BREC has been authorized as the agent for Mr. Littleton to assist in responding to this NOV and further to bring the site into full compliance.The owner began work on this site in August. Attached to this letter are corresponding historical aerial photographs of the site. The site has in the past a drive in movie establishment. (The screen still exists) According to the owner and shown in the aerial photos the stream in question was piped already in 12" RCP pipe that was failing.The owner wanted to replace and maintain the pipes as is. Mr. Littleton was not aware that this was not permitted without a 401/404. Accordingly our firm, on his behalf, will be submitting for the 401/404 permits for the replacement of these existing pipes. We look forward to resolving this matter. I have made the owner aware that in future projects he should secure a consultant to work through the permit process. A map of the site impacts and JD waters is attached. Please feel free to contact me if you have any questions for need further information. We would welcome a site visit at any time.
