Dear Mr. Johnson,
A Request for Information letter from the DWQ was received by Mr. Todd Black,
Owner/Developer on June 3, 2008 outlining six (a-f) minor items in need of response. This
letter was based on a site visit with Alan Johnson from the DWQ and Anna Salzberg from
ClearWater Environmental Consultants, Inc. (CEC) at the Broad River Highlands project in
Cleveland County (Figures 1-2). This letter addresses all items, which are included in detail
below. Please see revised Figures 4.1-4.4 (1 : 200 scale) and Detail Sheets A-C (1 : 50 scale)
for plan representation of all changes made according to the Request for Information letters
and site visit. These plans have been sent to both the DWQ Raleigh office and Mooresville
office.
a) Impact #1: The proposed road that runs adjacent to this stream is shown
improperly on the site diagram. This should be corrected and a copy provided to
DWQ. The road is shown impacting the stream channel.
The road was shown incorrectly on this original site plan, and has been corrected to
represent accurately on the plan what is proposed for the project site. See revised
Figures 4.1-4.4 (1 : 200 scale) and Details A-C (1 : 50 scale).

b) Impact #2: The crossing shall be located below the confluence of the two channels.
This temporary crossing #2 was removed from the impact plans and will not be
utilized in the field. The crossing will be restored and the banks will be graded to
match upstream and downstream topography. The banks will be replanted
following the N.C. Guidelines for Riparian Buffer Restoration (see Figure 3).
c) Impact #4: The rip rap in the stream immediately up and down stream of the
culvert needs to be imbedded in to the channel to allow for better stream flow and
aquatic passage.
As recommended, heavy machinery will be utilized to imbed the rip rap into the
stream channel, thereby holding the stream grade flowing through the culverts and
allowing for aquatic life passage.
d) Impact #5: There is no need for the utilization of the temporary crossing.
This temporary crossing #5 was removed from the impact plans and will not be
utilized in the field. The crossing will be restored and the banks will be graded to
match upstream and downstream topography. The banks will be replanted
following the N.C. Guidelines for Riparian Buffer Restoration (see Figure 3).
e) Impact #6: The proposed temporary crossing should be upstream of the
jurisdictional limit. Strongly recommended that silt fence and check dam be
utilitzed to prevent the potential of sediment entering the stream below the crossing.
This temporary crossing #6 was removed from the impact plans and will not impact
jurisdictional stream or wetland areas. The crossing will be restored and the banks
will be graded to match upstream and downstream topography. The banks will be
replanted following the N.C. Guidelines for Riparian Buffer Restoration (see Figure
3).
fi Impact #7: There is no need of the utilization of this site for a temporary crossing.
This temporary crossing #7 was removed from the impact plans and will not be
utilized in the field. The crossing will be restored and the banks will be graded to
match upstream and downstream topography. The banks will be replanted
following the N.C. Guidelines for Riparian Buffer Restoration (see Figure 3).
