On October 27, 2016, the Division of Water Resources — Water Quality Programs (Division) received your
application requesting a 401 Water Quality Certification from the Division for your project. The Division
has determined that your application is incomplete and cannot be processed. The application is on -hold
until all of the following information is received:
1. Upon consultation with the US Army Corps of Engineers (USACE), it has been determined that
you should resubmit this project as a request for authorization for a stream restoration under a
Nationwide Permit #27. Please submit a complete application including a detailed natural
channel design, construction drawings and proposed monitoring plan for the site.
Pursuant to Title 15A NCAC 02H .0502(e), the applicant shall furnish all of the above requested
information for the proper consideration of the application. If all of the requested information is not
received in writing within 30 calendar days of receipt of this letter, the Division will be unable to approve
the application and it will be returned. The return of this project will necessitate reapplication to the
Division for approval, including a complete application package and the appropriate fee.
Please respond in writing within 30 calendar days of receipt of this letter by sending one copy of all of the
above requested information to the me at the address below.
Please also be aware that the Notice of Violation # NOV-2016-OP-0007 issued to you by this Division on
October 11, 2016 will remain unresolved while you are pursuing a 401 Water Quality Certification. Any
additional work conducted within waters of the state prior to receipt of a 401 Water Quality Certification
may be considered as a continuing, or as an additional, violation of North Carolina General Statutes and
Administrative Code.
