Dear Mike Mills:
We appreciate the immediate response to the issues associated with the Notice of Violation (NOV) that was issued to
Division 7 is response to violations that occurred on March 5, 2008 at the 311 Bypass Construction site. In my letter
dated March 11, 2008, I asked that DOT provide us with documentation including rain gauge data and weekly inspection
and monitoring records as required by the NPDES_Stormwater Permit NCS000250/ Construction Stormwater Permit
NCG010000. Weekly inspection and monitoring logs evidenced that these were being conducted as required. However
abatement dates for corrective actions should be included in the future, as well as more detail in the logs when describing
inspected measures.
We also requested a meeting between DOT Division 7 staff and DWQ staff in the Winston-Salem Regional Office to
discuss. We appreciate the time Brian Smith, Patty Eason, Barry Harrington, and you took to come to the office. During
the meeting, we discussed the violation and contractor supervisor and crew training issues, including language barriers
and having individuals with appropriate certifications present at work sites.
And finally, though not required by DWQ, DOT organized training for crew workers and their supervisors on April 2,
2008. DOT provided a translator for Spanish speaking individuals. We commend your efforts in this training exercise,
and feel it was a positive learning experience for those involved.
Because of DOT's due diligence in regard to the NOV, the Division of Water Quality will not be assessing any fines. We
look forward to a continued positive professional relationship between the Winston-Salem Regional office and Division 7
