Dear Mr. Mitchell:
The Division of Water Resources has reviewed your submit[al for a 401 Water Quality Certiflcation for the
aforementioned project. Review of your application revealed i[ lacking necessary information required for making
an informed permit decision. The permit application was deficient in the following areas:
No stream improvements to prevent stream over widening
No stream improvements to ensure aquatic passage
No permanent impacts in linear foo[age included for stream improvemen[s
Therefore, pursuant to I SA NCAC 2H .0507(a)(5), we will have to place the permit application on hold until we are
supplied the necessary information. You have 21 days to respond in wri[ing with the requested informa[ion or
notification to Ihis office tha[ the information is forthcoming. If, at the end of the 21 days, this offlce has no[
received this information in writing we will assume you are wi[hdrawing your application and it will be returned.
Furthermore, until the information is received by the NC Division of Water Resources, we request (by copy of this
letter) tha[ the US Army Corps of Engineers place Ihe permit applica[ion on hold.
