A North Carolina Division of Coastal Management (DCM) Fisheries Resource Specialist has reviewed the subject permit application for proposed actions that impact fish and fish habitats. The applicant has proposed a modification to Permit #03-15 which authorized repairs to an existing vinyl sheet break -water that protected the entrance channel to Kitty Hawk Landing and the installation of rock along the breakwater with a footprint of 26' in width (13' of each side of breakwater). The modification would move the rock to be placed on the interior of the breakwater to the outside of the breakwater. Originally this office had no objection to the permit even though the area is mapped submerged aquatic vegetation (SAV) habitat and SAV does exist in the adjacent waters. Surveys provided with the original application show SAV beds in the area and on a site visit in November of 2014(well after the preferred SAV survey time) I observe remnant SAV growth. Reasoning for no objection was that a portion of the project was the repair of an existing structure as well as the area outside of the breakwater was already disturbed by heavy scour from wave action encountering the vertical breakwater limiting SAV growth directly adjacent to the breakwater. The other half of the approximately 14,000 square feet of fill was occurring between the breakwaters in area already disturbed by boat traffic and with an active dredge permit. I do object to the proposal to modify the permit by placing all of the rock on the outer portion of the breakwater as it is likely to have a significant adverse impact on SAV and SAV habitat in the area surrounding the breakwaters. Placing the entire 26' footprint of rock on the outer portion of the vinyl breakwaters expands the footprint well beyond the area of bottom disturbed by wave action adjacent to the vertical structure and essentially doubles the impacts to bottom habitat. If rock placed between the vinyl breakwaters is a concern to navigation and maintenance that portion of the project should be removed, not placed outside the breakwater.
