The Division of Water Resources (DWR) approved a Bank Parcel Development Package (BPDP) for the
above -referenced site on July 11, 2016 from EBX-EM, LLC (EBX). On October 18, 2016, DWR
requested that EBX amend the BPDP and submit a modification to DWR that accurately describes the
site's existing conditions. On October 18, 2016, EBX submitted a draft BPDP Modification for the
Maple View Nutrient Offset Site for review and approval under the terms and conditions of the EBX-EM,
LLC Cape Fear Riparian Buffer and Nutrient Mitigation Banking Instrument (UBI). The UBI was made
and entered into by EBX-EM, LLC (EBX), acting as the Bank Sponsor, and the DWR on October 9, 2009
and modified on February 17, 2014. Based on DWR review, EBX submitted revisions of the BPDP
modification to DWR on November 4, 2016 and November 14, 2016.
This BPDP will be placed on public notice without a public comment period. The BPDP submitted on
November 4, 2016, with revisions received on November 14, 2016 is now approved.
According to the credit release schedule outlined in your BPDP Modification, the following items are
required prior to receiving your fust credit release of forty percent: (original approval letter dated
November 21, 2016 stated "twenty percent" instead of `fortypercent" and therefore, this letter replaces
the letter from November 21, 2016)
• Conservation easement approved by DWR
• Financial Assurance documents for monitoring
• Planting and Installation of Monitoring Devices completed
• Mitigation Site Earthwork completed
