We are also requesting a 401 WQC from NCDWR for the above referenced impacts. The project is ±16.41 acres in size and is located at 2421 High House Road in Cary,Wake County (Latitude: 35.787701°N; Longitude:-78.867156°W). The project is located in the Cape Fear River basin (Jordan Lake watershed) and onsite waters drain to White Oak Creek. The Water Quality Classification for White Oak Creek is WS-V; NSW and the Stream Index Number is: 16-41-6-(0.3). The cataloging unit for the site is 03030002. Proposed Project The proposed project consists of construction of a 25-lot residential subdivision,with associated infrastructure (roadways, water/sewer utilities, stormwater management controls) to meet the increased housing demand in the Town of Cary, NC. Project History Onsite wetlands were delineated by WithersRavenel in May 2014. An Approved Jurisdictional Determination was issued by David Shaeffer with the USACE on October 30, 2015 (SAW-2014- 01045). A copy of the issued JD has been provided as an Appendix with this submittal. The Town of Cary issued a stream buffer determination letter for the site on July 10, 2014 (TCRB 14-013). Proposed Impacts The proposed impacts consist of 105 If of permanent stream impact,and 92 If of temporary stream impact,and 0.015 acres of temporary wetland impacts. The proposed 105 If of permanent stream impacts will occur from culvert installation and construction of a road crossing(Impact A: 100 If), and installation of a riprap dissipater pad below the culvert (Impact B: 5 If). The riprap dissipater pad is a requirement by the NC Division of Land Quality as a sediment and erosion control measure,and has been designed so that the riprap stone will be buried with the top of the riprap matching the pre-construction elevation of the stream bed. This design allows for the portion of the stream lined with riprap to continue functioning as a natural stream by maintaining natural water depths and allowing for passage of aquatic life,and therefore there is no functional loss. The proposed 68 If(Impact C)and 24 If(Impact D)of temporary stream impacts will occurfrom the installation of a sewer utility line using conventional trench and backfill methods. Following installation, the temporary impacts will be restored to the original contours and elevations, and temporary stabilization will be provided by seeding until natural recruitment permanently stabilizes the area. The proposed 0.015 acres of temporary wetland impact(Impact D)will occur from installation of a sewer utility line. A 20'maintenance corridor will be maintained/mowed in perpetuity, resulting in 0.015 acres of permanent conversion impacts as a result of conversion from forested wetlands to herbaceous wetlands. Avoidance and Minimization Prior to site plan design,the applicant requested that a detailed wetland delineation be conducted so that impacts to wetlands and waters could be minimized. Proposed permanent impacts have been minimized to only those impacts necessary to construct a road to access developable uplands,and conversion of a forested wetland to an herbaceous wetland within the 20-foot maintenance corridor of a proposed sewer line. Due to property boundary constraints,alternative access to the developable uplands is not available. The proposed road crossing of Stream 2(Impact A,depicted on Map A) requires installation of 100 linear feet of 60-inch culvert piping, and has been designed to cross Stream 2 at a perpendicular angle. In addition, the proposed road extends east,following existing site topography as much as possible,and minimizing the extent of required stabilization fill slopes for the crossing. The dissipater pad at the base of the proposed culvert (Impact B,depicted on Map A) is required to reduce outflow from the culvert to non-erosive velocities. The riprap dissipater has been designed for the stone to be installed such that the top of the riprap matches the pre-construction elevation of the stream bed. This design allows for the temporarily impacted stream areas to continue functioning as a natural stream by maintaining natural water depths and allowing for passage of aquatic life. The proposed gravity sewer line has been designed to provide service throughout the project,and has been aligned to match and connect with an existing, off-site manhole to the south, while minimizing impacts to on-site resources and maintaining required gradient. The proposed sewer line crosses Stream 2 (impact C,depicted on Map B) at a perpendicular angle near the southern property boundary. This crossing is required in order to access an existing manhole off-site to the south. Impact C is temporary, and will be restored to natural contour and elevation,and stabilized with vegetation. The proposed sewer line crosses Stream 1(Impact D,depicted on Map C) at a perpendicular angle, and is required in order to provide sewer availability to the developable uplands. This utility has been aligned to match natural topography,with inflections at the adjacent manholes to provide a perpendicular crossing. This impact is temporary, and will be restored to natural contour and elevation,and stabilized with vegetation. The proposed sewer line crosses Wetland D (Impact E, depicted on Map D) near the eastern boundary. This crossing has been aligned to match natural topography and crosses the wetland at a perpendicular angle. This impact is temporary, and will be restored to natural contour and elevation, and stabilized with vegetation. Following stabilization, this crossing will be part of the proposed maintenance corridor for the utility,and as such will be mowed/maintained in perpetuity. Nofill is required forthe maintenance corridor,thereby avoiding permanent impact atthiscrossing. Please note,the proposed sewer line crosses Stream 2 near the area of Impacts A and B; however, this crossing is an aerial line and there are no stream impacts associated with this crossing. Details of the aerial line are shown on the map labeled`Aerial Sewer Stream Crossing'. Mitigation The permanent stream impacts associated with the road crossing have been minimized to 105 linear feet for Impacts A and B. Temporary impacts for the proposed sewer utility have been minimized and will be restored following construction. As a result of the permanent stream impacts being less than 150 linear feet,and other impacts being temporary,no mitigation is proposed. Impact D will result in 0.015 acres of temporary wetland impacts for construction of the sewer line. The perpetual mowing/maintenance of the 20' easement within the wetlands will result in 0.015 acres of permanent wetland conversion impacts as a result of the permanent conversion from forested wetland to herbaceous wetland. Since the total permanent conversion impacts are less than 0.10 acres,no mitigation is proposed. Stormwater Management Plan The stormwater management plan consists of a combination of wet retention ponds,constructed wetlands, and grassed swales designed for 90% TSS removal. The stormwater management plan has been reviewed by the Town of Cary, and will receive final approval upon issuance of the 404/401 authorization. Potential habitat for the northern Long-eared bat(NLEB) is listed as mature forest with trees over 3"dbh,which is used for roosting during the day. The proposed project area contains forested areas with trees over 3" DBH, and therefore is considered potential northern long eared bat habitat. The USFWS Final 4(d) rule for the Northern Long-Eared bat specifies that tree removal within the White Nose Syndrome (WNS)Zone is not prohibited as long as it occurs more than 0.25 miles from known hibernacula and does not result in destroying known occupied maternity roost trees, or any other trees within a 150 ft-radius from the maternity tree, during the pup season (June 1 —July 31). The proposed project is not located within 0.25 miles of any known hibernacula, nor is there any known maternity roost trees present on the project. Additionally, clearing of mature forest between June 1St and July 31St is not anticipated for construction of the proposed project. Therefore, WR concludes that the project"may affect, but is not likely to adversely affect"the northern long- eared bat. 6.
