JAY ZIMMERMAN Director Mr. Daniel Ingram DWQ Project #: 2011-0720 v4 Environmental Banc & Exchange, LLC Person County 302 Jefferson Street, Suite 110 Raleigh, NC 27605 Re: Upper Neuse River Basin Umbrella Mitigation Banking Instrument (LIMBI) REVISED Hatley (Phase I) Bank Parcel Credit Release — Task 8 Dear Mr. Ingram: On October 17, 2016, the Division of Water Resources (DWR) received a Year 4 Monitoring Report for the subject site from Environmental Banc & Exchange, LLC (EBX). Overall, site conditions appear to look good and vegetation data results show stem densities higher than the required 320 stems/acre throughout most of the site. Replanting of the area in and around Plot 3 occurred in April 2016. Stem measurements recorded in Plot 3, show heights very similar to stems in other plots that are four years old. Additionally, no encroachment within the easement boundaries was noted in the report. On November 9, 2016, DWR issued an incorrect credit release letter. This credit release is being revised to release 5% of the credits instead of 10% and replaces the letter dated November 9, 2016. According to the UMBI signed on February 10, 2012, the following Project Milestones have been met, and the corresponding credits shall be released: Task/Milestones 8) Year 4 Monitoring Report approved by DWR Credit 5% By copy of this correspondence, DWR confirms that you have satisfied the above requirements for the above -referenced tract and 5% of your Neuse riparian buffer credits (0.05 x 310,838 ft2 = 15,541.9 ft2) are now available for sale. Additionally, 5% of your nitrogen nutrient offset credits (0.05 x 16,774.88 lb -N = 838.74 lb -N) and 5% of your phosphorous nutrient offset credits (0.05x 1,080.43 lb -P = 54.02 lb -P) are now available for sale. Please update the credit ledgers accordingly. Please note that nutrient offset credits generated at this site must be used for impacts in HUC 03020201 of the Neuse River Basin which includes only the Upper and Lower Falls Watersheds as defined in 15A NCAC 02B.0276.
