Enclosed is a NWP 29 Application for your review. It is submitted on behalf of LCD Acquisitions, LLC
to construct the Retreat at Greenville, a multi -family development located off of S. Charles
Boulevard in Greenville, NC (Pitt County). Impacts to 0.031 acre of Waters of the US are needed
for the construction of a stormwater pond and to provide access to an adjacent site. Initial
conversations with City of Greenville officials instructed the applicant to plan for this access way.
However, the crossing would only be constructed if it becomes a requirement of the City of
Greenville. Because impacts are so small and are to Waters of the US, no mitigation is proposed.
Enclosed are the PCN form, site maps and the site plan. Please let me know if you have any
questions or need additional information in order to issue the NWP 29. Thank you for your

The site is mostly in agricultural use. There are some forested areas along the stream to the south. Adjacent land use is
agricultural, commercial development, or residential.

The purpose of the proposed project is to develop multi-family residential housing within the site that will serve a growing
Greenville population.
3e. Describe the overall project in detail, including the type of equipment to be used:
This project includes the development of 188 multi-family units, clubhouse, parking, stormwater facilities, and access
ways. A total of 0.031 acre of Waters of the US impact is needed. One impact is needed for the construction of a
stormwater pond. The other impact is needed to provide access to an adjacent site and would only be constructed if
required by the City of Greenville. Initial conversations with City officials requested the access easement and the
developers would like to prepare for this crossing, if it becomes a requirement of the City. Site will be cleared and graded.
Stormwater facilities will be installed and roads/utilities will be constructed. Then building construction will occur. Track
hoe, loader, dump truck, bob cat, and other standard construction equipment will be used.

Impacts were minimized by careful site design. No stream or riparian buffer impacts will occur. The only impacts needed
are to jurisdictional Waters of the US. One impact is needed for the construction of a stormwater pond. This ditch extends
up into the site and cannot be avoided. A section of the ditch will be excavated and will become a part of the stormwater
pond. The other impact is needed to provide access to an adjacent site and would only be constructed if required by the
City of Greenville. Initial conversations with City officials requested the access easement and the developers would like to
prepare for this crossing, if it becomes a requirement of the City.

Silt fencing will be used during construction to reduce sediment from eroding into the jurisdictional areas.

The NC Natural Heritage Program GIS layer was used to determine the presence of federally listed species. No rare
species are known to occur within the site. One rare animal species, the coppery emerald dragonfly, has been observed
within a one -mile radius of the site but has not been observed since 2004 and this occurrence has a low accuracy. No
impacts to federally -protected species are anticipated from this project.

The Division of Water Resources has determined that the streams listed above and included on the attached map
have been located on the most recent published NRCS Soil Survey of PITT County, North Carolina and/or the most
recent copy of the USGS Topographic map at a 1:24,000 scale and evaluated for applicability to the Tar -Pamlico River
Riparian Buffer Rule. Each stream that is checked "Not Subject" has been determined to not be at least intermittent
or not present on the property. Streams that are checked "Subject" have been located on the property and possess
characteristics that qualify them to be at least intermittent streams. There may be other streams or features located
on the property that do not appear on the maps referenced above but may be considered jurisdictional according
to the US Army Corps of Engineers and subject to the Clean Water Act.
This on-site determination shall expire five (5) years from the date of this letter. Landowners or affected parties
that dispute a determination made by the DWR may request a determination by the Director. An appeal request
must be made within sixty (60) calendar days of date of this letter to the Director in writing.
