My partners and I are concerned about the potential amount of water introduction to this creek that couid create significant impact to the stream bed and bank above and below the high water mark. Affecting not only on our property; but the properties and bodies of water it feeds downstream. We received notification at the end July from NCDOT about the project, and two of my partners met with and asked a DOT representative to answer questions about the measures taken to protect this body of water. We have yet to have those issues addressed. Since that time, we have corresponded with other representatives from NC DOT, NC DENR, NCWRC, Yadkin River keeper as well as an Environmental consulting firm and William Elliott from the USACE regarding this project. When we contacted Tasha Alexander of the Asheville office of USACE regarding our need to rebuild a 50+year old bridge that had collapsed we were told that if we were going to disturb the stream bank below the high water mark, that we would need to apply for a nationwide permit, engage the NCDEQ and NCW RC, be subject to mitigation protocol, submit appropriate environmental plans, be subject to project oversight by the USACE, etc. Or, if we could stay out of the stream above the high water mark ACE and others would be satisfied. Accordingly, we increased the bridge span and cost by more than 20% in order to stay on top and back from the stream bank and left the original foundation alone to again leave the stream undisturbed. We also scheduled all work giving full consideration for the October to April moratorium for trout waters. We have been conscientious and compliant relative to USACE advisement and would appreciate the same scenario for all parties involved in this project 600 feet upstream. My partners and I would appreciate any help with this matter that you can offer going forward. We are not interested in impeding progress, we just want to protect and preserve the natural state of this property for generations to come.
