SUBJECT: Coastal Area Management Act (CAMA) Permit Application Submittal for
Charles and Carol Holden in Currituck County
Mr. & Mrs. Holden:
This letter is in response to the above referenced CAMA permit application, which was accepted
as complete by the Division's Elizabeth City office on October 7, 2016. Processing of the
application is ongoing. However, it has been determined that additional information will be
required prior to the Division taking final action on your application. These required items are
summarized below:
1) In accordance with 15A NCAC 07H.0208(a)(2)(B), it is the policy of this Division that,
prior to taking final action on a project of this nature, a Water Quality Certification for
the proposed development must first be approved by the Division of Water Resources
(DWR). Based upon the attached request for information from the DWR dated September
6, 2016, it appears as though additional information from the applicant will be required
before a final decision on issuance of a Water Quality Certification can be made.
Therefore, it is necessary that processing of your permit application be placed in
abeyance until such time as the required information is provided to the DWR, a Water
Quality Certification is issued for the project, and a copy of the approval supplied to this
office.
If you can provide to this office a copy of the requested information within five working days
from the date of this letter, DCM staff will continue processing of the application and the
processing clock will not be suspended. If the required information is not received in this office

with 15A NCAC 07J.0204(d) until such time as the requested information is provided.

OnOctober 2O, 2016, the Division of Water Resources (Division) received your application dated October .
13, 2016, requesting a 401 Water Quality Certification from the Division for the subject project. The
Division has determined that your application is incomplete'and cannot be processed. The application is
oh -hold until all of the following information is received:
1. Impact Justification (Avoidance and Minimization)
Please provide more details regarding avoidance and minimization of 0.05 acres of wetland
impacts associated with the construction of a retaining walla 115A NCAC 02H .0506(f) and (g)j. .
e : This should include alternative designs and layouts of the project area.
e This Office believes that the wetland impact labeled on the:plan as proposed 270 feet retaining
wall can be moved or reconfigured to avoid the impacts to. the 401/404 wetland, Please revise
the plans to avoid.the impacts or provide a detailed explanation of why this plan.for the activity
cannot be practically accomplished, reduced or reconfigured to avoid impacts to the 401/404
wetlands.
Pursuant to 15A NCAC 02H .0506 (6(f) and (g))l the applicant shall furnish all of the above requested
i information for the proper consideration of the application. If all of the requested information is not
received in writing within 30 calendar days of receipt of this letter, the Division will be unable to approve
the application and it will be returned. The return of this project will necessitate reapplication to the
Divisionfor approval, including a complete application package and the appropriate fee.
Please respond in writing within 30 calendar days of receipt of this letter by sending three copies of all of
the above requested information to the 4018t Buffer Permitting Unit,1617 Mail Service Center, Raleigh;:
