PROJECT SUMMARY: The applicant proposes to expand an existing marina basin into highground with associated bulkhead, fixed piers, floating docks, launch ramps, a full-service dry-stack facility, marina buildings, parking lot, and stormwater detention ponds. PROJECT DESCRIPTION The project site is the existing Port Cape Fear Marina/Wilmington Marine Center facility, located adjacent to the Cape Fear River, at 3410 and 3610 River Road, in Wilmington, NC, in New Hanover County. The facility consists of an inland basin, measuring approximately 700' in length by 300' in width, and includes 79 wet slips, a travel hoist, and a boat rail system, with associated temporary dockage between the boat hoist and rail. The shoreline around this area is stabilized by stone riprap. The basin is connected to the Cape Fear River by an access channel, approximately 2,200'in length by 100'in width. The surrounding highground currently includes a service/repair building, office, parking, and a dedicated, and diked spoils disposal area. The property varies in elevation from 4' to 9' above mean sea level (MSL). The applicants maintains their existing CAMA Major Permit No. 128-98 for continued maintenance excavation of the marina basin, measuring 700' in length by 250' in width (5.74 acres) with a final project depth of -8' at mean low water (MLW), and entrance channel, measuring 2,220' in length by 100' in width with a final project depth of -8' at MLW. The applicant received a major modification to State Permit No. 128-98 to allow for the construction of a full-service, dry-stack marina facility with a harbormasters office and parking lot, fixed piers, finger piers, floating docks, boatlifts, wet slips, launch well, bulkhead, new dredging and a stormwater detention pond. Work authorized under this modification was primarily on and adjacent to the northern side of the existing access channel to the basin, which was authorized on May 19, 2008 and is due to expire on December 31, 2008. State Permit No. 128-98 authorizes a maximum of 115 boat slips at this location, which includes slips within the basin and the authorized slips located on the Cape Fear river. The application states that no work has taken place under this last modification due to uncertainty regarding the alignment of the planned "Skyline" bridge. Upland vegetation on the northern end of the existing marina facility consists of shrub type plants, wild grasses and Section 404 type vegetation such as Marsh Elder (Iva frutescens) and Grounsel-bush (Baccharus halimifolia). This tract exhibits coastal wetlands along the river consisting primarily of Giant Cordgrass (Spartina cynosuroides) and Smooth Cordgrass (Spartina alterniora). The 27.3 acre tract located adjacent to the south of the existing marina facility remains mostly undeveloped. The application states that a Port Cape Fear Associate member owns this tract. There is an existing building and associated parking area for a crane rental company. Upland area consists of forest vegetation, including: Live Oak, Laurel Oak, Magnolia, Pine, Maple, Cedar and Sweet Gum. Understory vegetation consists of Red Cedar, Wax Myrtle and Baccharus. Waterward of the highground and the interior portion of the property the vegetation transitions into Section 404 type wetlands. The application states that the northern half of the marina basin was delineated and approved under ACOE Action ID# 200500614 and the southern half of the marina basin, and within the currently proposed work, were reviewed and approved under ACOE Action ID# 200500614. The vegetation transitions into high marsh consisting of coastal and Section 404 type wetlands within the interior portion and shoreline of the property are Section 404 Jurisdictional wetlands including: Cattail (Typha sp.), Giant Cordgrass (Spartina cynosuroides), Wax Myrtle (Myrica cerifera L), Marsh Elder (Iva frutescens), Grounsel-bush (Baccharus halimifolia) and Common Reed (Phragmites australis) and Smooth Cordgrass (Spartina alterniora) (See page 6 of 17). The Cape Fear River is approximately 7,000 feet wide at the project site. It's waters are classified as "SC", by the NC Division of Water Quality. There are no shellfish resources in the project area. At the project site, the Cape Fear River is a designated Primary Nursery Area (PNA), but was determined as nonfunctional by the NC Division of Marine Fisheries. The highground portion of the project is classified as "Developed" by the Wilmington-New Hanover Land Use Plan. The CAMA Areas of Environmental Concern and any area located in the 100-year flood plain are classified as "Conservation". PROPOSED PROJECT: The applicants are requesting a major modification to their existing State Permit No. 128-98 to allow for expansion of the existing marina basin into highground with associated bulkhead, fixed piers, floating docks, launch ramps, a full-service dry-stack marina facility buildings, parking lot, and stormwater detention ponds. The application states that the expansion of the marina would incorporate the undeveloped southern portion of the property and also the adjacent property to the south, which is owned by a Port Cape Fear Associate member. The total area for expansion would be approximately 27.3 acres, which 4.3 acres would be included for the new upland basin portion of the project. The final project depth would be -8'@ MLW, which would combine into the existing basin's existing water depth. The application states that predicted dissolved oxygen (D.O.) for the new basin would meet the 5.0 mg/L standard based on the tidal amplitude in this area. Port Cape Fear Associates, dba Wilmington Marine Center Page 3 The application states that approximately 146,00 cubic yards of highground material would be removed and placed on a permanent spoil location with dimensions of approximately 37,589 sq. ft. located on the southern end of the project area. Another temporary disposal location would be approximately 2.3 acres in size, which would be for the initial excavation. The decanted water from the spoil would be returned to the existing basin and a silt curtain would be installed at the mouth of the basin, adjacent to the river during the process. The application states the capacity of the disposal areas would be maintained by selling the material as necessary and that a mining permit would be submitted. The application states that land-based equipment such as backhoes and bulldozers would be utilized for the work. The application also states that an earthen plug would remain at the interface of the existing basin and the newly expanded basin during excavation (See sheet 13 of 17). The application states that a new 2,067 linear foot bulkhead would be constructed to stabilize the newly excavated basin. The application also states that 0.396 acres of Section 404 wetlands would be impacted for the basin expansion and another 0.08 acres of Section 404 wetlands would be incorporated for the portion of the new bulkhead with its associated backfill and tie-back anchor systems, which would be located along the southern end of the new basin (See sheet 12 of 17). The application proposes to mitigate for the Section 404 impacts. The application states that the applicant is proposing to purchase 1.0 acre of wetland mitigation credit from the N.C. Ecosystem Enhancement Program (EEP). A new boat ramp would be installed within the southern end of the new basin, which would measure approximately 100' in length by 35' in width with a slope of 8:1. The application states that a 100' in length by approximately 6' in width floating dock would then be installed on the western side of the boatramp, which would be used as a transient dock (See sheets 12 of 17 and 15B of 17). The application states that the existing docking structures located on the southern end of the existing marina basin would be removed prior to construction and construction of new docking structures would accommodate an additional 137 vessels. A floating dock, measuring approximately 570' in length by approximately 6' in width would be installed along the waterward side of the new bulkhead located on the eastern side of the new basin. This floating dock would provide access to three of the proposed dock spines (Dock B, C and D). The fourth proposed dock spine (Dock A) would be located waterward of the existing marine service building (Building F) and existing bulkhead. An access ramp and floating dock, measuring approximately 90' in length by 6' in width would then lead onto a fuel dock, measuring 153' in length by 12' in width would be located along the new bulkhead located on the southern side of the new basin, adjacent to the new boatramp and transient dock. Between the fuel dock and the new bulkhead would be a 25' in length by 25' in width "open dock office". The fuel dock would then lead onto a new floating dock, measuring 710' in length by 6' in width would be installed along the waterward side of the new bulkhead located on the western side of the new basin. The application states that this would be a side-to dockage (See sheet 10 of 17). The following is a further description of the project and the proposed structures aforementioned (Sheet 11 of 17): 1. Dock A (Northern end of marina new basin): • 227' in length by 8' in width. • 10 finger piers (40'-75'in length by 5'-6' in width) five (5) oriented on each side of dock. • All finger piers would be 45'apart with mooring pilings between them. • One (1) T-head transient dock 148'in length by 8' in width located at the terminus of dock. • 22 slips total. 2. Dock B: • 348.5'in length by 8'in width. • 17 finger piers (35'-50'in length by 5' in width), eight (8) oriented on the southern side, nine (9) oriented on the northern side of dock with mooring pilings between them. • 8 (eight) finger piers would be 40'apart and 11 finger piers would be 30'apart. • One (1) T-head transient dock (118' in length by 9' in width) would be located at the terminus of pier. • 38 slips total. Dock C: • 297.5' in length by 8' in width. • 15 finger piers (35'-40'in length by 5'm width) eight (8) oriented on the southern side, and seven (7)finger piers oriented on the northern side of dock. • Eight (8) finger piers would be 45' apart, nine (9) finger piers would be 4 Papart and four (4) finger piers would be 30'apart with mooring pilings between them. • One (1) T-head transient dock (110 feet in length by 9 feet wide) would be located at the terminus of pier. • 34 slips total. 4. Dock D: • 169' in length by 8'in width. • Five (5) finger piers (35'in length by 5'-8' in width) of which, six (6) would be oriented on the northern side of dock with mooring pilings between them. • 12 finger piers would be 30' apart. • 16 slips total. A new dry stack facility (Building D), measuring 260' in length by 240' in width by 45' in height would be constructed on the southern end of the project area and would provide a storage capacity for 400 vessels. A dock master office (Building I) would also be constructed adjacent to the dry stack building, measuring 25' in length by 25' in width. A two-story clubhouse (Building G) would also be adjacent to the dry stack building, measuring 100' in length by 80' in width by 36' in height. A restroom area of 800 sq. ft. (Building H) would be included adjacent to the clubhouse. Located on the southern side of the dry stack facility would be an office building (Building E), measuring 160' in length by 70' in width by 30' in height. This building would be two-story with parking underneath. These proposed buildings and docks would have associated parking areas to accommodate approximately 235 vehicles including 2 handicapped parking spaces (See sheet 7 of 17). An above ground fuel tank, measuring 27' in length by 8.5' in width to serve the fuel dock, would be installed on the western side of the dry stack facility, outside the Coastal Shoreline 30'buffer area. Capacity of the tank would be approximately 10,000 gallons. The applicant proposes the construction of a stormwater detention pond to be located between the proposed dry stack facility and the permanent spoil disposal area. The pond would be on the landward side of the marsh located on the western side of the project area. Another pond (aesthetic pond) would be constructed on the waterward side of the proposed clubhouse. A 416 linear feet keystone retaining wall would stabilize the eastern side of the pond adjacent to the dry stack building and another 514 linear feet keystone retaining wall would be constructed on the eastern side of the dry stack building (See sheet 7 of 17). The application states that three (3) access walkways would be constructed and elevated over the coastal and Section 404 type wetlands area between the newly created marina basin and the clubhouse building. Two (2) of the walkways would lead onto an access walkway located on the landward side of the new bulkhead of the basin. One of these walkways would lead onto an uncovered platform over highground, just before leading onto the 6' wide access walkway around the basin. The third and shortest walkway would connect to the dock master building. The application also states that a gazebo would be constructed adjacent to the 6' access walkway, which would be located on the southern side of the existing entrance channel. The gazebo would be located entirely on highground outside the 30' coastal shoreline buffer (See sheet 7 of 17). The application states that new buildings would also be proposed around the existing marina facility. A marine service building (Building C) would be located adjacent to the existing launch well, with a total area of 5,025 sq. ft., which would be 26' in height. A two-story office/retail building (Building A) would be located on the northern side of the access channel to existing marina basin. This building would replace the previously authorized dry stack building and launch well under State Permit No. 128-98. This building would have an associated parking area with approximately 80 parking spaces and restroom facility (Building B) with an area of 600 sq. ft. The application states that the existing municipal water and sewage system would be utilized for multiple connections. Port Cape Fear Associates, dba Wilmington Marine Center Page 5 10. ANTICIPATED IMPACTS The proposed new basin expansion with bulkhead and associated backfill would disturb approximately 4.3 acres of an upland area, which would incorporate approximately 0.476 acres (20,735 sq. ft.) of Section 404 wetlands. Approximately 146,000 cubic yards of highground material would be removed and placed on a designated highground area on the project site, in an area of approximately 37,589 sq. ft. The proposed highground buildings with associated concrete and asphalt areas would create 347,017 sq. ft. of impervious area (7.96 acres), which would be 29% of the entire tract. The new basin would create 166,108 sq. ft. (3.8 acres) of new AEC. Of that new AEC area approximately 84,359 sq. ft. would be impervious coverage for parking and access off River Road. The application states that the proposed impervious area within the new 75' Estuarine Shoreline AEC would be 51%, which the expansion would require installation of an engineered, high density stormwater management system. The proposed marina basin facility would create an additional 137 boat slips that would provide boating access to the Cape Fear River. The proposed floating structures and boatramp for the basin would incorporate approximately 35,917 sq. ft. of newly created Estuarine Waters and Public Trust Area. The three proposed access boardwalks would shade approximately 4,980 sq. ft. of Section 404 wetlands. There would be increased turbidity levels during project activity, however, if timed to avoid periods of peak biological activity, no long-term adverse impacts are anticipated. The applicant has submitted an application for a stormwater permit through the N.C. Division of Water Quality on 12/27/07. The application states that a State Stormwater Permit to the N.C. Division of Water Quality was submitted on 12/27/07, and also states that a Sedimentation and Erosion Control Plan for the proposed upland development has been submitted. A Section 404 wetlands delineation has been completed for both tracts and was approved by the USACOE (Action ID# 200300556 and # 200500614). Aforementioned, the application states that a mining permit would be submitted for the disposal of the excavated material offsite. Submitted by: Robb L. Mairs Date: 6/17/08 Office: Wilmington Request for Major Modification of CAMA Permit #128-98 Wilmington Marine Center, Wilmington, NC Project Narrative 4/9/2008 l APR , ? 20®8 ®ctL1 f ?eql Development History/Previous CAMA Permitting ' C- In 1987 Port Cape Fear Associates purchased 16.65 acres between River Road and the Cape Fear River within the City of Wilmington. The property is located south of the state port, in an area that has been historically used for marine and industrial services. In 1992, the property was developed as Wilmington Marine Center with the purpose of providing hurricane safe dockage and marine services for large power yachts. An approximately 5,74-acre upland basin marina was constructed with a dredged entrance channel in the river and a final basin depth of -8' MLW. Several associated marine-service businesses leased sites around the marina and began providing services including a haul out marine rail and service yard. Upland development covered approximately 11.4-acres and the remaining acreage was undeveloped forest. Shoreline along the marina basin and entrance channel was stabilized with a mix of concrete sheet pile, rip rap, and natural stabilization. Several modifications to the original CAMA permit allowed for work such as continued shoreline stabilizations and the addition of slips within the basin (see list of permit actions provided below). In 2005, the upland basin marina contained approximately 79 large, wet slips. At that time the need for smaller (30') boats was identified, and a major modification to the CAMA permit was requested. The modification was granted and allowed for the addition of 58 open water slips ("River Slips"), dry stack storage on the northern side of the property, associated parking, and a boat lift/drop zone. The 2005 modification remains valid until December 31, 2008. None of the work authorized under that modification has been constructed due to uncertainty regarding the alignment of the planned "skyline" bridge. It is notable that Wilmington Marine Center was the first marina in NC to receive a Clean Marina designation and strives to maintain good marina practices and provide environmental protection. The property is located entirely within the City of Wilmington. The northern half of the property is zoned "Commercial Services" and the southern portion of the property is zoned "Industrial". The CAMA Land Use Classification is Urban, with wetlands being classified Conservation. Adjacent land uses are industrial with National Gypsum (a sheet rock producer) being the adjacent riparian landowner to the north and the City of Wilmington Wastewater Treatment Plant being the adjacent riparian landowner to the south. v Currently requested Maior Modification: 0 Port Cape Fear Associates currently requests authorization to expand the marine center and 71 I-E marina basin to the south of the existing development. Expansion would utilize the previouslyXn- developed forested area and would incorporate an adjacent parcel to the south for a total site iea of 27.3-ac. The parcel to the south is owned by a Port Cape Fear Associate member, and Z although it has not been previously developed, it is currently utilized by a crane rental business-4 (Parcels R06400-001-001-000 and R07000-002-004-000 comprise the total site area). .Z Specifically, the applicant proposes to: (1) Expand the upland basin marina by 4.3-acres to a depth of -8' MLW for a total basin size of 10.04-acres. (2) Remove existing slips at the southern end of the existing basin and add 137 new slips ranging in size from 25' to 75' and available for lease. (3) Construct 2,067-Ift of new bulkhead to stabilize the expanded basin. (4) Construct a temporary boat ramp on the southern edge of the expanded basin with an associated 100-Ift transient dock. (5) Provide a 153-Ift fuel dock and additional fuel service. (6) Construct a dry stack storage building with 400 dry slips. (7) Construct associated parking (8) Construct 2 retail/office buildings, 1 marine service building, a clubhouse, and a dockmaster's office. (9) Create a permanent diked spoil disposal area on the southern expansion boundary for both initial and maintenance disposal capacity. (10) Provide utility services. (11) Install stormwater management and erosion control features. Existing features: (1) Existing slips in the northern half of the basin will remain (57 slips). (2) Existing shoreline stabilization including rip rap and sheet pile on northern portions of the existing basin (where expansion is not planned) will remain. (3) The existing drop zones, rails, and maintenance services will remain. (4) One existing marine service building will remain (Bldg F). (5) Existing parking and impervious surfaces will remain, with improvements as required under a state-approved stormwater management plan and city planning requirements. (6) Renewal of authorization to construct the previously-approved open water slips (currently not constructed) is requested. (7) A maintenance dredging clause for the existing basin and entrance channel is also requested. Environmental standards: A 30' Coastal Shoreline buffer would be observed around the new basin, per NC CAMA standards, and no new impervious cover would be placed in the created buffer. Excavation of the new basin area would impact 0.476-acre of non-marsh, riparian wetland. The wetland impact is thought to be necessary to create an open basin design that would not "bottleneck" flow or reduce flushing. The wetland area to be impacted has apparently received stormwater run-off from River Road for several years (through a stormwater pipe and easement) and may be partially created or expanded from that discharge. A 20' impact zone behind the basin bulkhead is included in the impact total for bulkhead installation and maintenance. There are no suitable areas for wetland restoration on site. V M 0 rn o o rn cc a 1% C I Therefore, the ability to purchase 1.0-acre of wetland mitigation credit from the NC Ecosyst Enhancement Program has been requested. Land Management Group sampled ambient water quality parameters in the Cape Fear River and along this shoreline monthly from May 2006 to September 2006. Ambient data was utilized to run the NC Division of Water Quality's dissolved oxygen model. Results predict that dissolved oxygen levels in the expanded basin would met the 5.0 mg/L standard over a wide range of sediment oxygen demand and ambient dissolved oxygen values, The average tidal range of 4.28' is expected to maintain good flushing in the basin. Construction Methods and Seauencina: Expansion of the basin will be done with land-based equipment such as back hoes and bulldozers. An earthen plug will remain at the interface of the existing basin and expansion area during excavation. Spoil material will be placed in a diked, temporary spoil disposal area in the location of the future dry stack building. Decanted water from the spoil will be returned to the existing basin and a silt curtain will be placed at the mouth of the basin (at the river) during work. Dry spoil material will remain stored in both the temporary and permanent on-site spoil disposal areas. Capacity in the disposal areas will be maintained by selling the material as necessary. Excavation of the permanent spoil disposal area and installation of all stormwater management features will be completed first. Expansion of the basin and installation of the new wet slips, temporary boat ramp, and fuel services would then be completed. Once the basin is complete and all spoil material has been removed from the site, the temporary spoil disposal area will be developed as the dry stack storage and associated buildings. The permanent spoil disposal area will remain available for future maintenance dredging events. Wetland and Coastal Marsh Delineations: Jurisdictional "404 wetlands" shown on the plans in this application have been delineated by Land Management Group and field-reviewed by the US Army Corps of Engineers. Wetlands on the northern half of the marina basin were delineated and approved under ACOE Action ID # 200300556.
