On behalf of the applicant, Wake County Board of Education, please find attached a complete application
and supplemental information requesting written concurrence from the U.S. Army Corps of Engineers and
the N. C. Division of Water Resources (NCDWR) that the activities proposed below may proceed under
Nationwide Permit 12 and Water Quality Certification 3884. The proposed project is within the Jordan
Watershed and was previously reviewed and impacts approved as a "local unit of government", therefore
the applicant requests again for the No Practical Alternatives review to be completed by the NCDWR.
The purpose for this modification request is that in preparation to install the sanitary sewer bore through
the wetland and across White Oak Creek and its tributary, the project engineers had the original survey
verified and found that the White Oak Creek stream bottom was approximately 2.5' deeper than shown on
the original survey. Per the project engineers, they have met with the Town of Cary and the Town is fine
with the bore encasements being exposed through the stream channels. Please contact me at (919) 846-

3. Project Description
3a. Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this
application: The existing conditions on site consist of forested land with White Oak Creek and its floodplain wetlands as
the northern boundary, a stream & wetland system bisecting the center portion of the property with a drained pond at the
head of this system, along with another stream & wetland system along the eastern side of the property. Additionally,
there is an isolated stream along the western side of the property and an additional drained pond at the far eastern corner
of the property that drains to the large offsite pond to the northeast. There are some utility easements adjacent to Green
Level Church Road and Roberts Road. And finally, there is an existing conservation easement within the property
boundaries, the boundaries of this conservation easement (CE) were re -negotiated for this project. The CE is held by the
Town of Cary and the NC Clean Water Management Trust Fund #2004A-003. The general land use in the vicinity of the
project is rural residential, with an influx of new residential.

3d. Explain the purpose of the proposed project:
The purpose of the proposed project is to construct infrastructure (i.e. roads, parking, sporting fields & courts, building
structures, stormwater devices and offsite utilities) for a high school. Additionally, the proposed school will benefit the
community and neighboring developments because it will serve the rapid growth in this part of the county and alleviate
overcrowding in other area high schools. The purpose of the modification request is to modify the stream and buffer
impacts for the sanitary sewer connection going north from the site.
3e. Describe the overall project in detail, including the type of equipment to be used:
The overall project consists of the construction a high school and attendant features, including but not limited to; ball
fields, multipurpose field, track and stadium field, competition field, tennis courts, volleyball courts, and the infrastructure
(i.e. roads, parking, utilities and stormwater devices). Specifically, this project will require impacts to wetlands necessary
for parking, entrance drives, and offsite utilities. For the offsite sanitary sewer to the north, the sanitary sewer will be
constructed via Bore & Jack and will result in stream and riparian buffer impacts. Equipment such as bull dozers,
bucket loaders, excavators and other typical equipment used for land disturbance, construction and Bore & Jack will be
utilized for this project.

D. Impact Justification and Mitigation
1. Avoidance and Minimization
la. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project. This project is a
proposed Wake County Public School site with a proposed offsite sanitary sewer line, an offsite domestic water line and
offsite reclaimed water line within the Town of Caryjurisdiction. The existing project site includes three (3) stream
systems, two of which have adjacent wetlands and two (2) drained ponds. The site is bounded by White Oak Creek to
the north, Green Level Church Road to the west, Roberts Road to the south, a future Town of Cary park site to the east
(north side) and a private residence to the east (south side).
The project proposes to construct only the required site athletic program elements and does not exceed the minimum
number of parking spaces for a public high school. Impacts to the wetlands were minimized to the fullest extent
practicable by fully scrutinizing a master plan for the high school and utilizing 3:1 slopes and minimum dimensions for
parking spaces, drive aisles and utility separations. A four-story high school building is proposed to minimize the
development footprint and assist in minimizing impacts to the site. The proposed high school will connect to the Town of
Cary's public water and sanitary sewer lines. A sanitary sewer gravity line will be extended north off the site and connect
to the existing Town of Cary White Oak Sanitary Sewer Outfall. This project will also extend the Town of Cary's water
main across the road frontage of the site. Water services for the school will connect this public water main extension. All
design and construction shall abide by the Town of Cary standards and specifications.
Impact Areas 1-4 have been previously reviewed and authorized, this application only includes the modification
to impact area #5.
Impact #5 are proposed impacts necessary for the offsite sanitary sewer; this section connects the school site to
the White Oak Creek Sanitary Sewer Outfall to the north. The proposed sewer line will result in temporary
wetland impacts, with exception to the permanent maintenance corridor which will result in a permanent
conversion of a forested wetland to a maintained herbaceous wetland. Additionally, the proposed sewer line will
result in one permanent stream impact as a result of inaccurate survey data which resulted in White Oak Creek
and its tributary to the north being lower in elevation than the original survey. Therefore, the sewer line will
result in 2 linear feet of permanent stream impact. Any temporary wetland impacts will be brought back to
original contours and be re -vegetated with native species.
The applicant is aware of the regional conditions associated with Nationwide Permits 12. With respect to utility line
activities (NWP 12 -Regional Conditions section 4. 0), the applicant is proposing the Bore & Jack method to minimize
impacts to wetlands, any temporary discharges into wetlands during construction activities will be kept to minimum period
of time and will be contained with appropriate erosion control methods, construction corridor proposed to be varying
widths, depending on sanitary sewer or water, however all less than 40' wide; utilities are not crossing the AIWW, the
utilities are not aerial communication lines or crossing navigable waters, the cleared wetlands within the construction
corridor will be re -vegetated with native species and the permanently maintained corridor has been minimized to 20' wide
and a compensatory mitigation plan has been provided (see section D.2 ); use of riprap will be avoided to the maximum
extent practicable.
1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques. The
project proposes the installation of tree protection and temporary silt fence and other sediment control measures such as
stone inlet protection to protect the buffers, streams and wetlands. Regular site inspections will be performed by the
design team to ensure the contractor is in compliance with all permits.

We have reviewed the "Draft Internal Policy, Cumulative impacts and the 401 Water Quality Certification and
Isolated Wetlands Programs" document prepared by the NC Division of Water Quality on April 10, 2004, version
2.1. The draft states that publically funded developments may or may not result in cumulative impacts. For
instance, the development of a regional, public park or new library is unlikely to result in cumulative impacts. The
Green Level High School (H -7) -Sanitary Sewer Modification project will be an institutional development.
Additionally, this project is located within Town of Cary's jurisdiction, therefore the adjacent properties that have
potential for development will have the following regulations to protect downstream waters: 1) the Water Supply,
Watershed Protection Program which limits development densities as well as requires protective riparian buffers, 2)
the Jordan Watershed Riparian Buffer Protection regulations, these regulations require limited development within
the riparian buffer area in addition to "diffuse flow" requirements at a minimum, and could require Best Management
Practices that control nitrogen if diffuse flow cannot be achieved, and finally 3) the Phase 11 NPDES Stormwater
Permit Program, this program includes permitting requirements for Municipal Separate Storm Sewer Systems
(MS4s) in addition to post -construction stormwater management requirements. We anticipate that the DWR will
advise us if any additional information is needed.
4. Sewage Disposal (DWQ Requirement)
4a. Clearly detail the ultimate treatment methods and disposition (non -discharge or discharge) of wastewater generated from
the proposed project, or available capacity of the subject facility. The Durham County Triangle Waste Water Treatment
Plant will be receiving the piped wastewater from the proposed project. This plant is a regional facility that accepts
wastewater from a few municipalities including Cary, Morrisville and parts of Durham.

Natural Heritage Program (NHP) office located in Raleigh, North Carolina on January 13, 2014. These records were
reviewed utilizing the most recent version of available NHP GIS data (NHP 2014). The records review showed that no
federally protected species are located on the project site or within a 2 -mile radius of the site boundary. A significant
natural heritage area, the White Oak Creek Floodplain, is located within a 2 -mile radius of the site boundary. Proposed
off-site utilities will impact this floodplain.

1. Stormwater Management Plan (SMP) Approval from Local Community Reauired
You are required to provide one copy (hard copy or digital) of the approved SMP, including
plan details on full-sized plan sheets, with proof of the Town of Cary's approval. The
approved SMP shall be submitted to the DWR 401 & Buffer Permitting Unit (1617 Mail
Service Center, Raleigh, NC 27699-1617) before any impacts authorized in this certification
occur. After it is approved and submitted to the Division, the SMP may not be modified
without prior written authorization from the Town of Cary. If the SMP is modified in the
future, then you shall provide one modified SMP with proof of approval to the DWR 401 &
Buffer Permitting Unit prior to the commencement of the modifications. 115A NCAC 02H

2. No Waste, Spoil, Solids, or Fill of Any Kind
No waste, spoil, solids, or fill of any kind shall occur In wetlands, waters, or riparian areas
beyond the footprint of the impacts depicted in the Pre -Construction Notification. All
construction activities, including the design, installation, operation, and maintenance of
sediment and erosion control Best Management Practices, shall be performed so that no
violations of state water quality standards, statutes, or rules occur. [15A NCAC 02H .0501

3. Protective Fencing
The outside buffer, wetland or water boundary and along the construction corridor within
these boundaries approved under this authorization shall be clearly marked with orange
warning fencing (or similar high visibility material) for the areas that have been approved to
infringe within the buffer, wetland or water prior to any land disturbing activities to ensure
compliance with 15 NCAC 02H .0500. [15A NCAC 02H.0506 (b)(2) and (c)(2) and 15A NCAC
02H.0507 (c)]

4. This approval is for the purpose and design described in your application. The plans and
specifications for this project are incorporated by reference as part of the Certification
and Buffer Authorization. If you change your project, you must notify the Division and
you may be required to submit a new application package with the appropriate fee. If
the property is sold, the new owner must be given a copy of this approval letter and
General Certification and is responsible for complying with all conditions. [15A NCAC

5. This approval and its conditions are final and binding unless contested. [G.S. 143-215.5]
This Certification and Buffer Authorization can be contested as provided in Articles 3 and 4 of
General Statute 1508 by filing a written petition for an administrative hearing to the Office of

1 am pleased to advise that on March 6, 2015, the Town of Cary approved the above referenced development
plan. This approval is specifically for the following:
• Development of a 320,987 -square -foot high school and associated ancillary uses
DURATION AND EFFECT OF APPROVAL
• No change(s) may be made to the above -referenced development plan unless approved by the Town of
Cary.
• In accordance with Section 3.9.2(K) of the Land Development Ordinance (LDO), this approval shall become
null and void if the applicant fails to make "substantial progress" on the site prior to March 6. 2017, or
extended date if approved by the Planning Director in accordance with all applicable requirements of the
LDO. (Refer to LDO Chapter 12 for definition of "substantial progress')
• In no case shall this plan or parts of this plan be valid if not completed as approved prior to March 6, 2020. If
a plan is deemed to no longer be valid, the owner or applicant will be required to resubmit for approval a plan
that meets current development ordinances unless otherwise noted in this Ordinance.
PLEASE NOTE THE FOLLOWING:
Before any work may begin on this project, all fees included in the attached Statement of Fees must be
paid prior to or concurrent with submitting the following to the Inspections and Permits Department
(located on the 1st Floor of the Cary Town Hall):
o Three complete, 24"x 36" sets of the signed, approved plans
o One complete, 11"x 17" set of the signed, approved plans
o Copy of the Statement of Fees and Receipt
o All fees indicated in the attached Statement of Fees should be remitted through the Inspections S
Permits Department, not the Finance Department. Please have the Statement of Fees and the
project HTE number(s) available when paying to ensure that the fees are receipted correctly. Failure
to do so may result in delays to processing times for related applications and permits. Failure to
submit the required fees as specified may also result in the Town initiating appropriate enforcement
action in accordance with Chapter 11 of the LDO. Such action may include, but is not limited to,
issuance of civil penalties and/or withholding issuance of building and occupancy permits.

• At the conclusion of development and prior to the final site inspection, a final set of this plan set

• Requirements for Construction and/or Occupancy of a Building or Structure
A building permit issued by the Town of Cary Inspections and Permits Department is required prior to
commencing the erection, construction, reconstruction, restoration, alteration, enlargement, conversion,
remodeling, demolition, moving, or repair of a building or structure or part thereof, including interior and/or
exterior work. Situations in which no work (interior or exterior) will be performed on a building or structure, a
building permit is also required prior to a change in the use or occupancy of any existing building or part
thereof. All required development fees will be due prior to the issuance of a building permit. For any
questions about permits, inspections, and/or fees, please contact the Inspections & Permits Department at

• No Certificate of Occupancy may be issued until all on-site and off-site improvements have been completed
unless otherwise approved by the Town of Cary.
• Signage is a separate approval process and has not been reviewed or approved as a part of this
