Memo to project file: 2007-1621, Avery County Day Care, Avery County
I spoke with Tommy Burleson with Avery County regarding the return letter we sent to
the applicant on May 28, 2008. Upon inspecting the file materials, it appears that the
applicant had actually mailed back our original "on-hold" letter from September 25,
2007, and had stapled the application fee check to our letter. We never got a response to
the second item in our hold letter, namely the need for the Nationwide Permit applied for,
hence the return of the application. I informed Tommy that they actually didn't really
even need to have applied for the General Certification in effect at that time (GC3631) or
even now (GC3705), as they fall below the written authorization requirement threshold.
The Corps issued a NW39, and I informed Tommy they could proceed with the project in
accordance with all conditions of the GC.
