PROJECT SUMMARY: The applicant wishes to construct a seventeen-slip commercial marina on Camp Creek and is applying for a permit to do so. Field Investigation Report: Walker Marina Page 2 9. Narrative Description: Due to previous development, this proposal was determined by the DCM to be exempt from the requirements of the NC Environmental Policy Act. This proposal is a request to modify State Permit #59-05, issued on April 18, 2005 and set to expire on December 31, 2008. State Permit #59-05 was issued for excavation of this area. The property is located at 313 Midyette Street in Oriental on Camp Creek in Pamlico County. The 0.75-acre parcel currently has a 26' by 27' building in the southwest corner with a supporting gravel 3-space parking area adjacent to the east corner of the building. A 12' wide and 25' long gravel driveway runs along the northeastern property boundary and provides access from Midyette Street to the parking area and a residential building. This 24' by 41' single-family residence has an associated 14' by 16' shed, both of which are located in the southeastern corner of the property. The shoreline is stabilized with vinyl bulkhead and there are also six existing freestanding mooring pilings offshore. Both adjacent properties consist of commercial marinas. The elevation of the high ground of the parcel is +4' above normal water level. Vegetation on the tract mainly consists of upland lawn grasses and a few mature trees. There are no Section 404 Federal wetlands or coastal wetlands on the tract. There is 110' of shoreline on the property. Immediate offshore water depths range from -3.5' to -5.1' nwl. These depths are a result of excavation performed under State Permit #59-05. There used to be a fourteen-slip marina on the property that was removed as during the permitted excavation activity. Camp Creek is about 525' across at this location. It is a Permanent Secondary Nursery Area and there is no submerged aquatic vegetation present. The substrate is firm without shell. This area is closed to shellfish harvest and has a classification of SC waters. There is not a significant shellfish resource. There is not a Federal Channel in this area. The nearest adjacent docking facility is at about 30' away. 10. Proposed Development: The applicant wishes to construct a seventeen-slip commercial marina on Camp Creek. This proposal also involves expansion of the parking area to accommodate nine spaces, as well as the renovation of the existing upland structures on the property. The existing high ground 3-space gravel parking area will be expanded to a total of 9-spaces and will cover an additional 900 square feet area of high ground in the center of the parcel. Only one of the existing mooring pilings adjacent to the southwest property line will be removed as a result of this project. There is a proposed 4' wide and 80' long boardwalk immediately landward of the existing bulkhead. The fixed dock will begin at the bulkhead and will be 5' wide and extend 105' waterward of normal water level into Camp Creek. A fixed "T" platform will intersect at the terminus of the pier. It will be 6' wide and 95' long. There will be nine 4' by 20' associated fixed finger piers, and a total of twenty-six associated tie pilings to denote the seventeen new wet slips. The total combined area of the "T" and finger piers is 1,290 square feet along 110' of shoreline. These slips can accommodate 35'-45' vessels of various types. The outer tie pilings associated with the slips will within 15' of the adjacent riparian property lines. This new marina footprint will extend a 150' waterward of normal water level in a 525' wide body of water. 11. Anticipated Impacts: The marina will shade 1,815 square feet and incorporate a total of 12,000 square feet of shallow bottom public trust waters. The proposal will also impact an additional 1,220 square feet of high ground. The riparian corridor and project limits were set forth through State Permit #102-99 and subsequent appeal. This marina exceeds the 1/a width of the waterbody, but does not exceed the established pierhead line. The combined area of "T" and finger piers at this commercial marina exceeds a combined total area of four square feet per linear foot of shoreline. These waters are not Primary Nursery Area. There are no wetlands, shellfish, or submerged aquatic vegetation present. Overnight dockage and live-aboards will be allowed at this facility. The area between an existing mooring piling and the southwestern most finger pier supporting Slip #11 could allow for an additional docking slip. M atCl,'2008 The project is located in the Town of Oriental on the southwest shore of Camp Creek. It is the site of a previous marina and small boat yard with 14 wet slips. The old docks, a boat house and haul rail have been removed. The existing upland structures include a clubhouse, residential unit, gravel access and parking and a small shed. The project proposes to construct a floating pier and docks to accommodate 17 wet slips for sail and power vessels in the range of 35 feet. The existing upland structures will be refurbished and serve their existing function. The only new upland development proposed is an additional gravel parking area for 6 spaces. Under CAMA Permit #59-05, authorization was provided to construct a vinyl bulkhead and to dredge the marina area to a depth of -5 feet MLW. As completed, the control depths exceeded the permit depth and restoration was required. Restoration was completed and a fine was assessed and paid in full.
