PO Box 128 Kernersville, NC 27285 Authorization Certificate Re: Determination of No Practical Alternative for Stream Buffer Disturbance Witty Road - Proposed Residential Subdivision (stream crossing) Project Location: [8407 Witty Road, NC (0138842)] Dear Mr. Parks, Please be advised that the request for the use of the Stream Buffer that you have submitted for the Witty Road subdivision stream crossing has been approved by this Office. The stream reach to which this approval applies is shown on the attached aerial photograph. Further, the stream reach will still be subject to the conditional Allowable Use category of the Guilford County Development Ordinance as it pertains to the Jordan Lake riparian buffer requirements within Table 7-1-2: Road crossings that impact greater than 40 linear feet but equal to or less than 150 linear feet or one-third of an acre of riparian buffer. Buffer Zone 1 Zone 2 Linear Impact Disturbance Impacts Impacts (feet) Allowable Allowable (square feet (square feet 131 9,541 1,039 148 In accordance with the State of North Carolina's Rule (15A NCAC 02B.0267) - Jordan Water Supply Nutrient Strategy: Protection of Existing Riparian Buffers, any applicant that intends to disturb Zone 1 and Zone 2 of the stream buffer must show that there is a "No Practical Alternative" to impact the stream buffer. The applicant submitted a Buffer Use Request Form on October 141h, 2016 outlining the "No Practical Alternative Request." Guilford County has determined that the impact to the Jordan Lake Water Supply Watershed stream buffer is necessary to install the road and stream crossing in question. Further, as outlined in Section 7-1-6 c To qualify for the designation indicated, an activity must adhere to the limitations defined for it in a given listing as well as the requirements established in Section 7-1.9(A)6(c) of the Guilford County Ordinance. Provided that: No heavy equipment is used in Zone One; Vegetation in undisturbed portions of the buffer is not compromised; No trees are removed by chain; No permanent felling of trees occurs in protected buffers or streams; Stumps are removed only by grinding; At the completion of the project, the disturbed area is stabilized with native vegetation; Zones One and Two meet the requirements of Sections 7-1.9(A)6(d) and 7-1.9(a)6(e). Please be advised that this letter does not exempt the stream reach from compliance with other local, state, or federal ordinances involving jurisdictional stream/wetland requirements, such as Section 401 and 404 of the Clean Water Act before the project proceeds. This approval is valid only for the purpose and design that was described in the application. If any modifications are made to the project, a written notification describing the changes, must be submitted to the Guilford County Planning & Development Department, Watershed Protection/Stormwater Management Division. If the property is sold, the new owner must be given a copy of the certification and approval letter and is thereby responsible for complying with all conditions. This letter completes the review of the Determination of No Practical Alternative by the Guilford County Planning & Development Department, Watershed Protection/Stormwater Management Division.
