HomeMy WebLinkAbout20160971 Ver 1_More Info Received_20161122PILOT ENVIRONMENTAL INC November 22, 2016 U.S. Army Corps of Engineers Attn: Mr. David Bailey Raleigh Regulatory Field Office Wilmington District U.S. Army Corps of Engineers 3331 Heritage Trade Drive, Suite 105 Wake Forest, North Carolina 27587 North Carolina Division of Water Resources Attn: Ms. Sue Homewood Winston-Salem Regional Office - 401 Wetlands Unit 450 West Hanes Mill Road Winston Salem, North Carolina 27105 Reference: Response to USACE Request for Additional Information Nationwide 404/401 Permit — SAW -2016-02101, DWR #2016-0971 Proposed Residential Sub -Division Witty Road Guilford County, North Carolina PEI Project 2011 Dear Mr. Bailey and Ms. Homewood: Mr. Herbert Parks (Applicant) received an electronic mail dated October 27, 2016 from the U.S. Army Corps of Engineers (USACE) and a letter from the North Carolina Department of Environmental Quality - Division of Water Resources (NCDEQ-DWR) dated November 2, 2016 requesting additional information to process the Nationwide Permit (NWP) and 401 Water Quality Certification (WQC) application for the proposed residential sub -division located on Witty Road in Guilford County, North Carolina. The electronic mail indicates that the USACE received the NWP application on October 11, 2016. The NCDEQ-DWR letter indicates that the NCDEQ-DWR received the 401 WQC application on October 7, 2016. The purpose of this letter is to provide the USACE and NCDEQ-DWR the requested information to process the NWP Verification and the 401 WQC. USACE Comment 1): Sheets 1 and 2 of 3 do not appear to show stream SAA. Please update these plan sheets to ensure that this and all jurisdictional wetland and streams are clearly shown NCDEQ-DWR Comment 3): Please provide a revised site plan with proposed lot layout as an that includes stream SAA. [15A NCAC 02H .0502(8)] PO Box 128, Kernersville, NC 27285 www.pilotenviro.com Response to Request for Additional Information Witty Road November 22, 2016 Applicant Response: The updated civil drawings (attached) include all jurisdictional waters within the project area. USACE Comment 2): Sheet 2 of 3 shows that the rip rap basin/pad would outlet into a curve in the stream bank. As discussed during our site visit yesterday, please realign the crossing location or skew of the pipe such that the rip rap basin/pad outlets into a more straight segment of stream. These efforts would reduce indirect impacts to downstream stream stability and water quality. Update the PCN to account for any changes in proposed stream impacts NCDEQ-DWR Comment 2): Please realign the outlet location of the culvert for the road crossing so that it is in better alignment with the stream channel. [15A NCAC 02H .0506(b)(2)] Applicant Response: The culvert alignment has been adjusted such that the rip -rap dissipater discharges to a more straight segment of stream. The result of adjusting the culvert has affected the amount and type of impact. Therefore, an updated PCN form documenting those changes are included as an attachment. USACE Comment 3): Sheet 1 of 3 shows that Lot 15 is diagonally bisected by Stream SA. Please provide a disturbance envelope necessary to construct a driveway and expected -sized dwelling, as well as a reasonable usable backyard area, to confirm that the lot size and shape is sufficient to avoid future impacts to streams and wetland on the lot. Please also provide information on how access to uplands to the southeast of the stream/wetland is to be provided in such a way that will not require additional authorization from the USACE. If additional authorization will be required to construct the driveway, dwelling, or access to the remaining lot, these impacts must be included for review as a cumulatively with the proposed Rivers Edge Road. NCDEQ-DWR Comment 4): Please provide building envelopes for all lots with wetlands, streams or buffers on the site plans to demonstrate these lots are able to be developed without additional jurisdictional impacts. [15A NCAC 02H .0502(g)] Applicant Response: The attached civil drawings show the footprint of the residences and driveways. Based on the footprints of the residences and driveways, appropriate, reasonable or sufficient recreational areas for "backyards" can be inferred. Additional impacts outside of those proposed within this application, are not anticipated due to a lack of area for residences, driveways or "backyard" space. NCDEQ-DWR Comment 1): Please provide a Jordan Lake Buffer Authorization from the local delegated municipality to document that impacts to the protected riparian buffer are in accordance with the approved local ordinances and that a diffuse flow plan has been accepted/approved. [15A NCAC 02B .0267(7)(b) Response to Request for Additional Information Witty Road November 22, 2016 Applicant Response: The applicant has submitted a request for Jordan Lake Buffer Authorization from Guilford County. Upon receipt of the Jordan Lake Buffer Authorization, the applicant will provide to the NCDEQ-DWR, for their records. Due to timing of the proposed project, the applicant requests that the NCDEQ-DWR issue the 401 WQC with a condition of the approval to be that a Jordan Lake Buffer Authorization be issued. NCDEQ-DWR Comment 5): Please be advised that deed notifications or other legal language that clearly indicates to future owners that there are jurisdictional features and that some lots may not be buildable as planned, or at all, without impacts that may not be approved by the regulatory agencies will be a condition of the 401 Water Quality Certification.
