PROJECT SUMMARY: The applicant proposes to construct a gravel walkway with associated § 404 Wetlands impact and a private docking facility into Myrtle Grove Sound. Peter Donat Page 2 9. PROJECT DESCRIPTION: The applicant's property is located at 1525 Salty Bay Landing in New Hanover County, adjacent to the AIWW and Myrtle Grove Sound. To find the property one would travel south from Wilmington on South College Road (NC 132) to the intersection of South College, Carolina Beach Road (NC 421) and Piner Road. This intersection is known locally as Monkey Junction. Turn left onto Piner Road and travel approximately 1 mile east until you reach Myrtle Grove Road. Turn right onto Myrtle Grove Road and travel south for approximately 1.65 miles until you reach Salty Bay Landing, which will be on the left. Turn onto Salty Bay Landing and continue down the unimproved road until your reach the property of interest on the left. The property is a residential lot approximately 1.0 acres and has an average elevation of approximately 8' above normal high water (NHW). Outside of an existing gravel driveway and small timber shed, there are no existing structures on the applicant's property. Highground vegetation consists of hardwoods and other woody species including: Oak, Pines, Cedar and Dogwood. Vegetation bordering the eastern highground area of the property supports §404 and coastal wetlands vegetation including: Wax Myrtle (Myrica cerifera L.), Marsh -elder (Iva frutescens), Grounsel-bush (Baccharis halimifolia), Sea Oxeye (Borrichia frutescensj, Salt Meadow Grass (Spartina patens) and Black Needlerush (Juncus roemarianus). The coastal wetlands transition to an area consisting primarily of Smooth Cordgrass (Spartina alterniflora) in an area approximately 380' in width. It appears through the provided survey that the U.S. Army Corps of Engineers (USACE) has delineated the existing §404 wetlands on-site. The N.C. Division of Coastal Management (NCDCM) flagged the coastal wetlands boundary on January 19, 2016 (see Sheet 3 of 3). The property has approximately 1 00'of frontage along the AIWW and Myrtle Grove Sound, which the application states this section of the waterbody measures approximately 1,400' across. Waterward of the applicant's property is a natural channel, measuring approximately 200' in width within Myrtle Grove Sound between the open water area and the AIWW channel. There is an existing private pier located to the north of the applicant's property along the same shoreline, which is located to the edge of this natural channel. There is a community marina basin and access channel to the AIWW to the south of the applicant's property (The Tides HOA), which this natural channel connects to the access channel of this marina basin. The current joint City of Wilmington and New Hanover County Land Use Plan classifies the adjacent waters as Conservation, and the adjacent high ground portion of the project area as Resource Protection. In the project area, the waters of Myrtle Grove Sound are classified as SA-ORW by the NC Division of Water Resources, and they are CLOSED to the harvest of shellfish. These waters are designated as a Primary Nursery Area (PNA), by the NC Division of Marine Fisheries. PROPOSED PROJECT: The applicant proposes to construct a gravel walkway with associated §404 Wetlands impact and a private docking facility into Myrtle Grove Sound. The application states a gravel walkway, measuring approximately 200' in length by 9' in width would be constructed along the most northern end of the property, which would be within jurisdictional §404 wetlands. The application states the walkway would be to help facilitate the construction of the access pier to the proposed docking facility and to reduce the cost of construction. Once the gravel walkway reaches the upper limits of coastal wetlands, a fixed pier, measuring approximately 810' in length by 6' in width would extend towards the east into Myrtle Grove Sound. The pier would then terminate onto a fixed platform, measuring approximately 12' in length by 12' width, creating a 7 -head" configuration. An access ramp would then lead onto a floating dock, measuring approximately 40' in length by 9' in width, which would run in the same alignment as the access pier. Based on the survey, the floating dock would be located at the edge of the natural channel within the -2.0' normal low water (NLW) contour. The applicant states that the proposed docking facility would provide mooring for up to four (4) vessels. As proposed and per the riparian survey, the proposed docking facility would be located within the established pier length to the north, within the applicant's area of riparian access, would not encroach into the adjacent 15' riparian corridor setback area requirement, nor the natural channel. The application states the proposed docking facility would not exceed the current 114 distance rule and would be approximately 615' from the near edge of the 80' setback from the AIWW. The application did not include proposed upland development plans for this property; however, the provided survey depicts a proposed dwelling footprint, measuring approximately 60'x 70'(4,200 sq. ft.), which would be approximately 15% impervious area within the 575' Area of Environmental Concern (AEC) and would be located landward of the Coastal Shoreline 30' Buffer. ANTICIPATED IMPACTS: The proposed gravel walkway would result in the impact of approximately 1,800 sq. ft. of § 404 wetlands (0.04 acres), which would be located between the highground and the access pier. The application states the walkway would be to help facilitate the construction of the access pier to the proposed docking facility and to reduce the cost of construction. The proposed access pier would shade approximately 2,940 sq. ft. of coastal wetlands would incorporate approximately 2,154 sq. ft. of Public Trust Area and Estuarine Waters. As proposed, the applicant's proposal would not encroach into the 80' federal setback requirement from the. AIWW channel. Based on the provided riparian survey, the proposed structures would not encroach into the adjacent 15' riparian corridor setback area requirement. The proposed structures would allow the facility to accommodate up to four (4) vessels in water depths of approximately -2.0' @ NLW. The proposed structures would extend approximately 340' into a waterbody, which measures approximately 1,400' across. Based on the survey, the floating dock would be located to the edge of the natural channel at the -2.0' normal low water (NLW) contour. As proposed, the docking facility appears to not exceed the 1/4 width rule and the established pier length, aforementioned.
