This project has the potential to impact trout waters or other aquatic species of concern. No construction activicies shall begin until the NCWRC makes a determination regarding moratoria. Should the NCWRC determine that a moratorium is applicable then the requirements of any moratorium(s) shall be a condition of this 4U1 Certification. lf the NC,DOT does not wish to honor the moratorium, then a written modification shall be submitted. Erosion and sediment control practices must be in full compliance with all specifications governing the proper design, installation and operation and maintenance of such Best Management Practices in order to protect surface waters standards [15A NCAC 02H.0506(b)(3) and (c)(3]): a The erosion and sediment control measures for the project must be desip,ned, installed, operated, and maintained in accordance with the most recent version of ihe North Caro[ina Sediment and Erosion Control Planning and Design Mawual. b. The design, installation, operation, and maintenance of die sediment and erosion wntrol measures must be such that they eyual, or exceed, ttte requirements specified in the most recent version of the North Carolina Sediment and Erosion Contro! Manual. The devices shall be maintained on all construction sites, botrow sites, and waste pile (spoil) projecu, including contractor-owned or leased borrow pits associated with the projed. c. For borrow pit sites, the erosion and sediment control measures must be designed, installed, operated, and maintained in accordance with the most recent version of the North Carolina Surface Mining Manunl. d. The reclamaHon measures and implementation must comply with the reclamation in accordance with the requ'vements of the Sedimentation Pollution Control Act. 22. Sediment and erosion control measures shall not be placed in wetlands or waters unless otherwise approved by this Certification.
