fede;al, state or local permits before
yoc proceed with yeur project ir.cleding (bu[ not limited [o) Sediment and Erosion Control, NomDischarge and
Wa[er Supply Watershed regula[ions. This approval will expire with the accompanying 404 permit. This
Certification replaces the one issned May 22, 2013.

18. The outside buffer, wetland or water boundary located within the construction corridor approved by this
authorization, including all non-commercial borrow and waste sites associated with the project, shall be clearly marked
by highly visible fencing prior to any land disturbing activities. Impacts to areas within the fencing are prohibited unless
otherwise authorized by this certification. [15A NCAC 02H.0501 and .0502]

21. Upon completion of the project (including any impacts at associated bonow or waste sites), the NCDOT Division
Engineer shall complete and re*au.� the enclosed "Certifcation of Com�letion Form" to notify thP NCDWR when all

22. Native riparian vegetation (i:e; trees and shrubs naiive to your geographic region) must be reestablished in the riparian
areas within the construction limits of the project by the end of the growing season following completion of construction.

23. T'here shall be no excavation from, or waste disposal into, jurisdictional wetlands or waters associated with this
permit without appropriate modification. Should waste or borrow sites, or access roads to waste or borrow sites; be
located in wztla��ds or streams, compensatoiy � mitigation will be required since that is a direct impact from. road
construction activities. [15A NCAC 02H.0506(b)(3) and (c)(3)]
24. Erosion and sediment control practices must be in full compliance with all specifications governing the proper
design, instaliation and operation a�-�d rnainter,ance of such Eesi Mauagement Practices ui order to proteci surface waters
standards [15A NCAC 02H.050G(b)(3) and (c)(3�]: -
a. The erosion and sediment control measures for the project must be designed, installed, operated, and
maintained in accordance with the most recent version of the North Carolina Sediment and Erosion
Contro! Pianning and Desi;n Murra�r�l.
b. The design, installation, operation, and maintenance of the sediment and erosion control measures must
be such that they equal, or exceed, the requirements specified in the most recent version of the North
Carolinu Sedin,e�t[ artd Erosion Con(ru! ,Lla�ival. The devices shall be mainiaineti ou ali conslmction
si[es, oorrow si[es, and was[e pile (spoii) projects, including contrac[or-owned or leased borrow pits
associated with the project.
c. For borrow pit sites, the erosion and sediment control measures must be designed, installed, operated,
and maintained in accordance wirh the most recent version of the North Carn!inn Surface Mining
Manu�cl.
d. The reclamatior. rc�easures ard implementa[ion must comply with the reclamation in acccrdance with the
requirements of the Sedimentation Pollution Control Ac[.
25. Sediment and erosion control measures shall not be placed in wedands or waters unless otherwise approved by this
Certificatioa [ISA NCAC 02H.0506(b)(3) ard (c)(3)]

hearing. You may obtain the petition form from the office of Administrative hearings. You must file the petition
with [he office of Administrative Heanngs within sixty (60) days of receipt of this notice. A peti[ion is considered
filed when it is received in the office of Administrative Hearings during normal office hours. The Office of
Administrative Hearings accepts filings Monday [hrough Friday between the hours of 8:OOam and S:OOpri, except
for official state holidays. The original and one (I) copy of the peti[ion must be filed with the Office of
Administrative Hearings.
The petition may be faxed-provided the original and one copy of the document is received by the Office of
Administrative Hearings within five (5) business days following the faxed transmission.
