Widen to Multi-lanes. Dear Mr. Steffens and Mr. Ward, SEPI Engineering and Construction and NCDOT are pleased to submit this preliminary ]D request for your review. Included in the packet are the following items: 1) Project Description 2) Jurisdictional Features Summary 3) Buffer Summary 4) GIS figures including: vicinity, aerial imagery, USDA soil survey, USGS topographic mapping, and LiDAR 5) Preliminary Jurisdiction Determination Form 6) Inventory Delineation Tables 7) USACE Wetland Determination Data forms 8) NCDWR's Stream Identification Forms 9) USGS topographic quadrangle 10) USDA Soil survey maps 11) Site Photos Project Description NCDOT Proposes to widen SR 1203 (Allen Road) from SR 1467 (Stantonsburg Road) to US 13 (Dickenson Avenue Ext.) to multilanes. SR 1203 is located in Pitt County, Greenville, NC (Figure 1). The project area consists of approximately 88 acres (Figure 2). ]urisdictional Features A delineation of jurisdictional features conducted by SEPI on August 24, 2016 identified two potential jurisdictional wetland areas (WA and WB), two perennial streams (SC and SE), three intermittent streams (SA, SB and SD), two potential jurisdictional non-RPW tributaries (SB and SF) and one potential jurisdictional open water (Pond PA). The potential jurisdictional features are shown over aerial imagery, soil survey data and LiDAR imagery in Figures 3 through 5. Photos 1-14 show the potential jurisdictional features. Tar-Pamlico Buffers Intermittent and perennial streams shown on either USGS topographic quadrangles or USDA soil survey maps are subject to buffers. The included inventory tables indicate which stream features are present on the USGS and USDA maps. The USGS (Figure 2) and USDA maps (Figure 6) are included with this package. 5030 IVew Centre !?rive Suite B Wilrningtan, NC 8403 Phone: 91d.523.5715 Fax: 910.523.5716 seprengineerirg.com [ SEPlengineers SEPI PROJECT SUMMARY Project Name TIP U-5875 Project Type Convert Road to Multi-lanes Owner / Applicant NCDOT; Attn: John Rouse County Pitt Nearest Town Greenville Waterbody Name Greens Mill Run Index Number 28-96 Class C; NSW River Basin Tar-Pamlico USGS Cataloging Unit 03020103 We appreciate the opportunity to work with you. The Carps of Engineers believes that there may be jurisdictional waters of ihe United States on the sulaject site, and the permit applicant or other afFected party wha requested this preliminary JD is hereby advised of his or her option to rec#uest and obtain an approved jurisdictional determination (JDj for that site. Nevertheless, the permit app(icant or other person who requested this preliminary JD has declined ta exercise the option to obtain an approved JD in this instance and at this time. 2. In any circumstance where a perrnit applicant obtains an individuai permit, ar a Nationwide General Permit {NWP) ar other general permit verification requiring "pre-construction notificatiort" (PCNy, or requests verification for a non-reporting NWP or otFer general permit, and the permit applicant has not requested an appraved JD for the activity, the permit applicant is hereby made aware of the following: (1) the permit applicant has elected to seek a permit authorization based on a preliminary JD, which does nat make an official determination of jurisdictional waters; (2) that the applicant has the option to request an approved JD before accepting the terms and conditions of the permit authorization, and that basing a permit authoriza#ion on an approved JD could possibly result in less compensatory mitigation being required or different special conditions; (3) that the applicant has the right to request an individual permit rather than accepting the terms and conditions of the NWP or other general permit authorization; {4} tha# the appficant can accept a permit authorizatiar and thereby agree to comply with all the terms and conditions ofi that permit, including whatever mitigation requirements the Corps has determined to be necessary; (5} that undertaking any activity in reliance upan the subject permit authorizatian without requesting an approveci JD constitutes tte applicant's acceptance of the use of the preliminary JD, but that either form of JD will be processed as soon as is prac#icable; (6) accep#ing a permit authorization (e.g., signing a proffered individual permit) or undertaking any activity in reliance on any form of Corps permit authorization based on a preiiminary JD constitutes agreement that all wetland and other water bodies on the site affected in any way by that ac#ivity are jurisdictional waters of the United States, and precludes any chalienge to sueh jurisdiction in any administrative or judicial compliance ar eRforcement action, ar in any administrative appeal or in any Federal court; and {7) whether the applicant elects to use either an approved JD or a prelimirtary JD, that JD will be processed as soon as is practicable. Further, an approved JD, a proffered individual permi# (and all #erms and conditions contained therein), or individual permit denial can be administratively appealed pursuant to 33 C.F.R. Part 331, and that in any administrative appeal, jurisdictional issues can be raised (see 33 C.F.R. 331.5(a)(2)j. If, durirg that administrative appeal, it becomes necessary to make an official determination whether CWA jurisdiction exists over a site, or to provide an official clelineation af jurisdictional watsrs on the site, the Corps will provide an appraved JD to accomplish tMat result, as soon as is practicable. 3 This preliminary JD finds that there "may 6e" waters of the United States on the subject projeck site, and identifies all auatic features on the site that cauld be affected by #he praposed activity, based on #he fallawing information: IMPQRTAIT NOTE: The information recorded on this form has not necessarilv been erified bv the Corps and should not be relied upon fvr later jurisdictional determinations.
