REFERENCE: Memorandum from the North Carolina Department of Transportation to the U.S.
Army Corps of Engineers requesting to rescind Section 404 Nationwide Permits
23 and 33, dated April 11, 2008.
Section 404 Nationwide Permit Numbers 23 and 33, issued by the U.S. Army
Corps of Engineers, dated December 6, 2007 (Action ID No. SAW-2007-03852).
Application for Section 404 Nationwide Permits 23 and 33, dated October 19,
2007.
This memorandum serves to rescind the North Carolina Department of Transportation's (NCDOT)
Section 401 Water Quality Certifications (WQC) 3632 and 3634. These certifications were for impacts
associated with the proposed replacement of Bridge No. 108 over New Hope Creek on SR 1730 (Turkey
Farm Road) in Orange County. However, the bridge design has changed and the impacts permitted under
these certifications have been eliminated.
Since the NCDOT was going to adhere to all conditions of these WQCs, written concurrence was not
requested. These WQCs were to be used in conjunction with Section 404 Nationwide Permits (NWP) 23
and 33, issued by the U.S. Army Corps of Engineers (USACE) on December 6, 2007. A request to
rescind these NWPs, dated April 11, 2008, was submitted to USACE.
