Dear Mr. Jones:
On behalf of the East Yancey Water and Sewer District, we are providing you with
information relating to additional work to be performed in jurisdictional waters of the US in
conjunction with the above referenced project. The purpose of the work is to repair a leak in
a recently installed (currently not in service) sewer line under Little Crabtree Creek just east
of Ransom Silvers Road and south of the Micaville Loop. This project is still in the
construction phase, the contractor is still mobilized on site and the above referenced permit
remains valid. Therefore, it is our understanding that this work may be authorized under the
above referenced NWP-12 permit.
We have contacted both the NC WRC and USFWS about this situation and both have
indicated that the repair should proceed provided the work is performed in the dry, to the
extent practicably feasible, and all disturbed areas are appropriately and sufficiently returned
to pre -construction elevation and stabilized post construction. WRC indicated that the trout
moratorium at this location is January 1 to April 15 to protect Rainbow Trout and that the
work may proceed as indicated above.
Included with this letter is Sheet GA from the construction plans showing the Leak
Repair Area and general location. We anticipate the temporary impacts associated with this
activity will affect no more than 25 linear feet of Little Crabtree Creek. In addition to the
above stated environmental considerations, we understand that all permit conditions,
general, regional, and special, are still in effect for the activity described in this letter.
